This is the first RIP-OFF report I have ever filed but I felt it imperative that I do so lest someone else be screwed over by this guy.

On 11/15/15, while at a gunshow in Tulsa, OK, I purchased a Cadex Defence Dual Strike rifle chassis from Justin Duval, the owner of DARC Ops Armory out of Shawnee, OK., for the price of $2400.

Before I completed the purchase, I made certain to ask plenty of questions, including whether or not he had a model that would fit my rifle, a Surgeon scalpel with a 591 action.

Justin said he did, claiming the Remington 700 chassis would fit my rifle, and my wife was privy to the entire conversation as she was standing next to me. I proceeded to inquire about how difficult it would be to install and if I would need a gunsmith, at which point he explained and demonstrated how to assemble it myself.

The next day, while I was at home, I happened to be viewing a different website online that indicated the chassis that Justin Duval of DARC Ops sold me was incompatible with the rifle that he sold it to me for. 

I immediately sent an email on 11/16 that stated the following:

To whom it may concern,

I was at Wanenmacher's on Sunday and purchased a black Drake Associates Cadex Dual Strike chassis. I informed the salesperson that I wanted it for my Surgeon scalpel chambered in .308 to replace the Accuracy International AX chassis that I currently had it in and I was assured that it would fit. Unfortunately, it will not. 
 
The Surgeon action has an integrated 20 MOA rail and it prevents the Cadex rail from proper fitment. Now, I am without a chassis entirely because not only does the Cadex not fit but I've already sold the AICS AX chassis that I removed from the Surgeon. Needless to say, I'm somewhat less than happy right now.
 
You may be ready to inquire about a receipt and therein lies another problem. I was told, by a middle eastern man who conducted the transaction, that I would receive my receipt via email and I have yet to receive one. So, below you will find a screen shot of the transaction charged to my credit card. 
 
I expect to receive a phone call first thing tomorrow morning when this email is received. You can reach me on my cell.
 
When I awoke the next morning, 11/17, I found that I had received the following reply:
Hey Matt we were slammed today since we had been working on the show since Friday so I'm sure Tony Thomas, who was born in and has lived in Oklahoma his whole life, or as you refer to him "the middle eastern man", I just call him the little Indian, was probably just so swamped he didn't get a chance to do it.  
 
I thought you asked for a Remington short action which is what you were sold, I know we discussed it being for a Remington short action.  As we both know it will fit it's just a matter of the top rail needing to be one that works around the integral Surgeon rail.  
 
I have had a few chassis that were made for a Surgeon still have issues with the top rail in the past and Cadex was able to swap out rails I think.  Let me check and see if I can come up with an easy fix.

I sat down, and typed the following reply in an attempt to be amicable because I didn't want to piss him off to the point that he wouldn't rectify the situation.
 
I just wanted this expensive screw-job to be overwith so even though he knowingly sold me the wrong thing, I felt it would be in my best interest to accept the blame for not knowing that what he was selling me wouldn't work.
Justin,
     First and foremost, please know that I meant no disrespect in referring to your associate, Tony, as a middle eastern man. I didn't catch his name while I was there and I could remember yours so the only other way I could find to describe who I was talking about was to mention what I believed to be was his nationality. 
 
     Secondly, after doing some more research last night I came to realize that this is all my fault. I was under the impression, by no fault of yours, that the Remington SA model fit all SA style actions. I wasn't aware that there's a separate rail model for the Surgeon due to the integrated rail on the Surgeon action. So, that brings me to my next question.
 
     At this point, is the top rail something you can swap out or do I need to go directly to Cadex, or? Thank you for your time, understanding, and assistance in this matter.
My email went unanswered and simply by coincidence, I learned that I had him as a friend on my Facebook account. The exchange of words is below.

Hey Justin, any chance I can get a response about the chassis I purchased on Sunday? 

DARC OPS: Sure thing, we took yesterday off since we had worked all weekend but we are back in the shop today. I've got a call into Surgeon and will let you know when I hear back about getting it taken care of

ME: If it wasn't such a pricey piece, I'd just 'modify' it myself but you don't wanna do that to such a beautiful piece of hardware. Ha!

DARC OPS: I completely understand

ME: Thanks man, I greatly appreciate it and sincerely apologize for the trouble.

