I had my mortgage with Citimortgage and switched mortgage companies in May due to the interest charged by Citimortgage. Citimortgage was overpaid by Quicken Loans over 1300 dollars. The agreed upon amount of the payoff was 95,468. After the payoff by Quicken Loans, Citimortgage charged me interest and added money to an escrow account. They already owed me over 1400 dollars in overpaid escrow. So, they are ripping me off for over 1300 dollars.

I would like to know if anyone is interested in being part of a civil suit against Citimortgage and Citibank.

If they owe you a refund you don't want a class action lawsuit, you have a cause of action yourself

If Citimortgage owes you money from excess payoff, the best way to handle it is to first get a copy of all of your refinance documents including the HUD1 and the estoppel letter for the mortgage held by Citimortgage. If you don't have a copy of the Estoppel Letter contact the title company or attorney that closed the refinance and they will have a copy of it in your file.

That letter will give the complete payoff amount due plus the per diem rate to allow for processing of the payoff. Once you have that document send a letter return receipt request to the right department for a refund of your excess payoff and a refund of your escrow account. Give them a deadline to send you the refund. Normally you get these refunds within 30 days of the refinance. If it has been longer than 30 days, make your deadline short (10 business days). If they don't comply, then report them to the CFPB and take them to court. Depending upon the amount due and your claims limit in your county, you might be able to accomplish this without an attorney in small claims court.

However, if it is larger than the small claims limit, take it to a consumer attorney.
