Here is the letter I mailed to Encore:

To whom it may concern:

Unless you'd like to have a conversation with the State Attorney General, I had better find a check for $247.95 in my mailbox by August 21, 2004. That will be exactly four months to the day that I cancelled my account and was promised a refund from your company. To be sure you have the whole story, here's a recap:

I cancelled my account on April 21, 2004. At that time, your "customer service assured me that my account would not be debited for the $169.95.

The check... for $169.95 was posted to my account on April 26, 2004.

As a result, I incurred $78.00 in overdraft fees for three transactions on...

I have sent all the information you have requested and have been told on several occasions that my file was in the "research department." Also, I have been told that I would receive my refund in so many weeks upon my compliance in faxing all documented proof of these transactions.

This will be the last time I fax my bank statement to your company. I have been put through ALOT of inconvenience in which I feel the fault lies in your ill mannered and unorganized staff's conduct. For instance, I have the fax confirmation sheet... (the ORIGINAL bank statement) per your request. Also, when I spoke with Betty, she discovered that another customer's bank account information was being referred to in my file.

Ever since the beginning, I've received nothing but lies and evasions from several of Encore's associates. Now, I expect my refund of $247.95 upon review of these documents. I have made numerous attempts to speak with a supervisor. However, ... replied that were not any supervisors available that I could speak with.

If this matter cannot be resolved then, perhaps you should lawfully provide me with the name and contact information of your statutory agent. If you have any questions, please call me...

Note: Since this letter Encore Financial has merged with "C.C.R." The 1-800-576-8220 is no longer valid. The answering service there directs you to 1-866-341-6692(wrong phone number!) Encore's calls regarding matters before September are taken by their corporate office (435)673-1530. When I finally got the opportunity to speak with a live person there, I was given the same reply as with most of my other requests, "Your file is in the research dept." If you ask me, Encore is using this avoidance tactic to further evade their responsibilities! Is there anything else I can do? I've never felt so raped by a company before in my life!
