MY WIFE GOT A FEW PAY DAY LOANS BECAUSE WE WERE IN A LIL FINANCIAL DIFFICULTY BEING THAT I WAS COMING OUT OF HURRICCANE KATRINA IN NEW ORLEANS IN AUGUST AND NEEDED BAD HELP TO GET AN APARTMENT.. MY WIFE IS IN THE US NAVY AND WE COULDN'T USE THEIR HELP BECAUSE THEY HELPED WITH GETTING OUR CAR FIXED, BUT ANYWAYS WE JUST COULDN'T KEEP PAYING THE MONEY EVERY 2 WEEKS BECAUSE WE ARE EXPECTING OUR CHILD, SO THEY KEEP HARASSING MY WIFE AT HER WORK.. THEY CALL HER MASTER CHEIF AND CAPTAIN... EVEN THOUGH SHE WENT TO THE NAVY TO GET HELP THE PAY DAY LOAN PEOPLE VIOLATED THE PRIVACY ACT...... AND ARE THREATNING TO GET HER KICKED OUT OF NAVY, TO PUT IN JAIL FOR FRAUD,ETC, ETC.... WHAT DO WE DO? MY WIFE IS TRYING HER BEST TO SERVE HER COUNTRY NOT TO BE A CRIMINAL... WHAT DO WE DO.. HOW DO WE STOP THE HARASSMENT?

How to fix the collection calls

I too have a personal loan with Check N Go and I can personally tell you that they are a life saver. They were the only company that would give me a loan when I had no car to get back and forth to work. I have made everyone of my payments on time and they have been the easiest people to work with. All you have to do is make the payments you originally agreed to pay and then all the pieces fall into place. If you don't follow thru on the agreement you signed at the time of your loan, then who's fault is it really? It is not check n go's fault that you do not pay your bills. You had no problem at all taking their loan and you are basically a dead beat and don't pay your bills and want to put the blame off on someone else. I have no sympathy for you or your wife. Make your mayments like you are supposed to and you won't get the harrassing calls that you are complaining about.

Texas and Ceck-N-Go

This is a rebuttal the the person stating Texas prosecution laws for check lending. I have done extensive research within the Texas penal code on this issue and have some information to pass on.

Texas law states that if a lending company knowingly accepts a post-dated check for collateral on a loan they are doing so with knowledge that the check is insufficient. Theft by check laws in Texas do not apply to this type of check and will not be prosecuted as such or Issuance of a bad check.

I have been paying on a payday loan of my wifes for over a year and have paid over twice the loan back by now. I was unable to keep up the payments and they sold the account to a collection agency. My wife took this loan before we were married so I am in no way liable. They called me on my personal cell# as well as at my office. I informed them that I do not have the name listed on the check and to cease and desist.

I intend to settle the account when I am able, but all they can do is seek civil litigation. My brother owns a business and was given a $25,000.00 bad check for a job installed and because he stated 30 days to pay in full he became a lender and could not prosecute. Check laws change when you issue terms for repayment. Bank rules for bad checks become lending rules. Civil matter!!!

1. first of all NEVER NEVER make phone calls to these company.


that what these company what you to do is to call them so they can't id your phone number.


2.IF they sent the $200,$300 payday loan into collections the company sold it and that company has been paid in full [screw them]


by the time they send it to collections it been over 1yr old and most likely they have sold it 2-3 times already after 3yrs time limit run out fall off your credit report.


if don't? call the 3 credits and demand it be removed after 3yrs. most like it be sold off few more times to other companies like esm,nco,alliance, fbd, so on


they just sale it off to another company anyway EVEN AFTER YOU PAID IT OFF in 6month to yr they sale it off to another company not say a thing about it being paid off


then you get another company scaming you for money [fuckum]


3. if there calling your job or your famly it not legal.


[record your phone calls from them kept records of what time they call and who you spoke with there full name]


and sue them for $1,500 pre phone call.


3.if you in the miliarty in some states payday loans not legal anymore


if got the payday loan before that law went into effect them check N go has no legal actions on your head because they broke the law in even you the loan


check your local law first

The person right above me is completely wrong. Check N Go is totally responsible for settling the debt...even after selling it to a 3rd party. The 3rd party collector is the main culprit when it comes to harassment issues; however, they are still associated with the original company because they sold private information. NEVER USE PDL's!!!! They are mostly scams and rip-offs

TRUST ME... as much as I'd LOVE Check 'n Go to be the cause, most of the complaints here are the 3rd party collectors your accts were sold to. Check n Go tries collecting for about 60 days and then sells the accts.

As for privacy acts... that's something they really adhere to! They are calling her work because she gave that number. When she defaulted the loan, they have every right. Now, she has a legal right to say stop calling work, and I'd put in writing, sent registered. HOWEVER, they will still call home and cell and references!

