I wrote this letter to Citibank and I was told that they would not do anything to help me, they would rather I sign bankruptcy, then to take my payoff.

A situation has recently come to my attention that I am asking for your help.  I have been a customer of Citi Card for years.  You were kind enough to allow me to be placed on a payment plan my bill is 11665.06, I was paying 366.00 a month, but my family has fell on hard times and I have had to go to a Debt Management Program.  I was told that you are unable to except my payment of 311.00 a month.  I had to go to a debt Management program so that I could pay all my debts, I did not think that it would be fair to file bankruptcy and not pay my debts back. 

My problem is that When I pay 311.00 which is all I have left out of my budget, the interest and charges are from 309.00 to 315.00 a month, so paying even this minimal payment it would take me 29 years to pay off 11665.06.  If you check your record my beginning balance was a little under 17000.00 and I was paying it down faithfully. I am now asking for help, I have already paid so much in interest, that I am begging you to reduce my debt a small amount, I am willing to sell my car, I will get about

7000.00, I would like to know if you could take this as a payoff.  I really want to pay off my debt and not have to take the next step which would be bankruptcy chapter 13, which means no one will get any money.  I have always been one to pay my bills and I would like to pay this off, rather than have it charged off or written off, it has already hit my credit and made my score bad, so I have nothing to lose, but I would like to pay my debt off the best I can.  I have called Citibank several times asking to speak to someone about my account, last time was 10/31/12, they always say they cant help me and there is no one else who can help me, because they are only allowed to help one time with a credit card.  Citi Card (Citibank) is a huge successful company, that I am sure care about their customers.  You have a good reputation with your customers and creditors, which mean you, have to be a company that care.  I am enrolled In Credibility Debt Management program I will provide my account number and my pay check stub as proof of not being able to meet this debt.  I have someone willing to buy my car, and I would like to take care of this transaction as soon as possible.  My effort is aimed toward making the most out of a bad situation with your help.  Thank you is a small token for what I am asking; I look forward to your prompt cooperation.   They would not help me at all, what kind of company would rather their customers go bankruptcy.

I was talking to CitiBank instead of my DMP, because they refused everything, they did not even talk to my DMP program.  I must have talked with my DMP and Citibank 15 times.  They said it was nothing that they could do to help me.  They said my option was to file bankruptcy.  They would not take any payment.  This is not my only bill that is why I can't afford to pay them 366.00, I just wanted a payment I could afford so that I could pay off my debt.  I do worry about my credit and I will pay everything off eventually, BUT I would never recomment getting any Citibank Cards, because if you get in a bind they are not willing to work with you, I have 5 letters and many calls to prove it. So unless you have tried as hard as I have to work this out I would hold on to my opinion.

It looks like you have some misconceptions and need to either talk to your current DMP, or find another one that will help you more.  Because there should be no reason that if you are in a DMP that you should be talking to the creditors, this is something that your DMP should be doing.

- Is that the amount that the DMP gave you?  If so that most likely also includes an Interest Rate Reduction as well, have you asked them about this?  After all if only $-4.00 to $2 a month is going to principal even on the DMP, your balance either increases each month or it will take you decades to pay off the balance.

- That is a very good that you want to "take care of business".  But you are incorrect, a Chapter 13 is a reorganization not a total liquidation.  You are put on a payment plan for 2-5 years and that money is dispersed to the various creditors.   After the period of time, any remaining debt is discharged(forgiven), so the creditors will probably get a good portion of the debt back.  Any debt that is discharged they just write off so it is really a no-lose situation for them anyways.

- Honestly if you are truly in a bad financial situation, how this effects your credit is the last thing you should be concerned with.  As that statement is a huge "red flag" to any creditor that you still feel that you can take out more debt.

But with that said.  Depending on your situation, a Bankruptcy can actually improve your credit.  The reason that if you have an open debt(even one's that are charged-off) the creditor may still be able to sue you for the amount.  But once a debt is discharged in Bankruptcy the creditor can no longer touch you.  So even though you have a BK on your report, you also have a "clean slate".

- Great you are willing to make this effort.  But Is this credit card your only debt?  If not, what else could that $7K go for?  Could it totally take care of other creditor(s)?  If so you could pay them off and then apply the money you were paying them toward this bill.  Have you made similar offers to these other credit cards?  If not...why not?  Why are you focusing on this one credit card so much?
