Hello. My name is John Caster from California. I wanted to report this company for its failure as a company if indeed it even is a company. I first came across this company in hopes to take care of my citation. However, I emailed them asking what exactly they do, and this is what they emailed me back, "By using our service, we prepare the Trial by Written Declaration, but no specific defense is entered..." How would they claim to "fight" california tickets without actually inputting a defense? I am a retired attorney, and find this to be extremely unethical and fraudulant. 

I am a pretty reasonable individual, but this company seems to deface everything I stood for throughout my career. Here are just a few of the things I found out about this so called company::

 

This Co. is falsely providing online legal services. The registered owner is a Kenneth Goodwin, but the company is not registered with the state, the website is registered under an insurance company Pacific Preferred Insured Agency.

1. They claim to be Attorney Approved (but they couldn't provide evidence of such).

2. They claim to fight your citation, but only fill out the request for trial (reported to the Attorney General& FTC).

3. Claim to be licensed as a Legal Document Assistant, but cannot provide proof of such license (reported to the Attorney General & FTC).

4. Address provided on their website is a UPS store

5. No phone contact number

6. Facebook was started in December and generated 14 thousand likes from the country of Turkey (this trial process only is allowed in California, Wyoming, Ohio, And Hawaii).

7. False claim that they fight 400,000 tickets a year.

8. False claim that they were up and running for 2 years.

I hope this letter along with me flagging this company with the proper establishments will keep people from being deceived into their cheap price with no legal grounds. 

 

Just to name a couple companies that have been able to provide proof of a legitimate practice inlude the following::

Sure they may cost a few more dollars, but atleast they do what they advertised.

Also, I would like to point out that John Caster's email address of mungsquad@gmail.com is attached to fightmyticketca.com, along with the email address of mungvoh@gmail.com, and the owner is David An who can be reached at fmtca2013@gmail.com

I share this, because it became clear that the initial report that was filed against FightCaliforniaTicket.com was self-motivated by those owning Fightmyticketca.com.

John Caster contacted FightCaliforniaTicket.com under false pretense and began to threaten the company because he wasn't happy with how we go about fighting a traffic ticket using the Trial by Written Declaration.

He mentioned he was a "lazy retired lawyer" in an e-mail dated January 13, 2014 to our office. We are clear in our communication with those using our service that we don't enter a specific defense under the statement of facts, as it is our opinion that this is not the best strategy. In fact, it is our position that "less is more" in this situation and that you are exposing a defense that can be used against you later on if you wish to request a new trial (trial de novo).  It's a matter of philosophical differences and at no time is anyone forced or told that they must use this specific strategy.  Furthermore, we provided Mr. Caster, Ken Goodwin's phone number to speak with him, but he took no such action.  In fact, it is our belief that "John Caster" is not indeed "John Caster", but it is an owner of another ticket fighting website who wishes to hide behind email and pose as a "John Caster".  Just look how he ends his complaint, by promoting two sites and hyperlinking them (nice SEO strategy Mr. Caster).

At any rate, let me address some of his points (answers are in 'red') not to satisfy him, but to set the record straight for you, the general public:

This Co. is falsely providing online legal services. The registered owner is a Kenneth Goodwin, but the company is not registered with the state, the website is registered under an insurance company Pacific Preferred Insured AgencyThe company is actually owned and operated under Pacific Preferred Insurance Brokers LLC, which is registerd with the Secretary of State.  What's false is how "John Caster" incorrectly presents us in his complaint.   "Providing online legal services"  If this "lazy retired lawyer" would have read further, it would have been very clear that indeed we state we help prepare legal documents and are registered to do so.  Perhaps if he would have contacted us as we suggested, we would have clarified this point as well.   

1. They claim to be Attorney Approved (but they couldn't provide evidence of such). Similar to other ticket fightings sites online who claim to be "Attorney Approved", we claim the process has been reviewed by an attorney. However, Attorney Approved does not mean that an attorney reviews your individual Trial by Written Declaration documents. 

2. They claim to fight your citation, but only fill out the request for trial (reported to the Attorney General& FTC). Again, the form is completed and a position/stance is taken under the statement of facts, which we feel in our opinion is most advantageous. This is further explained when you use the service.

3. Claim to be licensed as a Legal Document Assistant, but cannot provide proof of such license (reported to the Attorney General & FTC). LIC # 63

4. Address provided on their website is a UPS store 

5. No phone contact number This is an online service with email support only; otherwise, we would be charging $200 +, like many other sites out there.

6. Facebook was started in December and generated 14 thousand likes from the country of Turkey (this trial process only is allowed in California, Wyoming, Ohio, And Hawaii). You have something against people from Turkey?!

7. False claim that they fight 400,000 tickets a year.  I guess this is where the "retired lazy lawyer" must come from. If you would have read the initial text on the site, it said "Over 400,000 tickets are fought each year using this process"  It's called a Trial by Written Declaration.  We NEVER claim to have personally fought this many. However, in the interest of adding clarity, we have updated this text on the site.  

8. False claim that they were up and running for 2 years.  The company that owns it has been operating for over 3 years, not sure where you got the 2 years from.  We have been helping people for over 2 years fight a ticket using a Trial by Written Declaration.

 

What is most obvious is how "John Caster" claims two sites that he feels delivers on their word.  Interesting, how he strategically added this at the end and put their website links.  What's even more interesting, is you will find more NEGATIVE comments about one of them on this site than any other out there. 

It is clear that after "John Caster" wouldn't contact us directly to discuss this further and the fact that he went online to file this report, only reinforces his ulterior motives.  

However, we should thank "John Caster", because he inspired us to do something different.  Previously, we were charging a minimal fee to use our service.  But now, we have decided to make it FREE to the public.  Yes, I'm sure "John Caster", will take credit for this and we should give him some credit. Because, although we stood behind the service we were offering, we feel at this time we would like to give back (I mean our real business of course is insurance and although we have helped many clients win their tickets and in the process prevent a hike in their auto insurance rate, we have always provided this service FREE to our clients and charged a minimal fee to non-clients) and this is just one way in which we do just that.

At the end of the day, we feel good about the many people we have already saved money for and feel that in due time, many more will agree and spread the word.  That's our best way to win trust in the marketplace, not by convincing a "John Caster" who promotes other sites at the end of a complaint, but by delivering for others, those that mean something to us, not a "lazy retired attorney" who claims to be named, "John Caster".
