I atended an online auction with this company on proxibid. They sold me Train items that were new but in damaged boxes. Some of the items were listed as new in Box. Some items did list the items as damaged box with a picture of the box. None of the pictures or descriptions indicated that the boxes were crushed. An elephant stampede would do less damage. Also, some of the items clearly had water damage which was also not disclosed. In pictures of some items the rust damage was blocked so you could only see the good parts. NO pictures showed the BLACK mold. That boxes arrived with. This place is the worst auction house I have ever dealt with. They tried to tell me my shipper damaged the items aftr they left their site. They failed to tell me how my shipper water damaged the items without damaging the shipping boxes. Or how the items in the middle were crushed but not the items on top. They are the tru meaning of scum. Buyer beware.

Some people are idiots

AUTHOR: Stuart - ()

What I paid for the items has nothing to do with the issue. The issue is does the item description match what we recieved. do the pictures posted match what we got. What was paid is not the issue. Had I been aware of the item condition I would not have even bid on them. Fields usually ships USPS. Does USPS open up every box they pick up? Of course they don't so saying my shipper should have done that is STUPID. He is a shipper. He picks up and drops off just like USPS,  UPS, or Fed EX. SO if I got these via mail would that make a difference?

Telling me it's sour grapes because I paid less than I normally would have because it's an auction so I should be happy is moronic. I purchased an item not as described PERIOD. I paid for apples and got oranges PERIOD. Did you even look at the photo's? They posted good pictures and sent damaged goods.

So basically your saying if you bought something online from the pictures they posted and then got a broken piece of crap you wold be happy. Please give me your number I have a bridge in broolyn I want to sell you. If you have nothing intelligent to say don't speak!

its called a auction....

AUTHOR: Tyg - ()

Its called a auction for a reason. You get the opportunity to bid on something and get a chance to get it at a highly discounted price. Ive read both your post and thier rebuttal and your rebuttal. I hate to say this, but you claim they are using misdirection and smoke screens. Well your using crass language and a poor attitude. Im sure not every item you recieved was destroyed and im also sure that you paid quite a bit less then had you to purchase them at full retail.

Thier post only gives the facts related to thier part and thier investigation of your situation. Your post sounds like a child complaining. Your agent, needed to check the product before they signed for it. This one little step would have saved you from all this aggrivation. So you only sound like someone who is looking for anyone to find someone else to blame for this. Those of us that try and help the consumer can see this for what it is. A last ditch effort to try and embarass them into giving you your way. Well it backfired. They are not embarassed. They have covered themselves quite nicely. They have a well drafted post that explains thier side. Your posts are just passive aggresive attacks.

Important Information for the Reader

AUTHOR: Fields Auction Service - ()

Our company knows that the reader is fully capable of making their own determination on this situation based on the information provided by both the person making the claim as well as our detailed response. We will not engage any further into the nonsense with this individual. What we do feel is also important for our readers to know, is that this site, much like another well-known resource for company 'profiling' is considered by many as extortionist. This is an opinion, and according to Ripoff Report, anyone is allowed to post their opinion on this site and it will not be removed, so let's see if that is the case here. 20/20 in November 2010 did a story on the Better Business Bureau. Without making any parallels, with the BBB, a company pays a fee to subscribe to their service. Many people think the BBB is some kind of government run consumer advocate. WRONG. Ripoff Report has the offer for our company to pay $2000 dollars to arbitrate the complaint you are reading today. Yes, that's right two-thousand dollars. And "if" we win, guess what? They may even remove it! They have a place on this site that you can read. We call it, the 'don't even think about suing us for slander because we will win'. RipOff Report hides behind being a forum of Freedom of Speech. We are all for that, when it is fair and accurate. Go ahead RipOff, respond to this, as with the person that never actually bid on our auction, gave us a bad credit card, bought merchandise sold as very-damaged and then attempts to damage our reputation. We can take it. There are plenty of other sites where our words can sting too. We can post about this company and about our experiences with this bidder. The difference? We will stick to the facts, just the facts. What will surprise us is who will actually see this response as it is carefully placed far below the initial complaint. For a fee, a business can opt for one of RipOff Reports other services, such as the VIP level. Thanks, but no thanks. For those that DID read things this far, we appreciate you for doing so. At least you've taken the time to get informed. Knowledge is power. Lies and deceit brings you nothing.

ARBITRATE TO SET THE RECORD STRAIGHT

Unfortunately, those who get reported on Ripoff Report don’t like to tell the entire story about our programs and how they help both the consumer and the business.  No one works for free. Arbitration would cost more than 3 times the cost, plus the costs of an attorney for thousands more..  Ripoff Report uses real arbitrators including retired judges from here in Arizona. Ripoff Report does not mingle or have they ever talked with them about any case. Ever.

Lies and Misdirection

AUTHOR: Stuart - ()

Like most dishonest people, when confronted they use misdirection to cover the real issues. So I will address their comments so we can get back to the real problem; the truth of the matter. First lots of people in this economy were struggling and asking for help. Asking for items to sell is not illegal or unlawful nor is it even wrong like baiting and switching or selling items not as described. Like this seller did. I have an Ebay store online and I have a 99.3% approval rating from over 577+ buyers. This seller has indicated that I lied about having transmission problems then actually verified that I did by telling people I filed a complaint against Hyundai. If your transmission went 4k miles after your warrenty expired you would complain too. SO we address that misdirrection as well. As far as mugshots. Besides the fact that only a real d****ebag would bring that up then say unrealted to this issue, Many innocent people have them. I have NO criminal record, no convictions EVER and prior to that situation had never even had a parking ticket in 50 years.

