Unfortunately, I have to agree with Mr. McCasland.  Two of us here in San Jose (Fred and Duane) paid Miner $1800 each, for consultation services...and Duane paid much more than that, in order to set up a trust of some kind.

Dave Miner completely disappeared. Never finished any of the so-called "correction" process. He has left us high and dry...and $1800 gone. I've emailed and phoned over and over.

Dave, you know who I am. In fact, I'll email you notification of this complaint I'm making here with Ripoff Report. Feel free to make amends. Maybe you have good cause for abandoning our agreement, a couple of years ago?

I'm certainly disturbed to see Miner has been in business (or is representing himself as being in business) as of January of 2012 (this year). All the while not returning a single one of my calls or emails. Pretty brutal experience.

Mr. McCasland has twisted and misrepresented the situation and has resorted to this forum because he is about to lose his court case he filed against me.

Mr. McCasland contracted for certain specified services with IRx Solutions, which contracts the performance of those services to various Associates.  Unfortunately, I became the Associate servicing Mr. McCasland's account.

During the performance of those services, Mr. McCasland became embroiled in collections efforts by the IRS in its attempt to collect a substantial amount of back taxes, penalties and interest.  Mr. McCasland retained the services of another group to fight those collections efforts.  He then demanded a refund of the fees he paid to IRx Solutions to pay for the services of this other group.  In support of his demand for a refund, Mr. McCasland claims that IRx Solutions "disappeared with my money" and that he had no contact with IRx Solutions or with me for 5 months, requiring that he obtain other services to fight the IRS. 

Short-term collections efforts are not the focus of IRx Solutions nor are those efforts included in the services for which he contracted.  This was made clear on our website, in the documentation he completed to obtain our services, and in the materials he received after subscribing to our program.  But that has not stopped him from totally misrepresenting our services.

IRx Solutions offered a number of times to engage in mediation to resolve this dispute.  These offers for mediation were made to the large group of friends and associates to which Mr. McCasland was posting his allegations.  Each time, Mr. McCasland refused to accept these offers.

Mr. McCasland claims that he had no contact with IRx Solutions or with me for 5 months, which necessitated his use of another group to fight the collections efforts of the IRS.  Even if this were true, which it is not, the services for which Mr. McCasland contracted IRx Solutions did not include fighting the IRS collections efforts.  Further, Mr. McCasland has been presented with more than 150 email exchanges between himself and me encompassing the time when I supposedly disappeared.  As a result of this overwhelming evidence of his fabrications, Mr. McCasland posted no details in this forum of any so-called fraud perpetrated by IRx Solutions or Dave Miner.

Mr. McCasland got himself into trouble with the IRS and panicked.  He obtained services to fight the IRS which apparently cost him a significant amount of money.  He demanded a refund from IRx Solutions to cover the costs of fighting the IRS. 

He is angry that he received no refund from IRx Solutions and, as a result, he seeks to damage the reputation of IRx Solutions and Dave Miner.

It is just that simple. 

Mr. McCasland has not been defrauded in any way.  He has refused to continue with the Program for which he has already paid or he would have been already finished with that program.  This has been his choice.  I have already invested more than 30 hours in Mr. McCasland's case.  At our hourly rate, he has already exceeded in billable fees the amount of money he paid for the services of IRx Solutions.  It has been his decision to discontinue our services.  He is welcome to restart our services at any time and we will do what we promised.

Rather than do that, and because he is losing his court case against me, he has decided to resort to lies and misrepresentations in this forum.  Mr. McCasland is not an honorable man.
