Let me start off by saying I accumulated this debt and therefor assume responsibility for it. I graduated highschool back in 2002 and got into college. I was in college for about a year, maybe a year and a half, all the while living with a roommate and paying all of my bills on time.

Well to make a long story short, my grandmother, who raised me, got really sick and passed away. I was left with all of the funeral costs, which totally drained me of all my money. I had stopped going to college when she got sick, and because of all the stress surrounding the situation I stopped working at my job because they said basically if I didnt quit they were going to fire me due to complaints about my performance, pretty much due to the fact I was under abnormal stress. Including some funeral costs and just everyday expenses for the next 2 years, I ended up accumulating about 30k in debt to credit card companies.

Well I ended up getting back in school and am now about a year and a half away from graduating with my bachelors in business economics and political science. I am able to live off of my loans while attending school full time, and I have a friend who lets me live with him for free. The thing is, with everything that was going on I didnt have the money to pay any of the credit card bills and still dont. I dont live with my parents which is where they send the statements and thats where they call. My parents work and are always away on some business trip, literally never home. I dont have the best relationship with them, so we dont talk often anyway.

So basically I was unaware of all the phone calls that the credit card companies supposedly made. Now I just got a letter from the J A Cambece, which is one of the attorneys that works for Collection America, or something along those lines.

They brought a letter to my parents house a few weeks ago that says I have to pay all the money in a lump some in 20 days. Its probobly already been over 20 days. I know the law office tried calling my parents house in the past couple of days. I have no idea what to do right now. I owe 30k, I have no job, as Im taking 6 classes and realistically have no time, and I feel like Im going to be sued by a collection agency.

I own no property, have about $100 in my checking account, and dont own a car. IDK what they can possibily get out of me, but I didnt realize any of this was going to happen. I honestly thought that I could wait until I was out of college and just pay the whole lump sum the first 2 years I was working. Pay off like $1200 a month or something to that extent. These people have talked to my parents and have said that the credit card companies called numerous times per day and left message upon message. They used to leave me voice messages on my cell phone more than once a day when I used to have it but just used to delete them because they would be bogus messages usually going something like this "Please remain on the line and a rep will speak with you shortly".

Do any lawyers have any advice on what a college student should do about this? I plan on and want to pay my debt back, I just need about 3 years to do it, maybe 4. Please help Im desperate people

CACH (and many of the other collections bottom-feeders) will try to trick you like this: Say that after all their interest, penalties, and fees, your $5000 debt has grown to $7500. CACH shows up, and offers to take $6000. Here's the fun part: The agreement CACH sends you says that if you pay the $6000 agreement in full by such-and-such date, the original debt will be discharged. You pay the money, then CACH sends a letter to the IRS saying that they have "forgiven" a debt of $7500 and YOU have to pay taxes on the $7500.

Whenever you speak to these people, whether they appear pleasant or not, when you come to some agreement you need to let them know that you will only accept the agreement if it's in writing, with that person's name attached and signed.

However, I disagree with dealing with any type of collection agency or their attorneys at all. There is NO law that says that you have to deal with them, period. Collect America is not your creditor, the credit card companies are. However, CACH, Collect America or whoever they claim to be now, most likely purchased your junk debt from them for pennies on the dollar and are attempting to collect the full amount plus interest from you. Want to take Collect America out of the loop completely? Send them the cease communication letter, which I've attached my own that I use, modify it to your needs if you wish. Good luck.

If you violate this ORDER, your company and/or employees who knowlingly violate federal law under the FDCPA, which is the Fair Debt Collection Practices Act of Congress, shall be subject to legal and/or criminal charges being filed against them.

p.s.- If all else fails, and you do get a judgement against you in court, you can always file bankrupcty and the judgement will become null and void. However, remember to NOT ignore a summons to court, and DO file an answer if you are sued, within the specified time the court gives you in the notice.

Get any deal in WRITING before making a payment.

Thanks for the info steve. The thing is I do want to pay back the money that I spent. I just cant pay it back right now. Does anyone think because Im in college they will have leniency with me and give me some time to pay it off? Should I/Can I take out a student loan to just cover the whole payment? Do you think the company would settle with me and let me pay a fraction of what I owe? Sorry for all the questions guys but Im lost here and the clock is ticking. I feel the weight of the world on my shoulders, its horrible.

I guess that may be my only option huh? I thought credit cards stopped accumulating interest after a year or so of not being paid. Also, I have heard if it is credit card debt you have and not morgage, loans or vehicle notes you can actually settle for way less than what you owe. Does anyone have any suggestions on what I should do? Should I call these people this week? Or should I write one of those "dont call me anymore, you have to write me, the cease to communicate or something like that". Does anyone think these people would actually bring me to court? I own nothing, there is literally not 1 thing in my name. Someone mentiioned something about being 'suit qualified', meaning you own property, have a job, trust funds etc. I have non of this so maybe they wont try to sue me due to the fact I have nothing. Im so lost on all of this, it has literally ruined my whole life.

First of all, FEDERAL law requires that a bad debt be charged off after 6 months delinquent which means that default interest can only be charged for the first 6 months. After that, FEDERAL law sets the POST CHARGE OFF interest rate which is substantially lower, at last I checked was 6 or 8%.

As far as the phone calls go, this is easy. Under the provisions of the FDCPA you can send a CEASE COMMUNICATIONS request. Send this by certified mail, return reciept requested. Put the certified# on the letter itself and keep a copy for your records.

Now when they violate your LEGAL REQUEST, you sue them under the provisions of the FDCPA. Step up to the payment window. Collect your money from these GENUINE bottomfeeders.

This is all very simple.

And, since you own nothing, they can get nothing except a worthless judgement.
Then they can get a wage garnishment order if you ever get a job, at which time you simply file BK.

Done.

You may have it in your mind to wait 3 years and attempt to pay these off but the problem is they will have accrued a ton of interest on them because the interest rate will be a default rate and will be probably 30%. You would be looking at over $100,000 to pay back. Even if they are nominal and are around 15%, this would be over 50K.

You state you're taking six courses so there is no time for finding a part-time job. Since there is no money coming in and there is no good relationship with your parents, the only option that would work is to consider to file for bankruptcy protection. I am no attorney, but I don't see any other way unless some of these other factors above change and you have some means in the meantime to pay these off. They are not going to wait three years and will harrass the hell out of your parents which will further the wedge between you and them. Bankruptcy just appears to be the only option, given your circumstances. It's on your record for 7 years so it does come with obtacles. Others may have some other ideas, but I don't see it. Good luck in whatever you decide to do.
