RE: Capital Consumers Group AND Us Guardian Credit Card VICTIMS Refund info UPDATE Monday, November 11, 2002


Dear Victim,

Rip-off Report.com recently learned that First Capitol Consumers Group (FCCG) & US Guardian were shut down. Unfortunately, this means that we will not be able to process the last 633 names that we were previously negotiating for. Sadly, we knew this was coming sooner or later, but we were unable to inform you because we feared that doing so would adversely affect the governmental investigation.

REFUNDS WILL NOW BE HANDLED BY THE FTC BECAUSE ALL FCCG ASSETS WERE FROZEN BY THE GOVERNMENT. ADDITIONALLY, MANY OF THOSE INVOLVED WITH FCCG WERE ARRESTED AND JAILED .


There is good news; the FTC was successful in freezing the bank accounts, and other various assets in the possession of FCCG. This means that the FTC will now be in charge of refunding your money. Although this matter is now out of our hands, we are hopeful that they will be reimbursing all of you that were victimized! However, it appears that they will be issuing refunds on a pro-rated basis; meaning that you will probably not be getting a full refund. There is a slight chance that you will get a full refund, but you should not count on it. We estimate that victims will receive between 70-90% of the amount lost. Unfortunately, they will most likely not be reimbursing any of the long distance phone charges you racked up; not knowing you were making international calls to Canada!


HOW TO GET YOUR REFUND THROUGH THE FTC


The FTC told us to contact the remaining consumers who were on our victim list, or had recently filed a Rip-off Report. They asked us to instruct you to now file your complaints with the FTC via the FTC's website, www.ftc.gov, or via telephone by calling toll-free (877) FTC-HELP. FTC investigators have informed Rip-off Report that this will be a quick process, and that pro-rated refunds will be issued shortly.

To date, about 1,050 consumers have received a full refund through us at here Rip-off Report, and we are very proud of this accomplishment. We are also thrilled that we were able to directly affect the lives of so many innocent consumers in a positive way. Unfortunately, it has now come to and end, but we knew that this was eventually going happen; we just did not know when.

This has been a very time consuming and thankless job, but still rewarding! Knowing that we tried our best and helped so many, makes us very happy. However, we are truly sorry that we were not able to get everyone a refund. Even though our success has ended in this venture has ended, we do promise to continue working for unsatisfied customers and victims far into the future.

In closing, we would like to thank the many victims for their thoughtful e-mails thanking us, letting us know how much they appreciate our endless hours of efforts. If it were not for the thoughtful, and appreciative emails that we received from so many of you, our job would have been much more difficult. So thank-you for inspiring us, and giving us a reason to fight!

HERE IS WHAT RIP-OFF REPORT SUGGESTS YOU DO:



Go to your bank within 60 days of the charge, or as soon as you know about the charge, don't delay, and tell them that there has been fraudulent activity within your account. Explain that you wish you file a dispute, and demand that they assist you in accordance with Federal Regulation E.



According to the majority of victims interviewed by Rip-off Report, those who immediately called their banks to dispute the charges did not get very far. Many victims got the following responses from their banks: we could not do anything for you or you waited too long; it has been more than 60 days.



If the bank is says that you have waited too long, explain to them how you called their 800 number as soon as the charges were found, and were told by the bank that nothing could be done. Remind the bank that they failed to assist you properly at the 800 # , and instead, provided you with an inadequate explanation of your right to dispute. Tell the bank that it's their fault time has expired, and since they gave you the wrong info to begin with, they will just have to deal with it, take the loss and reverse the charges.



Tell them the truth; this was unauthorized and your account was NOT to be charged! Keep emphasizing how you never authorized anything! Direct them to the hundreds of victims reports that were filed on Rip-off Report.com. And if you're at the bank, walk them over to their computer and make them go to this site! If you are on the phone with them, tell them you will wait while they access this site! Either way, be persistent!



DO NOT TAKE NO FOR AN ANSWER!



Let them know nicely, that you were advised to Report them (the Bank) and this situation to the Banking Commission in your state. Since each state has a different name for the agency/comptroller over banks, find that name before you call or get to the bank so you can throw it in their face. The more knowledgeable you appear to be, the further you will get.



And just continue to demand the Federal Regulation E form! The bank CAN, MUST and WILL reverse the charge! But, you must be persistent; ask to speak to the supervisor or the area manager for all the branches in the state.



Let the bank personnel know you are meeting with the media later in the day, that you would much rather they do the right thing (as most other banks have) by looking at the complaints and immediately reversing the charge(s) to your account; no matter how long ago it was. Be sure to call the Media if necessary so you are telling the truth.



If you have to, be loud (but nice) in front of other customers. If you are just calling by phone, the above tactics should still work. The bank can easily fax or mail to you the Federal Regulation E dispute form.



CHARGES TO YOUR CREDIT CARD



If the charge was to your credit card (not debit card, check card, or checking account), contact the credit card company as soon as possible to request a dispute form. Consumers usually have a little longer to dispute fraudulent credit card charges (up to 6 months), but it is better to act right away. In this type of situation, credit card disputes are usually successful since fraudulent companies often won't contest the disputed charge. In rare cases, credit card companies will review disputes, but refuse to reverse the charges. If this occurs, complain to a manager and let them know you will be filing a report here.



Remember Don't let them get away with it! Make sure they make the Rip-off Report .. The more Reports filed on a Company or individual, the more likely it is that the authorities, media and attorneys will want to take

Dear First Capital Consumers Group victims,



If you used a phony name when filing a report OR if you filed for a friend/relative, you will not receive refund.



This is, UNLESS you send us an email titled "Filed report w/ incorrect name Re: First Capital Consumers Group".



In this email, let us know what name you used when filing your Rip-off Report, & what name you did use when signing up with First Capital Consumers Group. We will then forward that name on for refund processing. The reason we are bringing this up is because only 11 of the first 15 names processed could be identified as First Capital Customers Group customers / victims.



In addition, many First Capital victims are just emailing us their information without filing a Rip-Off report. Out if courtesy, we will forward many of those names on for refund processing, but we ask that you file a Rip-Off report before emailing us. Rip-Off reports help to build a larger working history on the company, it making a better case for the authorities, and more importantly, this will help other consumer's who come to the Rip-off Report. Filing a Rip-Off report is not a difficult process, and it is free. The personal information you do provide is strictly confidential!

I WAS ABOUT TO LET THIS SAD MISTAKE HAPPEN TO ME ALSO FIRST CAPITOL CONTACTED ME LAST WEEK MS.DAVIS CALLED ONICKA WILLIAMS ALSO CALLED CHRIS ALSO TIMOTHY TO SAY THEY WERE GOING TO GIVE ME A CREDIT CARD WITH A 2000 CREDIT LIMIT ALSO ANOTHER ONE WITH A 2500 LIMIT THE NUMBER I CALLED TO CANCEL WAS 1-416-488-4664 THE REASON I AM PUTTING THEM ON BLAST BECAUSE IT MIGHT HELP SOMEONE ELSE I WILL GO TO THE BANK TO CANCEL TRANSACTION BUT THANKS FOR THIS HELPFUL INFO...

We have sent everyone's first and last name to the company that is the clearing house for First Capital Consumers Credit. We could only go by the first and last name you used when filing your Rip-off Report.



If you did not give us your correct spelling of your name, you need to still answer the questions above.



HOW WILL YOU WILL GET YOUR REFUND?

If you had e-mailed us or filed a Rip-off Report against First Capital Credit, you will see your credit card or bank account credited in a few days.



If you closed your account, notify your bank that a credit is being issued. Ask them how they want to handle this with you?
