GMAC has gotten us as well! After my Husband lost his job, then returned to work... they entered us into a repayment plan. At one point, the loss mitigation rep told us that she was putting in for a loan modification. We gave her all the documents regarding our jobs, expenses, copies of insurance, taxes,etc. That was in January of 2004.

We kept making payments on the repayment plan, and a Real Estate Agent they hired came out twice(3 months apart)to appraise the house.We kept calling our rep. Angela Romenelli from the Conneticut Office. She kept telling us that everything looked great, and it was taking so long because they moved offices.

A month later they got new computer software, 2 months later, they revamped the loan mod process. Understand that we were still making payments on the repayment plan. In July of 2004, Angela called to say she had good news. The new loan mod would be at an interest rate two points lower than we were paying and would be for 15 years at $ 1,850.00.

It would pay all our taxes and insurance. But in order for it to work, we had to give our one car back to the bank(volunteery repo.)to make the numbers work. We did this. We kept leaving messages for her. Every few weeks she would be in the office and answer my call. She kept saying not to worry. The one time she told me that her co-worker was on maternity leave, so again things were backed up.

In October of 2004 Paul Molnar from GMAC called to asked why we had not sent back the loan modification papers. I called him back to say that we never got them. He said that the computer showed that Angela sent them via UPS service on October 21. He said that he would have her re-send them, both normal and UPS mail.

I kept calling her...only to speak to her a week later. She said that the papers were on their way, and to not send in Novembers payment because we will have a new account and account number after we signed the papers. She said to save that payment to send in with Decembers payment. We never got the papers. I must have left hundreds of messages. Never got a return call.

I tried talking to Paul, but he said that he would leave her the messages that I called. No one else would talk to me, just told me to talk to Angela. I did receive two messages from some female(not Angela)saying that they had not gotten back the loan modification paperwork yet.

Yet when I tried to talk to anyone, they referred me back to Angela-whom never answered her phone. On December 4, GMAC filed a foreclosure action against us. When I did get Angela on the phone finally one early morning, she told me that it was common procedure to still send that paperwork in case we did not sign the loan mod. agreement.

I asked her why we were not getting the loan mod papers. She said that we should not worry, they just had to "re-do" the numbers, and that we would get them in a few weeks. To make a long story short, a Sheriff Sale is scheduled. On the day that we got served with those papers we got notice from GMAC.

They sent a letter stating that we do not quailfy for the loan mod because we broke our repayment plan, and because there was not enough equitable interest or something to that nature( I am too upset right now to go find the paper). There also was another repayment plan from Angela with $33,000.00 being added to the 4th and final month...a month before the Sheriffs sale.

On it was a sticky from Angela saying : "REFINANCE NOW". My belief is that they wanted to get as much money from us as possible, while doing two apprasils to make sure they could sell the house at a profit. That profit conviently was the $ 33,000.00 they added to our balance.

Also ironic is that puts the amount they want from us at the amount the house appraised for...twice. We did file bancrupcty to save the house. Our Attorney for the bancrupcty said that they still have not sent an itemized list to him, only a total of what we supposedly owe...so he has to request it again.

If anyone here wants to complain, they should write to their States Dept. Of Banking And Finance,and Attorney General. Also, tell your story to whomever will listen.

dont worry dont worry but still they did the same things over and over at least you have names and people to contact now did you record the times you called them also have you sent them any certified letters stating you have never received the papers they promised you if not DO IT NOW AND GET THEM i do not know how it works in your state but here in fla you have to go to court first before they can sell your home in court you can plead your case and then a judge decides

so now heres what you also need to do contact hud and the office of respa along with your attorney that i hope you have hired at this point and do file the complaints with your state offices good luck