It's not their fault you are expecting a baby. Payday loans are just that... you borrow just what you need til next payday and pay it off or pay it down.

I can't tell you how many people come in and say, "I only need $200", but when they are told they qual for $1000, they take all $1000! Now who's fault is that.

Stop using the Military as her "excuse". She's being paid. And, they have a very clear "CODE OF CONDUCT" the prohibits them from bouncing checks. First, it IS FRAUD!! It's illegal to bounce a check. Commanding officers will not only tell them to pay, but if they can't, those Officers will sometimes loan the money to help the person out... to get the Govt's name clear!!!! These actions are embarrassing to them!

And, for the record, for almost 18 months now.... Check 'n Go... along with other payday loan Companies CANNOT and WILL NOT loan to anyone in the military!! This is due to finance percentage laws.

Just tell them to get you one a FAIR repay plan. But, the more you avoid calls, the worse it gets! Keep that in mind.

Also, keep in mind if you make a commitment to pay, keep that commitment!! Don't just say what you think they want to hear... that makes it worse. Don't close your checking account. Don't file Bankruptcy. Don't disconnect your nbrs.
Be an adult and tell them you need help. YOU ARE NOT ALONE!!! They will work with you.

Now... it's against the law for them to threaten jail, prosecution, etc. If you get that threat, report it immediately. When you get a collection call, WRITE THE PERSON'S NAME, the date, time, and exact wording. You can sue if it's true!!

But, just know... it's usually not the payday loan company. It's the collection company and once the acct is sold to them the payday loan company is no longer responsible. However, if you report the collection agency to the original lender, they can remove them from the list of collectors that they sell the accts to... because trust me, with confusion such as what you are all dealing with, it inadvertantly reflects on them... not the collection agency!

I ran one of these offices for almost 10 yrs and I've seen it all.

What you don't realize is if a CSR from the actual CNG location where you took your loan out is contacting you, then they are NOT held by the FDCPA (Fair Debt Collection Practices Act) b/c CNG is the original creditor they are not considered a "debt collector" within the meaning of the FDCPA. Which basically means sending letter via certified mail telling them to cease and desist will get you nowhere.As by law they do not have to follow that. They were there to help you when you were in need. You are the one that did not pay your bill back, whatever your excuse, it is your fault and not theres.

Pay Day Loans

A Payday Loan is a consumer transaction, covered by federal law, the Fair Debt Collection Practices Act (FDCPA).

You are protected from violations of the law which include harassing telephone calls, threats, intimidation, calling you where you work, making a third party aware of the debt and extortion.

You can take legal actions against collectors who violate the law and your rights.

I got this information from Bud Hibbs. He is a consumer advocate with a very good knowledge and understanding of debt collectors and the abusive tactics they use. He also has ways of dealing with them.

His site is budhibbs. Might also check debtorboards. Some good info there too.


Just have one question: Aren't military members banned from using payday loan type places? I thought the Pentagon issued an order to that effect.

I HAVE HAD SOME FRIENDS THAT GOT CAUGHT UP INTO THE SPIRAL OF THE PAYDAY LOAN COMPANY. I HAVE READ THE OPIONIONS OF WHAT PEOPLE HAD TO SAY. I HAVE A FRIEND THAT WORKS FOR THE COMPANY AND SHE IS STRESSED OUT BECAUSE PEOPLE DONT WANT TO PAY THEIR DEBTS.

JUST AS ONE REPONDER SAID YOU GOT THE LOAN TAKE IT BACK. JUST BY WATCHING HER AT HER JOB I WOULD NEVER, NEVER BORROW MONEY AND NOT REPAY IT BACK. DO WE GO THE GROCERY STORE WITH BAGS IN OUR HANDS AND WALK OUT WITH OUT PAYING?, NO. SO WHY SHOULD CHECK N GO LET YOU COME INTO THEIR PLACE OF BUSINESS AND TAKE MONEY. THAT GOES FOR CAR PAYMENTS, HOUSE PAYMENTS, ADVANCES ON OUR CREDIT CARDS.

Check N Go is a loan agreement, the check is collateral...nothing more

This response is addressed to the so-called "Employee" of Check N Go. In Florida, as is the case in most states that allow Payday Lending (or Deferred Presentment, as it is more commonly referred to), the check is not considered "toilet paper", but it is also not considered a "check." It is considered collateral on a petty loan.

