I purchased A home in July of 2009. I was a divorced single parent and I didn’t have a lot of money saved up, so I was looking for a home that was in good condition and move in ready, that way I wouldn’t end up immediately spending money on repairs. When I first saw the house it appeared to be perfect. It was a foreclosure that had been completely rehabbed by a couple named Gregory and Sylvia Waldon, and just about everything in the house was new. I wanted a home with a finished basement and this house had an unfinished basement, but I was ok with that because the basement looked immaculate and according to the owner, it was in great shape when he purchased it. I had the house inspected and the inspector told me that I should ask the sellers to hire a structural engineer to inspect the foundation to ensure that it is safe and structurally sound, because he could not determine the condition of the walls because they had been painted over. After receiving a letter from the structural engineer stating that the house was indeed structurally sound, I went ahead and purchased the home.

The day that I moved into my perfect little house, we had a terrible thunderstorm with lots of rain. The very next day, my mom went downstairs and was surprised to find water all over the basement floor and that's when my nightmare began! A year later I was having more and more issues and I ended up having to add drainage and 2 sunp pumps. The engineer from the company that did the work told me that it appeared to him that my foundation was still moving, but I said that couldn't be because before I purchased the home I asked the sellers to have the home inspected by a structural engineer to make sure that it was structurally sound. The engineer suggested that I contact the structural engineer and have him come back out to my house and re-inspect. After meeting with the structural engineer who had done the inspection, I found out that he had not actually inspected the entire basement. In fact, he had only inspected one wall as instructed by the sellers realtor, Ron Hill. After being told that I was not satisfied with the report, Ron Hill ALLEDGEDLY asked the structural engineer to change the report to make it look like he had inspected the entire foundation. The structural engineer, being a good Christian man, believed Ron Hill when he ALLEDGEDLY told him that the remaining walls had already been inspected and they were found to be structurally sound, so he went ahead and changed the letter. I purchased the house based on the letter that was provided to me, not knowing that it was not true. Not only did the basement have water seepage, but the foundation was indeed still moving and needed to be stabilized.

I filed a lawsuit in 2012 after finding an attorney who was willing to take my case contingent upon us winning. Two of the four individuals that I sued, including Ron Hill, have all settled (for pennies) and my attorney received 32% of it. I finally had my day in court and I am happy to say that I won, but the sellers, Gregory & Sylvia Waldon, have filed an appeal. Ther refuse to take responsibility for the part they played in this. They were the ones who owned the home and they should have been more involved in what was going on before they sold it. My attorney has informed me that if we have to go to court for the appeal it can get really expensive and I will probably end up owing him money. He has asked me if I'm willing to offer Gregory & Sylvia Waldon the opportunity to settle for a much smaller amount than what I was awarded! I didn't want to do it but my attorney seems to be giving up on the case. In the beginning he seemed so confident, but now he just wants it to be over with and he's rushing things along. He made the settlement offer and the Waldon's countered with their own offer. They are offering me LESS THAN 1/4 OF WHAT I WAS ACTUALLY AWARDED by the courts, plus they are demanding that I sign an agreement saying that I'll keep my mouth shut and not tell anyone about the case (even though it is public knowledge and you can find it on www.courtclerk.org and just search by their name or Ron Hill's name). I am still awaiting the outcome of the settlement offer, so before it becomes final and I sign any agreements I am going to tell EVERYONE I know so that they are aware of these con artists and can make sure that they NEVER buy ANYTHING from them!!!

One last thing, I purchased my home for $126,500 and the market value is currently at around $75,000. If I try to sell the house I will definitely disclose all of the major issues (because I am an honest person) and the price will probably drop to around $50,000. It will cost $20,000 to completely waterproof my basement, stabilize the foundation, and clean up all of the colorful mold currently growing in the basement. So basically I'm screwed and I'll probably end up losing the home to foreclosure like all of the previous owners did! I never imagined that my dream would turn into this horrible nightmare, all to no fault of my own. Because of all the stress of dealing with the house and the lawsuit, plus my father’s death last year in August, I have suffered a mental breakdown and I ended up going on short term disability for 8 weeks. I hope this information helps some other innocent, unsuspecting homebuyer so this doesn't happen to them.
