I am at a loss for words with this company. I fully understand and admit that it is my fault my vehicle got repossessed but what has happened since is madness!! My car was repossessed on December 20th by a nice man who let me know what was going on and asked me for the keys to the vehicle so I wouldn't be charged for a new copy to be made. I did so. He then told me to contact drivetime to figure out the next step. I took his advice and called customer service. Customer service then told me to contact the person dealing with my case by the name of josh. He then gave me josh's phone number and extention. I immediately call josh. Someone answers the phone and I give them the extention. They tell me that that extention doesn't exist. Weird but I then ask to speak to josh. They tell me to hold. She comes back on the line and tells me she has no idea where josh is but asks if she can help me. I tell her that my car was just repossessed and that I'm just trying to get some information on what I need to do next. She says that she will give the message to a manager and that josh will call me back. Needless to say I did not receive a call back that day. 

I call again the next day and a man answers the phone. Once again I ask for josh. I am told that josh is on his way to the break room and will have to call me back. Of course I'm upset but I don't want to make a bad situation worse so I wait for his phone call. A few hours later he does call me back and he tells me that the best he can do is let me pay $1950 to get my car back (I owe $2050 after they tack on a bunch of money for the reposession fees so I get a whole $100 break) but that if I can come up with $950 within 10 days that he will put a 2 week hold on the sell of my car. He tells me to call him back on December 31st to make the payment and verify the hold. So I'm all excited that I at least have a chance to fix what I messed up. By the way I have had this car for a year and made the first 7 months of payments on time until a bunch of bad luck came my way. So December 31st I call. Josh is nowhere to be found. So once again I speak to a woman who offers to help. I tell her that I can make a payment of 780$ today and do have more that I just need to put into my account but its difficult when you don't have a vehicle. She tells me that's fine and that it will put a week hold on the sell of my car. I just need to make the payment and call back with the reference number. I also tried to get the info on where my car is so I can find out how much it is going to cost to get my car out of the recovery company's possession. She tells me that it doesn't look like my car has been taken to the auction yard yet and tells me that it is with united recovery. I google united recovery. There isn't one in my city or state.

Against my better judgment I still make the pbyment. Only it is for $750 bc that's the highest amount western union would allow me to send. I jot down the reference number and call back. Now there is only a recording that says: we are currently closed for the holidays. Click. Immediately I am filled with dread but vow to get my car back still. So I call back January 2nd. I ask for josh as always. I am then asked if I had spoken to josh already that day. I say no. He says he only asks bc he hasn't seen josh and doesn't think josh is there. Then as always he says he can help me. I tell him that I want to verify that my payment was received. He says it was. And then says that my car may or may not have been sold on the 1st. I then tell him what I had been told by the other people I had spoken to. He asks if I called back with the reference number. I told him I tried. He confirms they closed early on the 31st. He basically tells me that there was a request made on the 21st to have my car moved to the auction yard. That's the day after it was picked up at my house. He says he will place a hold on the sell and to call josh again tomorrow.
 
Now I'm really freaking out bc if my var was going to be sold without my knowledge and after all these promises I could've saved my money. So here we are to January 3rd. I called josh again. The woman tells me that he isn't in today. I ask to speak to a manager then. I'm told they are all in a meeting. She says she can help me though. I tell her that I have no idea what is going on. I am told that my car might be sold. No one knows where my car is. She tells me that the hold on my car expired yesterday. I tell her that there was a hold put on my car yesterday. She says no but that she will do it now and hangs up on me. Who do I turn to??? I just want to know where my car is so I can pay what I owe and be at peace again.

