I was trying to make payment arrangments with this company and they told me it wasn't good enough. They told me to borrow money from my mother and my sister whom they had the names of, and shouldn't.

I asked to be put in the voice mail of the guy who handles my case and they said it wasn't going to happen. I was on sick leave most of this year and was explaining that I was trying to play catch up and they wanted to contact my employer which I responded no too. He said it did not matter he was going to do it anyway, he didn't need my permission.

He wanted to know why I couldn't borrow money from these family members and why I didn't get paid when I was on sick leave. This man's name was Robert whom worked with Eric who is the one who usually handles my case.

I had to change my phone number, because they would start callingif my payment was 3 days late, and call at least 10 times a day.

Advice from a Previous Debt Collector

Ok for starters, these other comments are ridiculous. Grow up? Really? I used to be a collector and spent all my days garnishing peoples salaries, and bank accounts. To answer your questions;

NO they do NOT have the right to pursue or use any body else in your families name buy yours. Furthermore, they do not have a legal right to investigate or acquire any information except in terms of the debtor, you. In order to pursue you and acquire your information they are required to have a judgment against you. This means that you would have to be served papers and sued. If you do not show up for court, they enter a default judgment against you. ONLY then can they utilize skip tracing tools to pursue YOU and you only. If they know your family members names, then they are breaking the law in terms of utilizing skip tracing.  Furthermore, you tell them that you want to work out a deal with them, they WILL do it. These people are like vultures. They buy up whole portfolio's of bad debt. The longer the debt is outstanding the wider the profit margin they have. Ie. Longer debt cost less to buy, they have to forward less back to the creditor and they ge to keep more themselves. So it is ALL profit to them. I would reccomend any debt over a year old to ask for a payoff of 30% less then they are asking Most debt collectors have a baseline % they can go to as per the originating creditor they are allowed to collect. They don't give a shit what % they hit as long as they are in their clients acceptable range. Another thing to consider when paying off debt is to ensure your payments are paying off the PRINCIPLE. This is the LAW. They cannot apply any part of your initial payments to interest first, NOR can they apply it to their own court cost and attorney fees. You should ask for a breakdown of what your payment is paying off. If it shows them paying off their court costs and attorney fees before it pays the principle, Contact the original creditor and inform them their collection attorney is ripping them off. Ie...get their fucking asses fired.

THIS TIME HOWEVER I AM DISAPPOINTED IN
YOU LACK OF REASONING & NAME CALLING.
BY THE WAY, HOW DO YOU KNOW WHAT I DO? DONT LET THE SN FOOL YOU. THIS KID IS TRYING TO DICTATE TERMS ON THE LOAN & THATS NOT GOING TO WORK! IF SHE IS TRULEY IN NEED SHE WILL DO WHAT THEY ASK TO GET HIS SITUATION RESOLVED OR SHE CAN BORROW THE MONEY ELSEWHERE & PAY IT OFF. IM SURE THIS IS NOT THE 1ST TIME SHE HAS HAD ISSUES AFTER ALL GREEN TREE IS A SUB PRIME LENDER. EVERYBODY RUNS INTO A SNAG WITH THEIR LIVES, BUT SOME HAVE IT HAPPEN ALL THE TIME. MOST OF THEM BLAME EVERYONE BUT THEMSELVES.
AS FOR DAN, FYI, YOU CAN CALL ANYBODY YOU WANT TO REACH A DEBTOR EXCEPT IN WA & WI AS LONG AS YOU DONT TELL THEM ITS ABOUT A DEBT. AS TO THE RIPOFF STATUS, ANY COMPANY THAT DEALS IN SUB PRIME IS GOING TO
HAVE COMPLAINTS CAUSE THESE DEBTORS FEEL THEY SHOULD BE TREATED LIKE
PEOPLE WITH GOOD CREDIT, BUT AS WE ALWAYS TELL KIDS, TRUST HAS TO BE EARNED & SUB PRIME BORROWERS HAVE NOT EARNED THE BENEFIT OF THE DOUBT YET DUE TO PAST "MISTAKES". MY ADVISE WOULD BE TO GET A LETTER FROM HER BOSS THAT WOULD EXPLAIN HER SITUATION OR BORROW THE MONEY TO CATCH IT UP & KEEP IT CAUGHT UP SO NEXT TIME SHE MAY QUALIFY FOR A LOAN WITH A PRIME LENDER. The FDCPA does allow debt collectors to contact others to obtain location/contact data of a debtor.

The applicable sections of the FDCPA are 804. Acquisition of location information and 805. Communication in connection with debt collection.

The FDCPA is very specific as to how and how often they may contact others. Essentially, they are allowed to contact another for location information ONCE.

Read these sections of the FDCPA and you'll see what they can and cannot legally do.

bill's right about one thing

1st off yes they can get your family members names. in fact anybody can pretty much find out anything about anybody they want even you, but if you do your homework you will find that what they can not do is contact your family, friends, or neighbors to try to contact you or get information about you.

2nd of all if you read the post correctly they did not ask if she could borrow the money they told her to borrow the money and i,m sure there was probably some kind of or else involved.

and for a finall thought if you research the company in question you will find that they are a ripoff and i would not recomend them to anybody. do a search and you will find people have paid three or four times what they borrowed and still owe tham money. sounds like a ripoff to me.

1ST OF ALL THEY CAN GET YOUR RELATIVES INFO IF THEY WANT. 2ND OF ALL, ASKING YOU TO BORROW $$ TO PAY WHAT YOU OWE IS NOT UNREASONABLE! YOU WERE RESOURCEFUL ENOUGH TO GET THE LOAN IN THE 1ST PLACE. PLUS, YOU DONT WANT TO CALL YOUR EMPLOYER TO VERIFY YOUR ALLEGED SITUATION. THAT SENDS UP A RED FLAG IN ITSELF. IT WOULD BE LIKE IF YOU WERE LATE TO WORK BECAUSE YOU GOT A SPEEDING TICKET BUT REFUSED TO SHOW IT TO YOUR BOSS. THERE COMES A TIME IN EVERY MANS LIFE WHEN HE HAS TO TAKE SOME RESPONSIBILITY BY THE WAY, ITS NOT A RIPOFF TO ASK SOMEONE TO TAKE CARE OF THEIR BUSINESS.
