Dish Network has dropped channel claiming cost too high from the network (ex. Fox)


If Dish did not have Fox Channels when I signed on I would not have signed with Dish...I only watch Fox channels. 



 When I called to cancel the service they said I have contract and since it has only been 2 months I will have to pay $400 to get away from Dish.



Yes, I have all the horror story's too with dealing with customer service...the absolute worse EVER. Actually total MORONS! They can't give us the receivers we bought...they have been here several times to repair something.  They really really STINK!



I feel they have, by dropping my channels and cannot give me what I signed for, Breach the Contract.  I want out.  I hope we can get a class action suit against them.

I have lost some FOX programing already and expect to lose more Nov. 1st. I am interested in any class action law suit being considered.

What does it take to put together a class action lawsuit? ONE PERSON... willing to sign papers declaring that he or she forfeits the right to sue the company as an individual.

- That is ALL it takes..are you really sure about that?  And no I am not talking about getting a laywer to take the case.

Back to the OP. So the ONLY reason you signed up for Dish is because they had the Fox Network channels?  I have a feeling that is a bit of a stretch.  I am sure however that the agreement says that they can remove/add channels as they see fit or need to.  While courts can be very unpredictable, you are probably going to have a hard time convincing a judge that removing a handfull(as compared to the overall number of channels) is detremental enough to you that you should be able to void the contract.

As for the reason.  It is a contract dispute over carriage fees.  The Fox Networks want to charge Dish(and eventually others) more money for access to their channels, and of course Dish doesn't want to pay it.  Who gets stuck in the middle...the consumer.

Fox hopes that customers will complain to Dish about it, to get Dish to "cave".  Dish hopes that customers will complain to Fox about it, to get Fox to "cave".  Just as with every other contract dispute, they will go back and forth and eventually come to an agreement somewhere in the middle.  So your precious Fox Channels will be back.  Will that be 1 day or 1 year..who knows..but they will be back.  This is NOT the first time this has happened.  There is another dispute is between Time Warner who has a dispute with Disney/ABC.  There have also been a handfull of others over the years.

By the way, reports like this and talk about suing Dish is EXACTLY what Fox wants to hear.  Perhaps you should write a report on Fox as well.  And NO I do not work for, or have Dish Network.

 I don't use any "dish" service since I do not want to lose the picture in the event of rain or cloudy conditions. But I can sympathize when others who have are unable to cancel if they are miserable with the service for whatever reason.

Granted, consumers need to be a tad more savvy before they sign contracts, and should not do so unless they can afford to stick the contract out to term, but nonetheless, to be financially "forced" into keeping a service just because they were suckers, may require further investigation.

On the other hand..to be fair, the company had to send someone to your residence to set everything up and you are using their equipment. The company has a right as well to protect their investments. So it is a tough call.

I can say that if the service was to cancel any channels that initially came with the service upon contract..regardless of what it says in the contract, I would be mighty pissed off if they lost the channel(s), and then "forced" me to stay with the service or pay a steep cancellation fee simply because I signed a contract where in states somewhere in it they have the right to do this.

I am a firm believer in fairness. If I signed on to a contract to provide a service and the company can no longer deliver..at the VERY least I would expect the right to cancel without penalty. I have a feeling the law would agree..but to be honest it does require further investigation. I am far from an expert on satellite TV contracts, but I do have the ability to determine right and wrong.

..can at times even protect "morons".

Just because someone signed a contract that allows them to be ripped off, does not take away from the fact that it may be a rip off. And as well if a contract is ripping off one party who signed, it can and at times does render it legally void.

What does it take to put together a class action lawsuit? ONE PERSON... willing to sign papers declaring that he or she forfeits the right to sue the company as an individual.

Now of course it helps convince a lawyer or law firm to take on the case contingency or pro bono if there are many complaints.

Are there many similar complaints against Dish network? That can make the difference.

Did you not read the contract that YOU signed.  It plainly states that Dish can change the programing at ANY TIME at THEIR discretion.  There is no rip off here.  Just a fool who doesn't know how to read a contract before signing.  A class action suit ???  Get real.  You have absolutely no idea what a class action suit entails.  Not to mention that you don't have a leg to stand on, anyway.  Now...WHO is the moron ??????