Let me again add some thoughts to this and expound a bit.  See if you can follow me thru this.  First, the basics if we haven't yet covered them.  If they sell the car at auction, whatever they get will be applied to whatever you owe them, which includes all the interest they would have received from you if you paid the loan off.  If what they get at auction won't cover that amount, and it usually doesn't, they come after you for the "deficiency".  They will sue you for that amount.  If your state allows garnishment, they will attach your wages.  The amount of wage attachment depends upon your family situation.  If you have dependents, then they can only attach a smaller percentage.  They may also get into your bank accounts.  For you, this is a worse case scenario.  Now then, what is happening according to you is different people are asking for different amounts of money and telling you once you send in that money the car will be released but everybody in that office has a different story, right?  Follow me, I have a point to all this!!!  Suppose they have already decided they are done with you and they are going to sell the car at auction.  Any money they can get from you now by verbally telling you to send it, then they are guaranteed to have at least that money, then they send the car to auction.  Do you understand this?  So then, what are you to do in the form of damage control.  I would plan for that worse case scenario.  If you have a bank account you've paid them from, I would urge you to draw that account down and don't put anymore money into it until this is resolved.  If you are paid by direct deposit, stop it tomorrow!  You can cash checks at Walmart for $3.  In this way, you can protect some of your money should they decide to attach your bank account.  However, if you open up another account at another bank, it is possible they can force you legally to disclose that should they obtain judgement.  I would also urge you, in your dealings with them to ALWAYS obtain a name or employee number and keep a phone log of who and when you talk to them.  Also, plan on needing access to a fax machine.  Find a place in your town which, for a small fee, will allow you to send and receive faxes.  Call around NOW and get the fax number so you will have it when you ask them to fax a copy of whatever agreement is made, if an agreement is made.  Lets look at one more fork in the road.  Yes, you can declare bankruptcy but since they already have the car, it probably won't do any good.  Bottom line here Mama is for you to get from them, in writing, an agreement that they will return the car if you come up with "x" amount of money.  If they won't give you that written agreement, then they probably have decided to string you along, get more cash now and then sell the car at auction anyway.

So you just want information.  Well okay here is some information, but probably not the information you were looking for.

You talk about paying the money to get your car back, and basically infer that if the car is sold you think you could have "saved" your money and not pay.  Well don't think if the car is sold you are "free and clear".  

When a car sells at repossession auction, in most cases it sells for less than you owe.  In these cases you still owe what is known as the deficiency balance.  If you do not pay that they company can(and offen will) start up collection activities and may eventually file a suit against you.

So in the end it really doesn't matter if the car is sold or not.  As if the $750 covers some(or all) of this deficiency balance you would have owed it anyways.  If by chance you had a positive balance after the car was sold you will eventually get the money back.

One other thing that seems to have gotten lost.  Remember that you are behind by $2050, and you have only paid $750 toward this amount.  If by chance you do get your car back you better be very clear as to how much time they are giving you to make up the rest so you don't end up with your car being repossessed again in a few weeks.

Exactly. I'm just trying to find out what's going on before I give them more money. I really want my car back and am once again making enough money to pay on time. Btw I never completely stopped paying, I sent what I could every month.

I have never had a car loan before so when I say I don't know what's going on. I don't. That's why I'm seeking out answers. Or seeking help from anyone who can tell me who else I can contact.

I just hope anyone who cares to judge someone doesn't end up in the same predicament one day. So if anyone has any idea who I can get in touch with please let me know. That's all I want.

Although the gentleman from California does make some great points (and he usually does), I would have to agree with the OP that if what he/she said is true, then it seems like either the left hand doesn't know. What the right hand is doing or they are intentionally giving the OP the runaround because they would rather just sell the car and sue rather than deal with the OP. If they are only interested in selling but are stringing the OP along just to get money now, then thats another matter.

So you REALLY don't know what is going on..well let's review.

You admit it is your fault for the car getting repossessed..well there's one point in your favor.  Let's keep this in mind for later.

You call them up and to get your car back they tell you that you actually owe $2050 but need to only pay $1950.  But you don't pay that, as they said if you can come up with $950 in two weeks you can pay that and still get your car back.  But you don't even pay that.  You call back and say you could only come $780. They still say that is okay.  But you then don't even pay that..you only pay $750, which of course is not your fault.   Then apparently this was so late in the day that by the time you called them back they were already closed.

Let me just ask you this..if the maximum by Western Union is $750(which by the way it is not), just how were you going to pay them the $950, $1950, or $2050?

So, by all accounts they reduced the amount to get the car back three times and you still paid them less.  Yet you are confused about what is going on and think it is all their fault that the car got sold.

Going back to the original statement..where you fully understand and admit it was your fault that the car was repossessed.  It is now probably time to fully understand and accept the fact that you are also responsible for the car getting sold.
