DELL motors is defrauding the public they state they are a financing company that you are buying your car and when you sign the leasing agreement paperwork they state that they ordered the wrong form that it is acting as an buyers agreement. The difference is that when you sign a buyers agreement as you should you pay on your car and you get a title when it is paid off, but at DELL they make you sign a Leasing agreement meaning that once you pay the car off if they want to or not they can give you the title or they can say well you leased the car. so now your lease is done so you need to return the car or you can buy it for what it is worth. so if you paid $10,000.00 they can say if you want the car you can buy it for $6500.00 and if you dont they may have the right to take your car away that you just paid off because of that agreement that you signed and that they defraud you into signing it and giving you the impression that you own and are buying the car not that you are leasing ( Like a Rental Car ). and at the end you need to give it back. So tell me if this is not a SCAM and are working as FRAUDS!!!!!!!!

#5 REBUTTAL Owner of company

Lease Here Pay Here vs. Buy Here Pay Here

AUTHOR: New Owner @ Dell Motors - ()

POSTED: Monday, January 05, 2015

1. Our holding company has a state issued banking license, we are a registered finance company.

2. A Lease Here Pay Here (LHPH) agreement is similar to a Buy Here Pay Here (BHPH) agreement. There are 2 main differences: a. you only pay sales tax on the downpayment at the time of sale 2. your monthly installment includes a portion that goes to sales tax (6%) and a portion that goes towards lease tax (3%), these are built in to your monthly payments.

Why LHPH? To help you the customer minimize the total amount due at the time of sale in order to make your purchase more affordable.

Let's use an example (no warranty in this example for ease of calculation):

Car: 2004 Kia Sorento

Price: $8,495

Title transfer ($156) & tags ($50): $206

Downpayment: $2,250

LHPH:                                                                    BHPH:

1. Down $2,250                                                       1. Down $2,250

2. Title & tags: $206                                                2. Title & tags: $206

3. Tax (6% x2250): $135                                         3. Tax (6% x 8,495): $509.70

Total: $2,591 @ signing                                           Total: $2965.7 @ signing

Upfront cost saving of $374.70

3. You do not need to return your car at the end of the lease! This a lease to own contract, so we have lien on title and at the end of the lease term you own the car once you have made all your payments and  pay the residual which we typically keep around $300.  Once this is paid the title is transferred to you (the new owner).  All of which is clearly explained!

4. Under the BHPH model a lien is placed on the title until the vehicle is paid off. The main difference being the 3% PA lease tax which you do not pay as you paid the full sales tax upfront. This amounts to about $8/month on a typical monthly payment of $267/m.

I hope this clarifies the mechanics of lease vs. buy and why we do it.

You can find more information on this on the internet (LHPH vs. BHPH).

Under a BHPH model if a customer had only a single payment outstanding but could/did not pay, the lienholder has the right to repossess the vehicle to recover outstanding dues.

This is no different from treating the residual payment as an outstanding due payment.  Totally lawful and accepted practice performed by every dealership nationwide.

I totally disagree

I totally disagree with what this "rip offs" website has to say or complain about with the Dells Motors dealership. First and foremost, these are used cars .... not brand new. Secondly, knowing that they used, you should be smart enough to know to suppect some issue (s) being a used car. I have to be honest, I bought a 03 white c240 Mercedes several months ago from Dell Motors.  The car is a beautiful car but it had an issue or two when I purchased the car. When I brought the issue to the dealerships attention, they took ownership of the issues and corrected them in every timely fashion! Before I purchased the car, every detail of the purchase was outlined and what will be exspected from both parties.

Yes, I do have a pay off at the end of my three year contact which is a whole $248.00 ..... I have no Iidea what these other people are talking about. Anyway, Dell Motors of Allentown PA is not a rip off dealership but one of the better car dealers ou t there. Their service center is fast, uses dealer parts and explains in detail how they are going to put a smile back on your face for a lot less then you would some place else. I am actually looking at purchasing another car from them if I can talk ny wife into it!!!!  Lol .... I love Dell Motors and I look to do business with them for a cery long time exspecially now that they are under new managenent ...  it has gotten even better .... try them!!!!

*If* it really went down the way the OP said it did, this is a valid Ripoff Report

Just because something is legal does no mean it is not a ripoff. I certainly would not sign a lease agreement either, but one should not be penalized by unscrupulous dealers for being naive. A lot of people just do not know what they are doing. Note that the OP "bought" at a "buy here, pay here" joint, which means she is probably not of high socioeconomic status, and these are the people that often get taken. So now if someone Googles the company's name, they will see this report and at least see what the company does (again, IF the report is accurate). *I* would certainly never go to a place that would lie about what a person was signing; who knows what else they try to pull!

That being said, it is hard to believe a company would pull this kind of a stunt.

To the OP: if you have the form you signed, please upload it. Also, do you have any of the following info?

Make/Model/Year of car
Cap Cost: (this is the actual cost of the car)
Residual amount: (this is the amount you would have to pay at the end of the lease to keep your car)
Monthly payment, excluding tax
Length of lease (e.g. 36 months, 48 months, etc)

Thanks.

" So tell me if this is not a SCAM  "

I don't know for sure.    Could you explain why someone would sign a lease agreement if they intended to purchase a car?   If they were forging your signature, I could see it.   If you freely signed an agreement to lease and are now saying that you wanted to buy, then you have a problem.

" but at DELL they make you sign a Leasing agreement  "

This is the part I don't get.  How are they MAKING you sign an agreement that you supposedly do not agree with?  Gun or knife?  You are aware that the second word in "lease agreement" means that it is something that you are agreeing to do.

  I'm stumped.
