Hi, I recieved a summons a while back and went to court and the judge granted a more time . I recieved a new court date and it was later rescheduled. In the meantime i sent the company certified letter requesting validation of the debt and recieved nothing back.


 I have a new court date for later this month amd im not sure what to do in the meantime. This company will not give me any  valadation of this credit card debt. When I did go to court the lawyer representing Hannah and Assiociates or midland showed me a letter or bill they had tried to send me? Is this valadation?  Any help would be greatly appriciated! thank you

Hannah and Thugs have a reputation in the legal community as being somewhere below pond scum. I have seen them fabricate evidence to bolster their case against  a defendant. You need to find a good Lawyer to fight them on your own it might not be such a good idea. They fight dirty, real dirty.

It seems that Hanna will lie on court affidavits about his position and most affidavits attached are bogus in the information stated. Fred J. Hanna is NEVER to be trusted, his court filings should ALWAYS be challenged.  Fred is concerned about one thing; separating you and your money.

Send them a letter via Certified Mail + Return Receipt (NOT regular mail) stating:

Per the Fair Debt Collection Practices Act, I am requesting written validation of your claim, to include a copy of the original signed contract with my signature. I cannot respond to your claim until validation in this format has been submitted. Documentation in this format will be requested in any court hearing. A typed letter showing an account number and balance due is not validation.

Receipt of this letter is being officially time stamped

There is a statute of limitations for credit card debt, which is the amount of time that they can successfully take legal action against you for the debt. This time period varies for each state. You can find this time period for your state by going to the link below and looking under "Open Accounts."

If the number of years since you defaulted on this account and stopped making payments on it is greater than the number listed for your state, then they can no longer defeat you in any court action because the debt is  time-barred

i don't think that's validation of the debt

i believe you should ask for more, like a contract you signed with your original credit card issuer, payments you made, statements and their contract of sales, may be more.


now midland needs to prove that they own the debt and can legally collect from you, but in most case, they usually can't because probably they really can't. to my understand, u signed a contract between your credit card issuer and u only. if they didn't say someone else in your terms and conditions (like capital one, they would definite themselves as successor, assignee, etc), i don't see why someone else can go after you for your debt with the credit card issuer.  


anyone can snoop into your credit report, get your credit card debt info, like original creditor name , account name , number and amount, then try to claim they own the debt, but infact, they might just be scam or they can't prove ownership because they are not the original creditor.


they bought the debt dirt cheap, and try to collect from you in full amount, if u want to settle, pay them whatever they pay for the debt, definitely not the amount they request. but i won't settle. i also have to show up in court in May, surely ask them for proof that i owe midland, otherwise, i won't pay a dime. 


if you already in litigation, it's useless to ask for validation of the debt from them now. just ask them to do it in court. if u ever want to settle, make sure u file the stipulation of settlement and have the judge looked at it too. don't do anything outside of the court room coz your file is already in court. it would be best for u to do everything infront of the judge.


if you got sued by the original creditor (credit card issuer, bank) usually u have to pay up. but if it's debt collector like Midland, u gotta make sure you fight and check if they really can legally collect from you.


you surely don't want to pay money to the wrong guy, right? i read stories ppl already made payment to them, but they still sue.. .