You comment that this is tantamount to fraud is both ignorant of the law and common sense. If you accept a post-dated check, you are already taking a risk. If you use the check as collateral in a loan agreement or deferred presentment agreement, you are accepting a different set of rules than those that govern standard banking (i.e. - Bad Check Laws). One of the most basic rules governing Deferred Presentment in Florida is that is NOT considered a criminal matter: rather it is regarded as a Civil Matter that must be resolved in Small Claims Court. Also, in Florida you cannot be sued for more than the amount of the agreement plus court costs and reasonable interest. I don't know about Connecticut, but I have had one of your "Collections" agents threaten me with a suit for triple the amount of the check, which I actually thought was funny since a DPP agreement is not governed under the "Bad Check" laws of Florida. He also threatened to have me served at work with papers - be my guest. Getting the judgment is the easy part (and most states force mediation anyway before they allow the option of a bench or jury trial.)

Bottom line is....don't say ignorant things online because they become a matter of public record...you just did that, and it could come back to bite you in the butt. Just pray that nobody at your work knows you go on here....

I am an employee of Check 'N Go and would like to appologize for anyone contacting your employer about your loan, that is against company regulations and shouls never happen. I am sorry they were harrassing you they shouldn't have.

I do have to point this out to all the people complaining though, we are a loan company, and when you take out a loan, regardless how small and with whom, you are legally and morally required to pay it back. If you default on a car laon, they take your car, if you default on a home loan they take your home, and if you default with a payday loan company, they cash your check.

As for the person who said the checks are the equvilant of used tiolet paper, you are wrong sir. Writing checks that cannot be cashed is a felony, and people will be prosecuted in both civil court to get the funds as well as criminal court to prosecute for fruad.

My advice to those people who have problems is this, if you cannot afford to pay the loan back, do not take the loan out.

In most states the post-dated checks you give a payday loan place (or anywhere else) are the legal equivalent of used toilet paper. They are exempt from state "bad check" laws because the company knew that there was no money behind them when they were written. Thus the consumer cannot be prosecuted for "theft by check" or other criminal charges.

Such checks are at best a promise to pay later, i.e. a note or other loan document. The company may use civil court similar to any other loan that was not repaid, unless they can prove that the borrower never intended to repay when they took the loan out. Such a circumstance would be criminal fraud, but it is nearly impossible to prove.

If you have proof that you've already repaid considerably more than the original loan, go to the state Attorney General. Attorney Generals nationwide have a very dim view of payday lending.

forgotten check

since i went to that place back in 2003, i don't have that bank account anymore. i closed it before we moved from north carolina to indiana. i didn't purposelly forget about it by no means. i had some problems in the last month of my pregnancy and between those problems and having to leave work earlier than expected, and moving from a 2 bedroom house to a 3 bedroom house for base housing. then on top of that, we didn't have the money to pay a cleaners to come in and do it for us so we spent countless hrs. cleaning that stupid house which took us 2 weeks to finally get them to pass us on inspections because we forgot the very back corner of a room with a tiny speck of dirt on the floor and they failed the entire house! then on top of that i ended up having my baby on my couch in the new house. this all happened with in a months time period where i had too much going on i just completely forgot that the check was out.

it was an honest mistake, and i'm not saying yeah go ahead and forget about it that nothing will happen. it's not on my credit report, i've checked numerous times since i've gotten the only phone call which was a year later. i haven't had the means to pay for it. and i know your sitting there going "right, it's 3 years later sure they don't" my husband isn't in the military anymore (honorable discharge, contract ended) and had an extremely hard time finding a job. so he was jobless for 7 mths. until he found some little rinky dink job that paid him less than what i got paid where i worked and he had to drive a whole lot further. things are just starting to get better now, because he has an outstanding job so we were able to catch up on everything. no, i don't have a brand new car or house.........and infact, the 2 peices of junk were given to us from family members. so maybe in a year we will have saved enough money to have gotten a better vehicle.

it wasn't purposely the check went unpaid, i honestly did forget about it in the mist of everything that happned

Paying Back

First of all i would like to say I have a loan with check n go. Second of all I have paid over the amount I owe plus. I know these places are a ripoff, and am learning my lesson from it. I will probably never get them paid down all the way for a very long time.

I would like to reply though to the person that said they forgot about there loan and never went to jail. Well in the state of texas and how check n go works here is you have to renuew after 4 months and you do have to give them at least 3-4 checks filled out depending on the loan you received. If you do not pay this loan back or at least pay the interest, they will try to collect through your bank.

If the money is there they will get it right away, if the money is not there they will start proceedings to collect, and if you do not attempt to pay or ignore they will have it sent to the D.A. in your state. The D.A. then takes it as Theft by Check and will prosecute you.

In the state of Texas anything over 500.00 is a felony and you could spend alot of time in jail if you do not pay. Just a warning!! Oh and it wil be placed on your credit under verichek which will make it very hard for you to cash a check at any merchants store that uses this feature. I know this because my neighbor was in the same situation as I but he refused to pay.

