In April 2007 my old vehicle died, and being in desperate need, I financed an auto through Drive Financial. First; the car lot took the first payment because they said I did not have enough time to get it into the company before it would be due & then they did not send it to the company. Then Drive Financial called & said I had to make one on my cc to get it in in time. I explained to them I had already made the first pmt of $513 to the lot & she actually laughed & said she had heard that a lot from that dealer but they never send the payment in. I contacted the lot numerous times & they refused to discuss it with me even though I had a reciept for the payment. At the time I took the loan, I was General Manager for a hotel & the payment was not a problem. However several months later, I lost my job & have not been able to work due to an illness. I live on a widows pension alone now & tried to keep up with the payments anyway until it became a matter of making the full payment & doing without medication & food or making a partial payment. I was told if I sent in a partial payment in April this year that they would defer the amount I was behind to the end of the loan. They did not. I recieve at least 10 calls a day telling me they are going to reposess if I don't send in the past due amount. This has been going on for over 4 months now. When I callled & aske why the overdue amt wasn't deferred, I was told they do not do that & whoever promised it didn't have the authority to do that. With my illness & thier telephone harrassment, I feel like giving up but I have over $10,000 alreay paid into it & it isn't worth more than $12,000. But because of the high interest (20%) & late fees, I still owe $10,000. They play telephone games by saying my "case" has been assigned to "them" (hwoever the caller is from 1 to 10 or more each day) & if I will send in a certain amount they will defer the overdue charges, etc. I have asked numerous times if they would reduce the payments to about $300 because I am no longer able to work & they tell me they continue to bill me for the full $513 per month. You cannot believe ANYTHING they tell you. I am beyond frustration! I wish someone would file a class action lawsuiit against them like they have similar loan sharks in other states like Illinois. And I wish I had known about this site before I took a loan from them.

#4 Consumer Suggestion

Its not about who is dumb here!

honestly I work in the back end collections and agree with both of you! First, I am sorry about your situation but like it was said loan companies can't adjust your payment according to your life. Second there is no need to be so harsh, obviously she just needs some good advise. I collect day/night on charged off and seriously past due accounts but there is a limit to how you should treat people. I believe in advising them of the laws and letting them choose the surrender option or the hindering option. There is no need to call so many times.

Even though I am in the business, I still have sympathy for others. I know about getting in a financial bind. Just send them a letter asking them not to call you and go get you a vehicle that you can afford and cut your loses. If you still owe 10k trust me its not going to kill you to have a repo on your credit. There are several companies that will still work with you with a repo on your credit and just write them a letter of explanation.

"I have an appointment with an atorney later this week: he says if he does decide to file a class action suit, it will not cost me a dime." Well that's good, I would hate for you to come out of pocket to get $ you don't deserve.

"He says Oregon has laws regarding the unethical actions of auto dealesr & the financial companies that work hand in hand with them to prey on people." were the other lenders "preying" on you as well as you defaulted on those loans.

I paid for a 4 year warranty & is worthless (not out fault we don't sell warranties) & the vehicle is molding to the point of rotting the carpet & rusting the floorboard out under the back seat; because of a leak it had when I bought it (why did you buy a car with a leak, don't buy a boat with a leak either) & the dealer promised to fix it, (not out fault what the dealer does) but after they got my money, they did not want to hear from me again. The vehicle stinks unbearably. (not our fault the car stinks)The shocks are shot & the transmission is slipping.(not our fault what the dealer sold you)

so the dealer lied to you, we lied to you, you are a out of work sick widow, you bought a faulty car & you want your 513 payment reduced to 300 because your car stinks. The Stewart thinks you need to read his post about "common thread"

I just wanted to tell epople that your company is nothing but loan sharks In Illinois & other states there are class action lawsuits aganst companies operating like Drive Financial. You lie repeatedly, harass people like you think if you call 10 times a day, it will somehow change their financial situation? I have an appointment with an atorney later this week: he says if he does decide to file a class action suit, it will not cost me a dime. He says Oregon has laws regarding the unethical actions of auto dealesr & the financial companies that work hand in hand with them to prey on people. I paid for a 4 year warranty & is is worthless & the vehicle is molding to the point of rotting the carpet & rusting the floorboard out under the back seat; because of a leak it had when I bought it & the dealer promised to fix it, but after they got my money, they did not want to hear from me again. i dont understand what your question is. if you cannot make the payments they will call you. they are not going to lower the payments because of your situation. EVERYONE has a situation. this company would go bankrupt if we lowered payments based on "situations"
