In late February 2013 my wife and I purchased a 2007 Mini Cooper from Gibson Truck World. We were told we would be purchasing the vehicle "As Is" and signed a document stating such. After we agreed to the purchase of the vehicle we went to the "finance office" to sign the paperwork where we were offered the warranty on the used car and were assured that "this is like a new car warranty, it will cover everything but normal wear and tear." We were given the option of 3 different levels Bronze, Silver, and Gold.
Obviously we went with the best coverage since we were purchasing an older vehicle. I specifically asked about clutch problems and was told not if it's considered normal wear on the car but if not the yes it will be covered. After I got the car home I noticed small issues with the car I.E. the sun roof fabric was torn on the edges, the driver side visor mirror cover was missing and the visor was dirty. I also noticed that the passenger side mirror falls completely out when you put the visor down. Small things that did not affect the way the vehicle ran so it was not an issue.
Wednesday July 24th I drove to Oviedo, FL to take my son to his therapy appointment and when I got out at 4:30 my car would not start. I used my own means to have the car towed to my home 27 miles away. The following day I contacted the warranty company and they towed it to the local Mini Cooper dealership but the mileage was over the limit given so I had to pay an additional 18.00. The following Tuesday, July 30th I received a call from the Mini dealership stating that the ELV (Electronic Locking Mechanism) inside the steering column was bad and needed to be replaced and was told per the warranty company that was not covered.
The repair is 610.00 219.00 was the cost of the part and the rest was labor PLUS TAX! I said don't fix the car I was told everything was covered but normal wear and tear. Gary at Orlando Mini verified that this was indeed NOT a normal wear item. I called the Warranty company myself and sure enough was told that the part nor labor was covered. So later that day I called and spoke with the person, Hector, who sold me the "Like New Car Warranty" and was told that there's nothing he could do but refund the money for the warranty back to the bank in which the car was financed leaving me with a 600.00 plus tax repair on my car.
I explained to Hector that I needed a check for the warranty costs since the money in the bank didn't help me get my car out of the shop. By this time it's now Friday Aug 2. He said he'd have to check with the manager to see if that could be done. I said FINE call me back I need my car by Monday morning. Friday night I heard nothing, Saturday I called and left a message and didn't hear back. Sunday I called and left a message and by Tuesday Aug 6 I STILL HAD NOT HEARD ANYTHING BACK.
So by this time it has been two weeks that I had not had a car and have had to ask favors from friends and family to help me with my normal day to day errands. I requested that Gibson Truck World either pays the difference for me to get my car fixed, I have a 100.00 deductible that I'm willing to pay. Or to give me the price of my warranty back in the form of a check. The cost of the warranty has already incrued finance charged and interest at BB&T where the car is financed through so I just want the money or for the car's repairs to be paid for.
This is also what I discussed with Hector and heard nothing back. Finally I needed my car back and since it was clear that Gibson was not going to call me back I had no other choice than to borrow the money from my family to get the car fixed. I called Mini back and told them to move forward with the repair and I would just pay for it myself. So they had it repaired fairly quickly and took it for a test drive.