I made the mistake of not reading the contract but thank god I do pay the interest once a month and when it is time to renuew I never get back the full amount but get back less 100.00 increments and this will go on untill I can get the complete loan paid off! On another note Check n Go will not let you make a payment on your loan such as 25.00 a wk. until it's time to renew which I find very annoying.

So to the person that never went to jail, your very lucky, cause they will take that check and deposit it, if they do be sure you have the money in your acct. cause if you dont it will go into collection or to the D.A. and you will be charged with "Theft by check" If your state does not acquire this then you are very lucky!

I too have had my share of these people and all you have to do is send them a certified letter stating do not call my home or work or my contacts and if they violate the letter, you can report them to the proper govt department for further action. I did, and sorry when I write a letter I mean do not bother me. And one visited my job and I told that person to leave and then filed a complaint.

I have not heard from them at all. I hope they do go out of business.

Though you may be mad at the company for wanting you to go good on your loans, please keep in mind they were there when you needed the money and gave you that loan.

If you were to loan to a stranger in good faith with a time frame set, you would expect to be paid also, and more than likely take them to court. Unfortunately our country is full of people who want to pass the buck and blame the person who has actually helped them. If you don't pay rent, eventually you end up out in the cold with a mark on your credit.

If you don't make a car payment, eventually you end up without a car. The only thing the loan co. has is your information and a post dated check that they take in good faith for collateral.

It sounds like though you have a problem of being in default it may be a good idea to contact their collector and set up some type of payment arrangement. It is worth it to face these things rather than hope they go away and have to put up with the stress of the phone calls.

navy relief

speaking from experience of using them before (husband was in the military), they won't help with bounced checks. and once they have helped you once, they won't help you again. we were stuck in an apartment that we needed to get out of because the transfered my husbands duty station from jacksonville, nc to havelock, nc. the apartment complex wouldn't let us out of the contract because it was 48 miles from where we were living and it had to be 50 miles before they would let us out of the agreement.

so after a letter from his command and help from navy relief, we were out of that place and into base housing in havelock.

i was pregnant at the time, and our bills were being payed as supposed to be, his command was more worried that i would go into labor and not be able to find him, when we moved to jacksonville i was alread 6 months pregnant and was showing pretty good so i decided not to get a job because i would have had to leave in less than 3 months.

after moving to havelock, miliatry started screwing up his pay on more than one occasion and needless to say, it all went down hill from there. we got behind on every bill we had except for car payment, and took out a loan to consolidate all the other things (which was a terrible mistake). navy relief refused to help us because they said we should be able to make it on our own and that they shouldn't have to help if they have already helped us once before even though the military messed up his pay while he was in japan and we had to pay it back . he was getting paid 199.00 every two weeks, they told him when he was gone to japan i was not allowed to move anywhere and i was supposed to stay in havelock, so therefore i wasn't suppose to get bah for living in indiana.

WELL THAT WAS THE OST RUDEST THING!! IF YOU HADNT BEEN OR IN Y SHOES THEN DONT CTITIZE CAUSE IT COULD BE YOU NEXT BUDDY!!!

I HAVE NEVER BEEN LATE ON ANY OTHER BILLS... WE ARE JUST HAVING THE DIFFICULTY WITH THE PAY DAY LOAN DUE TO HIGH INTERST RATE AND THE FACT THEY DEMAND EVERY CENT BACK OR NO MONEY AT ALL!!!

ALSO THERE IS SOETHING CALLED THE PRIVACY ACT THAT SHE SIGNED AND THEY HAD NO RIGHT TO GO TO A 3RD PARTY WHICH IS THE NAVY..... INFACT, MY WIFE IS ABOUT TO GET KICKED OUT OF THE MILITARY BECAUSE OF THIS!!!

I CONTACTED THE ATTORNEY GENERALS OFFICE AND HE INDEED AGREED THEY HAD NO RIGHT AND THAT ITS CALLED HARASSMENT

You DO NOT want to continue down this road. As a U.S. Navy member you are fully aware that you are held to a level of financial responsibility that a normal citizen may not be.



You need to pay this debt as soon as possible. Ignoring it, and having your command repeatedly contacted in regard to it, will simply put you in a circle of problems you do not need.



You know, that your command will tire of this quickly and the higher and higher levels it reaches could eventually result in the end of your military career.



Go to Navy Relief, make them aware of the situation, get some financial counseling and assistance.

i had a check written to a payday company and completely forgot about it. i wrote this check in 2003 and just realized about year ago that it's on my credit. they called my grandma threating her saying that she needed pay for it or have me pay for it that day or i was going to jail. well needless to say, i'm not in jail. really, though if you can't afford paying them back and are struggling with other bills, talk to base legal and ask for their opnion about the siuation. the military may not be able to help you pay for this debt, but maybe they can give you advice for this debt.
