Tony James Vondell at Desert Toyota in Tucson, AZ sold my young daughter a 1993 Forerunner for $11,000. He claimed the mileage to be 169,000 and he told her that the car was too old to pull a Carfax when she asked for one. The forerunner broke down within hours of her leaving the dealership, and they refused to repair it. Upon retaining an attorney, my daughter was informed that there was indeed a Carfax, and that the odometer reading was misrepresented by 85,000 miles. Not only that, but the vehicle had been in a major collision and was deemed disabled. When confronted by my daughter's attorney, Desert Toyota's attorney agreed to cancel the deal and refund the $4,000 down payment and return her trade in vehicle to her. But not without ALOT of fighting and threatening. They returned her trade in, and have refused to return the title and license plates. Now she has a car that she cannot drive because they won't return the title and plates. These unethical, pathetic, unprofessional wimps should be all over the news, exposed for the losers that they are. When I called to talk to the sales manager, he said "well your daughter is an adult so she can sign a contract"... What a tiny little worm of a man. I have filed complaints with BBB, Tom Horne Arizona Attorney General, Tucson Police Dept, and the local news station. These snakes have messed with the wrong person.

If you can, get a copy of the info that the dealer sent to many lenders for loan approval   Many times dealers will know that they can't get a car buyer a loan approval. So they know after looking over the deal and the buyers income and say to them self this.

 

Hey sales manager. I know that this car buyer has good credit, BUT they do not make enough for me to get a bank to do the deal.  So CAN I send a fraudulent loan application through dealer TRACK. And send this fraudulent loan app to a bucket load of auto lenders. And make them believe that she MAKES MORE THEN SHE REALLY DOES ??

I have been hired by many attorneys as an expert witness to help law firms win cases against bad, dirty fraudulent car dealers.  I come in as an expert witness and I show the law firm who is defending the plaintiffs as to what might have happened behind the scenes or under the table.  

Once I get done with my investagation, most of the times the dealerships want to settle and make the bad situation go away. 

I catch dealerships submitting fraudulent loan applications to auto lenders behind the car buyers backs all of the time.  When a car dealership misrepresents a fraudulent loan application to a lender they set the customer up for financial failure.  The bank never gets to review the true picture of the customers financial situation.  Most of the time dealers do this to people who have good credit but low income.

 

If you are a car buyer and you plan to fill out a credit application make sure that you fill it out in your own penmanship and your signature and make sure that you get a copy of what you give the salesman or the finance manager to get a loan approved.  I caught a Chevrolet dealership in Arizona submitting fraudulent loan applications to Huntington national Bank. They did this because they knew that they would have a problem getting the customers financed because the customers did not make enough money but they had good credit.

Lenders do not use microscopes or magnifying glasses to loans where customers have good credit.  When they see a customer has a really high credit score they are less likely to decline the loan based upon what the dealerships submitted to them as far is a financial picture of the customer.

 

I have caught many car dealerships posting the wrong vehicle identification number in their advertisements that way if you go to their website and look at a car that you're thinking of buying and you copy and paste the Vin number in the Google search you might not find the real dirt.  

 

I caught a used car dealership in Florida posting the numbers that had nothing to do with the cars that they were selling.  There's big profit in damaged cars if the customer does not know that the car has been wrecked.  Car dealers are able to buy cars that have been wrecked with salvage titles extremely cheap.   

 

Yeah ever notice when you go to a dealership they always try to take you away from a new car and try to sell you a used car.  You cannot go to a dealership and ask for an invoice of the used car. You can't find out what they paid for it if they bought it way back of book that can creat a huge profit spread.  

 

I even have caught dealers submitting fraudulent RDR cards to the new car Manufacturers.  A  RDR card is a retail delivery report from the new car dealer to the car manufacture.  It lets the auto manufacturer be aware of who bought the car and their correct mailing address so the manufacturer can send them a survey it's called a CSI Survey.   Customer satisfaction Index survey that goes from the buyer to the manufacturer.  If the car dealer thinks the car buyer is going to be unhappy with their new car they will submit fraudulent mailing information about the car buyer to the car manufacturer they do this that way the manufacture cannot send the new car buyer a survey to find out how they feel or how they've been treated.

 

Ask yourself this question Mr. attorneys.  If the car buyer buys a new car and the auto manufacturer has false contact information regarding the new car buyer and the car buyer gets in an accident because of defective components on the car and the car maker was unable to send them a safety recall notice regarding defective components on their new car.  

 

Who can be held liable for preventing the auto manufacturer of sending the customer a safety recall notice in a timely manner ?  Many years ago I tried to get 3TV to do a story about CSI DIVERSION.  They had a reporter named Rich Skidmore who wanted to do the story, but the BIG BOYS at 3TV in Phoenix said NO he told me.

 

If you are a attorney and you help car buyers don't assume you know everything that goes on behind the scenes.  Make sure that you're willing to spend the money to hire an expert witness that knows what goes on.  I know a local Ford dealership in Arizona they got wacked HARD for over $200,000 for misrepresentation. 

 

Even accident attorneys should be looking in to CSI and RDR records If they have a case regarding a car  that was less than a couple of years old.  It doesn't matter who caused the accident look at both sides of the fence of both cars.  Most of the time your local media will refuse to do any stories regarding auto dealer fraud or misrepresentation or any kind of credit scams because that's where they get most of their advertising money from.

 

If you are a car buyer make sure that if you plan to buy a used car grab the Vin number the vehicle identification number off of the car and pay for a search of that Vin numbers history.  Do not grab the Vin number off of the advertisement on the Internet !  Never do that.

Many years ago I went up against the largest RV dealer in the country and I proved in a court of law that the RV dealership  submitted fraudulent documents to the court as evidence and I proved that those documents had forged signatures on them. 

I proved that the RV dealer never stolid the RV buyer that the complete FACE / FRONTEND of the coach had Been BASHED IN.  The RV buyer bought a new RV that had been in a CRASH on the dealers lot.  I also proved that the dealer never gave copy's of all documentation that they had in their Possession To the court. Bottom line they try to hide the proof of what really happened.

If you are a car buyer and you feel you have been wrong investing in the attorney that is willing to hire an expert witness to help you win your case.  If you get into an accident in your car or the other parties car is less than two years old make sure that your attorney is willing to subpoena the RDR records on both cars if the cars were purchased new.