As time wore on and I didn't hear anything from him, I was certain that it wouldn't be an easy task to find the right hardware so I decided I would simply return the chassis. Although he hadn't provided me with a receipt, even after my having asked for one, I had the transaction statement from my credit card company as proof of purchase. 

The messages below are what transpired via Facebook on the afternoon of 11/18:

11/18, 3:17pm

ME: Hey Justin, I'll be returning the chassis on Friday morning. This isn't something I really WANT to do but I'm unwilling to wait however long it may take for something to be done so I can put my rifle back together.

If you don't have a Surgeon compatible model in stock then I will purchase one from Drake Associates.

11/18, 3:34pm

DARC OPS:

I'm still waiting on a call back to see if the top rail is available as that's our best bet. I can't give you a refund on the chassis as we don't take them back once they have been installed. We want our customers to get a fresh, clean example of a chassis when they are spending that much.

Certainly if the reason it's being returned was because of a mistake on the customers behalf. I also have my doubts that Drake has a Surgeon chassis in stock as those are exclusive to Surgeon now. That's why I'd need the rail from Cadex directly or Surgeon

11/18, 3:34pm

ME: It hasn't been installed. It can't be installed because it won't fit. Not a single screw has been inserted in anything.

I simply slid the rail down the barrel and noticed how it came in contact with the Surgeon rail.

Even if I have to wait on Drake to get one in stock, it will cost me $2175 versus the $2400 that I was charged by Darc Ops for the exact same package.

It was at this point that my messages began to be ignored, and he wasn't even reading them. I decided to give it until the next morning to see if he would reply but he did not. While I was waiting, I made some contacts and the following message was sent on the morning of 11/19:

ME: 

To Whom It May Concern,

I've been in contact with the manager of Cadex for North America sales and have informed them of the fact that I was sold a chassis, by Darc Ops, under false pretenses. I was instructed to return it, however, I let him know that you wouldn't take it back even though it hasn't been installed.

I informed them of how I told you that my Surgeon action was currently in an AICS AX chassis like one you had for sale and I specifically asked if you had one that would fit a Surgeon action, at which point you pointed to an R700SA on the table and straight-up told me the R700SA would fit.

It was at that point I inquired about how difficult it was to assemble, if a gunsmith would be needed, and you proceeded to demonstrate how to do it myself.

I tried to be amicable in my email and accept the blame for not knowing what I was purchasing, however, you knew it wouldn't fit my Surgeon action and you sold it to me anyway.

The chassis has not been assembled in any way, shape, or form so you can either take it back and refund my money and that will be the end of it or I will dispute the charge with my credit card and post this entire ordeal on every large shooter forum that I'm a member of so that everyone will know what kind of underhanded dealings you take part in.

The ball is in your court so if I don't hear anything by tomorrow, I will dispute the charge and the chips will fall where they may. You should know that I have also solicited a billboard company to rent a billboard in Shawnee to warn others about how you do business.

Not long after I had sent that message I noticed that he had removed me as a friend on Facebook so I sent the message to his business page on Facebook as well. Within less than 5 minutes the message had been read and I was banned from being able to contact the page at all. 

Out of curiosity, I decided to punch the business name into Google and see if anyone else had been a victim of their underhanded dealings and this is what I found from October 2014:

I recently bought a highend Surgeon Rifle from Darc Ops Armory. They shipped this rifle with poor packaging and the rifle was received damaged by my FFL. My FFL sent them picture evidence and UPS documentation but Darc Ops Armory refuses to take responibility. Buyer beware - these guys will duck and hide and shirk responsibility when things go wrong even if its their fault. Not an ethical seller. Worst service i have encountered.

As you can see from the online forum post above, DARC Ops has a history of shady dealings.

Everything posted herein is factual down to the letter. Not one detail has been fabricated or exaggerated in the least little bit. 

Tomorrow, 11/19, I will be disputing the transaction on my credit card and filing a complaint with the BBB.

All I want is a refund so I can go about my business, never dealing with DARC Ops ever again.

 Whether or not the merchant actually received a notification about this report being filed is anyone's guess but it was only hours after I posted this when I received an email that stated they would refund my credit card in full. I made the 2hr drive, returned the merchandise, and the refund was processed as I waited.
