Had moderately successful business at time of service. Unfortunately,business was lost and serious illness with hospitalization, unemployment and disability resulted. Tried very hard to work with enerbank but they were extremely rude and did not give needed information and they were constantly calling with threats. It was "pay this full amount or else".

Because of the medical expenses that needed to be paid for to SAVE MY LIFE, we ended up losing out house; leaving us with NO MONEY. Husband took job at MUCH LESS pay. Still cannot afford the large amount. Had to move into apartment in 2012. Did not hear for Enerbank since before we moved until October 26 when we got served with a lawsuit form them.

We are starting our bankruptcy this afternoon because of our situation. We cannot even feed ourselves. All we wanted was for them to work with us and lower the payment to where we could afford because we are low income people. They need to understand that people lose businesses in tough times and in areas there the economy is not good. We have been struggling since the middle of 2011 and it has become worse. We were on the brink of being homeless last year in 2013.

But, since Enerbank has done nothing but harass and threaten us and force a lawsuit over an amount that we cannot afford now because we are at a much lower income since losing our business and home. We have no choice but to go bankrupt (we have no assets BTW. we have NOTHING!!). I'm sorry, but I would rather live. Sorry to have suffered life threatening illnesses the past few years.But I would rather live. Like I said, I would have been happy if they could only work with us instead of being rude, nasty and threatening.

I finally had to say no more phone calls from them because of their behavior, but written communication and accepting what we can afford would be just fine. I just want them to leave us alone now since they did not even work with us or listen to us. Things happen to good people that are beyond their control. It says in the summons that they served us that they have tried to contact us. THIS IS AN OUTRIGHT LIE!! THEY HAVE NOT CONTACTED US AT ALL SINCE 2012 AND SINCE THEN WE MOVED BECAUSE WE LOST OUR HOME. IF THERE WAS ANY COMMUNICATION, IT SHOULD HAVE BEEN FORWARDED TO THE ADDRESS THAT WE HAVE NOW!! NO PHONE CALLS BECAUSE OF THEIR RUDE AND THREATENING BEHAVIOR!!

Dear Enerbank Employee,

 We have not recieved a single written corospondence from you in over 2 years other than the lawsuit that was delivered last week.  When Enerbank was constantly harassing us with the calls, they have flat out refused to work with us and they really hassled us when we paid then what we could afford (i.e. "That's not enough!!" and continue to harrass when we only had a small amount in our account to pay them).  Like I said, other companies, such as Sallie Mae and even Bank of America were willing to work with us during hard times. Enerbank refused. They just harassed us with threats.

EnerBank USA (the “Bank”) is a FDIC insured and regulated bank that follows all Federal Fair Debt Collection Practices Act policies. The Bank is willing to and does work with all borrowers that may be struggling to make their required loan payments, which may include a loan modification for qualified borrowers. In the event that a borrower requests that the Bank no longer contact them by telephone, the Bank will make efforts to contact the borrower only through written correspondence. Should the borrower choose not to repay the loan in accordance with the signed agreement, the Bank may, at its discretion and after sincere efforts to assist the borrower, pursue various methods of repayment. "here is a integrity check for you.  If you had in mind what you could afford..did YOU put that money aside where you could give them a lump sum payment after a period of time?  My guess is NO you did not.  So your "well we really wanted to pay them" is just a bunch of hot air..sorry but you can't get by that fact.  Oh and I am sure you will then come back with 1001 reasons why you didn't save the money.  But you see EVERY reason you come back as to why you didn't save the money is just one more reason why even if they let you pay less..you wouldn't have followed through, and why companies are very leary"

 

Excuse me, we DID and DO follow through the best we can and we have for the other companies who were willing to work with us. Bank of America worked with us, Sallie Mae worked with us, as well as others. We have made the lower payments like clockwork on time. We really did want to pay them, but we could only afford a smaller amount and Enerbank refused it. Instead they have made constant, threatening phone calls. how can we save the money when we didn't have the large amount? Wave a wond and have it magically appear out of thin air? You are just making very wrong and rude assumptions about us and I find that very insulting.

