I fractured my ankle on October 9, 2009 at work.  The walk-in clinic I was sent to put me on full workman's compensation and made an appointment for me to see an orthopedic physician.  I requested he allow me to return to work half days until it healed as half my job is performed sitting at a computer. It is now November 18th and I have still not received one dime of compensation.


Lorraine sent a check for $200.00 on Oct. 29th, then proceeded to contact our HR rep the following day stating she was stopping payment on the check and I was instructed to mail it back to her, because the amount should have only been $15.31.  I make $19.25 per hour, and I was due 40 hours. Our HR rep contacted her and questioned her on how she arrived at this figure. She came up with some pretty creative mathematics and convinced our HR rep that it was all I was due. 


I contacted an attorney, who assured me that was impossible. Now Lorraine seems to have fallen off the face of the earth, she will not answer anyones calls or respond to anyones emails. My last doctor appointment's x-ray showed the fracture is still visible, despite that, I have had to return to work full time with restrictions, this in turn aggravates my employer, upsets my coworkers and in general stinks.


The bills are piling up, I am so stressed out from working in a hostile environment that I've even contemplated suicide. I can't wrap my head around how this type of thing goes on. I did everything by the book, I even went above and beyond working half days so my company did not have to hire a temp to fill in for me and this is the slap in the face I get. 


Lorraine should be fired and denied unemployment compensation that way she can experience first hand what she does to people, and I'm sure she has done this before, get this her title is Senior WC Claims Representive. She must save the company loads of money on the backs of poor people like me.

It has taken me almost two years to figure out the rules on how to file paperwork for what you need.  My claim is almost over.  I had to learn by mistake and fail a few times before I figured it out to get something done for myself.  If I could contact you, I could tell you what to do and who to contact to get the help that you need now.  But I dont know how to get my contact info to you?  If I type an email address, it will remove it.  Any suggestions?  I use america on line.  My email is (((REDACTED))).  Lets see if they block this?

The rules work like this: You get hurt.  You file an injury report.  You take your copy, they keep theirs.  You go to the clinic that your Employer uses.  They treat you.  If your going to be off work for more then three days, they owe you wages.  The first check for temporary disability wages is due fourteen days after your injury.  If its late, there are penalties for being 3 days late that increase when 5 days late and continue to grow at intervals.  When they are late, then owe a 10 percent self imposed penalty.  You send them a letter telling them that they were late and you demand they pay the self imposed penalty.  They have to respond to your request.  You have to keep proof that you sent a request and they received it.  She has 30 days to respond.  If she doesnt respond within 30 days she has to send you a notice that she is working on a response and requires more time to complete it and explain why.  She can delay her response for up to 60 days with good reasons as long as she notifies you on time correctly.  When your placed on workers comp, they figure your wages by requesting a statement from your Employer of all wages for one year prior to your injury date.  Everything counts.  Over time etc.  They total it then divide it by fifty two weeks and thats your benefit amount that your eligible for.  They have to send you a notice within 14 days explaining your rights, how much your weekly benefit amount will be and who to contact if you feel there is a mistake.  They cant just send you a check without establishing the claim first and telling you how much your eligible for.  There is a self imposed penalty for each and every notice required.  Keep every envelope for each correspondance you receive to prove by post date when you got it.  They have to pay 10,000 in medical bills and benefits combined before they have to accept fault or deny responsibility for your injury.  They have 90 days to accept or reject or exhaust the 10k.  Whichever comes first.  If they dont accept or deny before 90 days then its presumed they have accepted responsibility for your injury and they are on the hook for it.  If they dont send you the notice stating how much your eligible for weekly and they send a check without explanation instead then its presumed that they are agreeing to compensate you at the max amount allowed which is something like 1300 a week or so?  I cant remember the total exactly but its pretty big.  They owe you full wages for every day you are off work as long as you were off for more then three days.  I dont know how it would work if you went back to work part time or half days?  They could say if you are well enough to work four hours then whats the problem keeping you from working eight?  Then you have to have your Doctor write a report on the correct form reporting your status and explaining why you cannot work more then four hours a day.  There has to be a medical reason or they might think you voluntarily put yourself on part time duty and your Employer agreed to that so they dont owe you anything.  I'm not sure exactly.  I would have to research that one.  As long as the Doctor says you cant work full time and theres a medical reason then they should

I'd like to thank the person who refered me to Audit Referral, I did just that, I did finally receive some compensation, however, no explanation as to how they arrived at the amount was given. I still think they owe me money, and now that I've received some money, the company I work for and the attorney I contacted have stopped pursuing the matter. 

I feel as though I've been thrown a bone to shut up.

Next time I get a mortgage or utility bill I should try the Gallagher Bassett approach, I'll pay them what I think will shut them up, think they'll fall for it?

File a complaint against the Adjuster

I have a current workers compensation case with Gallagher Bassett Services.  I have experienced similar problems to those you have listed in your complaint but I have a different Claims Adjuster.  I figured out how to file a complain with the audit unit to have them investigate the Adjuster and look into her files for compliance issues.  I am going to file my complaint shortly and it will appear with yours under Gallagher Bassett.  Check the site tomorrow and read what I went through.  I think if we all unite together and file complaints with the audit unit we might be able to do something about what they are doing to people who are injured at work.  United we stand, divided we fall right?  Here is a link to the instructions on filing a complaint against an Adjuster.  The actual complaint form is included in the instructions.  http://www.dir.ca.gov/dwc/Audcomp.pdf
