Complaint: Failure to pay for services rendered as per agreement.

I was hired to provide US sales and marketing for Elucidate/Nipplus. Mr. Jeneby O. Mathews and I agreed to work 20 hour per week for a sum of $1250.

I was instructed to start a project plan, in which Mr. Mathews added additional activities. Also, specific times were selected to work with Mr. Mathews. The last week of August I spent over 20 hours working.

The project was cancelled on Friday, and Mr. Mathews said he had no intentions of paying me. I could have used this time with other clients to generate income. I worked and should be paid for my time, regardless that the project was cancelled at the end of the week. I performed my side of the agreement/project plan.

As per the project plan, I submitted my bank account information for payment on 8/28/2014. I would have NEVER given my bank account information if I wasn't to be paid.

Mr. Mathews represents he is a CPA and a licenced PMP (project manager) with the highest integrity. I sent him emails to resolve this matter, but I have had no response. I want to be paid for my time.

Mr. Mathews, the owner of Elucidate-Software also know as Nipplus Ltd., ruins his own reputation by his actions of not paying for services contracted.  

I simply want to be paid what I am owed $1250, for one week of work.   The details are stated in the project plan Mr. Mathews wrote, which include the amounts.   In fact, in his rebuttal, he references the $1250/$5000.    I’m not asking for the $5,000, only the 1 week, $1250, that I worked.

Mr. Mathews can bad mouth me as much as he wants, but the fact remains, he used for my services for 1 week and he owes me for that week, $1250.   I am simply posting the truth, so that others aren't deceived by his words and actions.    If and when he pays me for what he owes, I will also post I have been paid. 

I would appreciate if Mr. Mathews would tell me his US legal representation, as I cannot file a legal claim with his Philadelphia non-existent office, nor in Australia, where their home office is located.   I know of no Texas representation for Mr. Mathews or his companies.   I am very willing file a claim in Texas.    

Without being able to excercise any other remedies, I will continue writing more complaints about the money owed to me, on the different websites.   I simply want the money owed to me, $1250.

Demanding Money with Menaces

As a PMP and CPA with many years of project and business experience we would never agree pay $1,250 for 20 hours work to someone without a signed contact or agreement for services to be rendered. We run our business on professional basis and signed contracts, tax invoices, approved time-sheets and an essential part of our business processes - none of these were present in this case. After one week of negotiations we discovered Sue Davis could not be engaged for the job we planned. We sent scope of work and deliverables clearly required access to our system and this was never granted. Sue Davis provide a bank account and demand payment for services not rendered. Her resume at clearly shows Sue Davis is an internet marketer with WebGeek.com operating with callers based in Singapore. Our company needed a US market entrance strategist, a role she is clearly unqualified to do and inexperienced to manage.

As part of our due diligence during our personnel selection we requested an online face to face meeting via Skype which she refused, stating that she does not want her face on video cam, Just IM, Skype calls and email. After we sent the project plan for discussion, she sent her bank details demanding payment for monies detailed in the project plan even without a contract. I am a licensed PMP and use both Agile and PMBOK knowledge areas to resource our projects. There was no contract, no access given to our project management tools, no access given to time-sheets, no invoice showing “services”- nothing. We are asked to pay $1,250, the first of$5,000 per week payment that would represent her monthly fee. (see attached document)


The threats to ruin my professional reputation as a CPA, PMP, AIPA and our company’s consulting reputation is well documented in emails and Skype IM. This started soon after we realised she was unqualified to perform any of the tasks under discussion in our project plan. We declined to take her on. The job was offered to someone else and we have since paid for the services specified as deliverables on our project activity plan to the company we contracted. We are in the second stage of our contract and proceeding with a reputable marketing company for our US market entrance.

There are many reasons we could not hire. Her resume was full of unexplained gaps and could not be corroborated by online professional search and discreet calls we made as part of our due diligence. We could not find her details on professional networks such as LinkedIn. I understand that Sue Davies has spent a great deal of time and effort in online websites to make good on the threat to damage our reputation. The communication of these false statements with the intention to harm my reputation and that of our business, product, group, unless monies are paid is illegal and we have now engaged a legal practitioner in the Houston with jurisdiction in her area to take appropriate legal action to deter this individual from further demanding money with menaces in this way. 

We will be filing similar action including requesting restraining orders in the next week in other jurisdictions in USA where we believe our reputation has been targeted in this way unless a payment is offered. We take this threat to our reputation very seriously and will spare no effort and expense to ensure that Sue Davies does not succeed in the reputation I have built over many years and obtain redress by way of damages to the
