Well I was one of the stupid people who refinanced with Ameriquest for a supposed lower payment. Well of course we got suckered into a ARM and are payment skyrocketed. Me and my wife can no longer make our payments. Our loan was bought out by Citi Residential Lending, and we thought OK now we can get our payments back in order. We were three months behind. I called Citi and asked them if we could make arrangements to get my loan caught up, they were very pleasant and agreed if I could make one payment to them they would make arrangements on the rest. So instead I took all the money needed to get my loan up to date out of my retirement. $3,156.05 got the check and mailed it to them. Feeling pretty happy that my mortgage was current minus this months payment.

Well today I receive a letter in the mail with the check I sent them saying that this wasn't the agreed amount according to the plan. I calle dthem up and got a guy who was really rude who told me that the agreed amount was $4,200, which is total BS the agreed amount was actually one months payment which is around a thousand dollars.

The plan was I would pay one months payment not all of it and they would make arrangements on the rest. I don't know what to do. I called my State Attorney here in Wisconsin and he is sending me some paperwork to fill out, But, I am not sure what that will do.

These people are intent on foreclosing on me. I was asked to pay a little and instead paid alot. And they still won't accept my money. All during this time I am sure they are adding fees to my loan. What do I do? Can I sue these people even though I was in on the class action lawsuit against Ameriquest? They don't want me to get my mortgage current.

I know what your going through, and I even went to the extreams to contact the S.E.C. (securitys exchange), and I did not see a buy out, either hostile,stock, or agreed. So my question to all is...How did CITIBANK Inc. buy out AMC?

I am also a victim of AMC/Citi. I was so relived when Citi took over, just to realize relief was NOT on the way. AMC sent our payment from 1100. a month to 2400. a month by adding insurance at doubled the amount it was suppose to be and by paying my taxes early and forcing us into escrow for the tune of 1100. extra a month. I am currently fixing to close on a refianance, God willing. The people who are refinancing me were able to get through to someone and got them to accept 1 payment instead of the 2 they were demanding. I had to agree to pay 2 more payments before Dec. 31 2007. I do not know how this company gets away with it. Amc put us in the same mess. It seems all too apparent to me that this is a practice that Citi has become accustomed to. I filled a ripoff report in Oct. 2007. I received info that Citi hired the same person that was working for Amc. AMC/Citi was having us pay for insurance through Escrow for 2008 for the tune of 6000. while at the same time we are paying on this years insurance on our house that is only 3000. a year. When Metropolitian Ins. asked AMC/ Citi why they were charging us for insurance twice and doubling the amount that it cost they said because were were Forced Place insurance. Did not make since even to our insurance comp. because we never lapsed and we pay them biweekly through my husband's comp. benefits and our insurance automatically renews yearly. This company tries to default loans. Good Luck, I just wanted you to know you were not alone. I would print all these reports and take them as evidence when you report the Mortgage Company. Maybe that will help. Why is it some companies are going out of their way to help people save their homes in all this mess, and AMC/Citi does quite the opposite. They will not do loan modification or even let you miss an escrow payment and just pay on your principal. My heart is with you. We just got the go ahead from our Mortgage Broker to change the lender on our Insurance and fax it to our new company. We have to close before the end of Dec. 2007 or Citi is going to foreclose on us, and we have over 45000. equity in our home. Good Luck. I will pray for you to get relief and you pray for us. Christmas is suppose to be happy, not stressful on trying to save your home and the home of your children. The burden of proof is on theirside, the amount of people that they have done this to speaks volumes!!!

I have been fighting these people for over three years including filling chapter 13. That didn't stop them from trying to foreclose on my house. After three attempts and three failures...I got refiancing but they also stopped that by changing the payoff amount....However it was discovered the original closing documents voilated federal law and I was able to cancel the loan agreement...getting back all money I paid plus closing cost and all fees charged.....check your closing documents for violations in the truth and lending act as well as fair credit reporting act the federal trade commission and respa real estate settlement act. any of these can get you out of this loan...

Hi Steve,
I to got into this trouble with AMC and here my profession is real estate and of all things it's dealing with nothing but foreclosures so don't feel like the stupid one. For one, contact at least one of your local news stations and give them your story, all the paperwork, etc and let them run with this and make CITI publicly look like the idiots they are.

If your local stations don't want the sotry, which I can't see them turning it down, still call 20/20, Dateline NBC, they all love to do personal stories like yours and in many cases they really get results.

Also, contact a local attorney that specializes in mortgage foreclosures, a lot of them have free consultations and can guide you in the right direction as far as filing with your local court for the judge to at least put a hold on any foreclosure action against you until he's heard the case, seen the evidents, etc...

I know it is going to be hours, days, months worth of fighting but the end result will be heaven if your home means enough to you to fight for it.

I never did sign up for the lawsuit because the settlement per person didn't put a dent in the $53,000 they "Tried" screwing me out of. I took my knowledge of the Michigan laws and fought with everything I had in me for almost a year but I got the results to date that I was fighting for. I had one more round to go and then CITI bought them out BUT, all they did was buy out the illegal dealings that AMC started so now they are just as guilty.

Get some emails out to your state reps, congressmen, etc and don't give up! Get on the web and research you state website and get answers & don't stop until you get the help!
