Creative Marketing Solutions schedules tours and bookings for resorts such as the Westgate in Park City. Their employees work as Independent Contractors, and are not under the jurisdiction of the Utah Labor Comission. Therefore, if an employee quits and still wants to receive their comission, CMS can withhold their payment.
Example:
Katie works for 40 hours and only has 1 person show up for their tour at the resort. However, she has booked ten more people to go on a tour in two months. She quits her job, since she doesn't anticipate booking any more tours through the month. Because Katie works as an Independent Contractor, the Utah Labor Comission cannot make CMS pay Katie for any tours that show up after she no longers works for them.
