I am a guest service rep. for a hotel in Shallotte, NC. I checked in a guest on the 19th of January, 2005. Long story short he stole my wallet out of my purse and wrote checks to the Cracker Barrel in Wilmington and Jacksonville, NC. I don't know how a man could write and cash checks at two different Cracker Barrels on two different days in two different towns and no one noticed or asked for a driver's license when the checks belong to me (a woman with a woman's name). My DL number is on the checks as well. He managed to spend $383.62 in two days of my money at Cracker Barrel. Because of this I have had to close my checking account, file numerous police reports and go without any cash for over two weeks. I am a newlywed and he wiped my husband and myself out in an instant.

This all could have been avoided if the employees of Cracker Barrel had only followed the common procedure of asking for ID with a check. Especially because the amounts were so high!!! The sad thing is that Cracker Barrel was not the only place that he got away with this. He hit 3 other places but luckily enough my bank was able to catch those and refuse to pay them-but the guy still got whatever he bought with our money!! Please don't end up like us! Keep your cash close and your checks closer.

Contributory negligence on your part

If you are working as a "guest service rep" presumably behind a hotel check-in counter, what is your purse doing within view and even worse, within reach, of the general public with whom you are dealing? Shouldn't you keep it locked up for safety and perhaps even leave your checkbook at home if your entire life savings is stored on that account? Sounds like you are trying to blame everyone and anyone but yourself for your own carelessness.

I have been a cashier for Cracker Barrel for over 4 years. Our policy states that we cannot check id's due to the fact that some guests feel offended when we do so. When I first started we could only check on credit cards that had "check id" written on the back. Over time we have had more complaints from us checking id's than we have had on us not. We have never been allowed to check id's on checks unless our systems decline them. We work through a check approval company that has links to banks all over the country. If the bank states a problem with the account, our systems decline it. If anybody should be at fault, it should be the bank for not putting a hold on the account. While I do feel that our policies are a little extreme in this area, and I do think that we should be allowed to check id's, I understand why they have changed the rules so drastically. I have seen too many of my fellow employees put in the hot seat because people file discrimination charges on them. While the company is responsible for protecting its guests, they are also responsible for protecting its employees. The only way to have this changed is to contact the home office. If as many people called about id's not being checked as people who called because it is, then maybe the rules would change. Me, myself, was furious when I was informed we would no longer be allowed to check any id's (unless a card or check was declined of course). Good luck to you. Hopefully the policies will change soon.

Bank is liable

The bank is liable because the signature on the check, even if it is forged, probably does not match the your signature on file with the bank. If the bank accepts a check without YOUR signature they are liable for the money. Go get the money back from them. This is the entire purpose of signing checks - verification that the person's whose signature is on file matches the check! I am not a big fan of lawsuits but if they try to give you a hard time, just say you will take them to small claims courts to explain why they are taking money out of your checking account without your signature on the check.

This is a story (maybe true, maybe not) that happened a few years ago. A man had his checkbook stolen. The bank told him he would have to put a stoppay on each check not already cashed, at $12 a pop. He thought about and said he would not put a stop payment on them because it is up to the bank to verify the check BEFORE they deduct the money from the account and if they cashed any checks the bank would be liable, not him.

Good luck. There are enough hurdles for young people - you don't need to be jumping over one you don't have to.

Kimmie: The bank is liable and should refund your money. By law, the bank is to compare the signature on the check with your card signature they have on file for you. Failure to do this is negligent. Call the bank, ask to speak to a supervisor, and demand they refund your money or you will take your money elsewhere. Good Luck!