 

All we wanted was for them to work with us like the other institutions and we would follow through.

It is not for that one. It is for the medical debt that we have left over from chemotherapy, tests, hospital stays including the Intensive Care Unit, ambulance, emergency room, medication, medical supplies, doctor's appointments ect. (all the debt that we had no choice to accumulate because this was before the Affordable Care Act).

We are very responsible with our money. However, like I said, things happen quickly and you never know until you have been there yourself how quickly it does.

I am sorry, but your rubutal was very insulting and rude. You have no idea what we have been through.  Apparently, you have not been in that situation. You are just assuming that we are just a bunch of deadbeat when we are not.

First of all, we have an internet connection so we can try to earn money so we can keep a roof over our head. We are in a slightly beter situation, but not by much. We do not have control of the job market in our area or the economy here or anywhere else in the nation.

Second, the financial downfall was beyond our control. Our father in law was the main owner of the business and the recession happened. Like I said we are not responisible or the economy.

Third, every single lender and creditor we had and have has worked with us or at least turned it over to someone who can accept our payments without the threats. Including Bank of America, Sallie Mae and others. We signed contracts there as well, but they understand circumstances that are beyond people's control. Enerbank is the only one who has refused to work with us.

They should have sent us written communicaiton within those 2 years of no contact. We could have worked something out. But there was nothing.

I am sorry, but we just cannot wave a wand and have the money appear out of thin air. We have worked very hard for what little we have now.

I am sorry that you do not understand. Things happen VERY fast when it comes to losing what you had. Yes, I was very upset and extremely flustered when I wrote the original post and I should have clarified things more. Or at least proofread it. We will settle this thing with our attorney as well and we will work it out. I was pointing our the rudeness of Enerbank and the inappropriatness of the threatening phone calls.

 You need a severe reality check.

We cannot even feed ourselves.

- Yet you can afford a Computer and Internet connection? 


All we wanted was for them to work with us and lower the payment to where we could afford because we are low income people.

- Translation...we agreed to certain terms and after we borrowed the money we want to change them.  Yet because THEY won't do what WE want we are going to blame them for ALL of our troubles.

When you agreed to borrow and use THEIR money you agreed to certain terms.  I can guarantee you that no where in those terms was anything that said you only had to pay them when you could. 

But here is a integrity check for you.  If you had in mind what you could afford..did YOU put that money aside where you could give them a lump sum payment after a period of time?  My guess is NO you did not.  So your "well we really wanted to pay them" is just a bunch of hot air..sorry but you can't get by that fact.  Oh and I am sure you will then come back with 1001 reasons why you didn't save the money.  But you see EVERY reason you come back as to why you didn't save the money is just one more reason why even if they let you pay less..you wouldn't have followed through, and why companies are very leary about doing things like that.

As for the Bankruptcy...again people do not file a Bankruptcy for a single debt.  Yes, this in your mind may be the one that "put you over" to do it.  But the reality is that if it wasn't this suit, it would have been some other event in the next few months that would have caused you to.  The difference with this one...it allows you to focus your anger into a single company to blame them for ALL of your issues rather than force you to look at your situation.

I will also tell you that if it truly has been since 2011 when you stopped paying, depending on your State you may be beyond the Statute of Limitations.  If that is the case then you can prevail in the lawsuit by having it out of Statute.  However, you MUST go to court to defend yourself.  So if you are truly going to a Bankruptcy Attorney...this is something you need to bring up and inquire about.

Now know I am not saying any of this to be mean or rude.  This is to get you to look at this from a different perspective.  Because if you actually take a step back and look at the whole picture you will be able to move on a lot quicker than if you spend the rest of your life thinking.."Oh only if that one evil bank allowed us to do what we wanted we wouldn't be in this situation".

One final thing...No I do not work for any finance company or bank and would have said exactly the same thing regardless of the bank you listed.