The credit card mentioned was not declined because of funds It was not an active card and I had simply forgotten to update our Proxibid account after I transferred credit card balances as many people do to lower interest rates, it was a simple innocent oversight on my part.  I didn't even know there was a problem until after we asked Fields to help with the damaged goods as they never told us they ran the old card. It was immediately updated to the new card information. See how scummy people try to use smoke screens to cover their misdeeds. The facts to this case are that items sold on proxibid on August 20th by Fields Auction Services were not as described. At no time were items described as having black mold or water damaged. Yes my agent signed for 3 boxes which from outward appearance looked fine as he was only able to view the external boxes that housed the damaged items. The items inside were damaged already and packed away so they could not be seen by him. Unless Fields is suggesting my shipping agent had xray vision or that my agent opened the boxes, crushed the items, soaked them in water,  stopped time for the rest of the world but not the items so mold could grow and the items could dry off, then repacked the items in the boxes so that they looked perfect again from the outside. Is that what Fields wants you to believe? That is absurd and when something does not make common sense, it usually is a lie.

They are throwing out garbage to redirect the public into thinking we are the bad guys. A typical d****ebag tactic. As for payment. If I was having trouble paying I would not have paid at all. I could have just said sorry my tranny blew and can't pay. I asked if I could make payments because my transmission failed the day after the auction and I did not have $2,000 for it and the items at the same time. I asked Cynthia at Fields who asked the auctioneer directly. Mr Feilds said it was  just fine. If that was a problem or they had issue with my card that was the time to bring it up. They did not! I told them I would make a partial payment by Friday, which I DID. I then told them I would make a final payment by a certain date, which I DID again.I am a man of his word and did exactly as I said I would. I'm the type of person who you can make a business deal with a handshake and who keeps his word. Unfortunatley Field's Auction is not. They have 4 negative reviews on google but not one positive one. They removed the auction from proxibid after it concluded so you can't access the descriptions which in itself is shady. They requested it be sealed, mmmm, wonder WHY??? Fortunately computers store that stuff in history so I still have the whole auction including all photos and descriptions. So I have pics of an item looking great online, yet receieved an item crushed and covered in black mold. Bait N switch, you decide for yourselves. I have dealt with many auction houses and this is the only one whom I have a complaint with. Every one else stands behind their product.

So let's get back to the facts now. Feilds sold items as NEW IN BOX. not even the ones that do say some damage. I have items that were listed as NEW IN BOX with a perfect box in the picture and received severly crushed boxes, but zero damge to the external shipping box that housed all Field's items sold.  I have other items that were listed as "box is slightly damaged" and the picture they posted has a part of the item being sold maticulously placed in a very specific spot directly on top of severly rusted spots. Feilds placed pieces of the items on top of RUST so that only the good part or non-damaged portion  was visible and no mention of rust at all in the description. Suspicious and shady to say the least. So Feilds, why don't you stop trying to redirect the focus onto another issue that has no relavance to the issues being discussed here, be an honest business and stick to the actual, factaul, and truthfaul facts. It IS balck and white; Facts are facts. I am staying on subject and telling it like it is. No lies, no name calling, no misdirection of facts. The fact that 2 years ago I asked my community for help in selling items to provide for my family in an honest manner is so irrelavant, it's silly. Feilds sold items not as described and is now trying to say we are the bad guy. They are dishonest and are trying to defelct thew fatc that the proof is in the photos and descrioptions. Their own pictures and wording are NOT what I received. I thought I was purchasing a nice batch of apples and instead, received a rotten, molc covered bag of oranges. All they are doing is "muckraking" as they have no honest leg to stand on. I simply wanted a partial refund and/or replacemetn for the damged items as any good business would do for a customer. Instead, they chose to be disrespectful and dishonest. They sadly, have put profit in front of people, sad but true. Let's try this again Field's, state the facts of this issue. You did NOT disclose damage, period. Let the public decide, unseal the Auction so all can see YOUR lisitngs for themsleves. I will happily share current photos of the actual items received so that the public can form their own educated opinion once they have ALL the facts. IF you did nothing wrong, unseal the Auction, the ball is in your court....we are all waiting......

Buyer's Remorse-Reported Non Paying Bidder

AUTHOR: Fields Auction Service - ()

Sadly, the man who has filed this complaint (Steve Tyll) is not the registered bidder to begin with, it is a woman who is registered on Proxibid.com where the items were purchased. The condition of some of the items purchased was described in the listing title AND description as 'damaged' to 'very damaged boxes.' Perhaps the bidder did not read either of the two? The credit card we were provided with declined. We had to report the bidder to Proxibid for non-payment. For two weeks, the bidder was not able to pay, claiming all sorts of excuses including transmission trouble, to which they are also online on another website appealing to others to write/lobby on their behalf to Hyundai to assist them with yet another complaint. They are also on a third website called Panda looking for handouts, describing themselves as unemployed and in need of items that they can resell. "They'" refers to both the registered bidder and the man who has written this complaint against our auction company. Additionally, they both have mugshots online for issues, unrelated to this situation. The items were sold and then finally, after paid for, picked up in person. Although we are sorry that this individual(s) may be suffering financial difficulties at this time, we will not be scammed or slandered by a case of buyer's remorse. Additionally, our pick-up policy (when items are not shipped by our company) with Proxibid items-they MUSt be signed for before they leave the building that they are acceptable and good-to-go by either the bidder or authorized agent. This policy was followed. There were no issues at the time the items left the building. Fields Auction Service can not assume responsibility for damage to items once they have left our hands.
