Purchased a quart of paint and had it mixed to my specifications. Checked out with can in my hand and no bag.

Placed can on my passenger fron seat. Drove two miles when can tipped over and spilled over my entire car. The cover had not been secured by the man whpo mixed the paint. Drov e back to Home Depot. The namager Mary Landers had an employee clean up the puddle of paint on  the passenger front seat so that it would not spill when being towed, Had the car towed to the dealer and had to rent a car.

Home depot, being self insured has a company investigating their claims. Vivian Segwick of that company stated that because I had not "secured" the can of paint, they were not liable. Obviously id did not matter that the cover was not secured. I did not know I was required to "secure" the can of paint. This is not even a questionable matter, It was clearly obvious that the cover was not secured properly unless someone can define "secured" as stated by Home Depot.

This incident occurred due to your negligence because the paint should have been securely stored on the rear floorboard of your vehicle. The paint covered the instrument panel due to your careless actions following the incident.

Another indication of your carelessness: To avoid damage to the LCD panel, a wise person would not travel with a computer on the seat of an automobile.

 Have YOU forgotten that YOU left the property? Once YOU left thier property it is NOT THIER FAULT!!!! YOU could have taken it upon yourself to make 100% sure the color was right and YOU didnt close the paint can. While yes its unfortunate that YOU spilled paint all over the interior of YOUR vehicle. Its NOT thier responsibility. HD doing ANYTHING for you is far MORE then they ACTUALLY have to do!!! YOU screwed up by putting the paint where YOU placed it. YOU just want the corporate deep pockets so YOU dont have to pay for it!! YOU are HIGHLY transparent in THIS situation. YOUR own words are showing anyone who reads your report that YOU caused the issue and YOU want someone else to pay for your overly expensive clean up.

And just to shoot down your next statement. NO!!! I DO NOT WORK FOR HOME DEPOT OR ANY INSURANCE COMPANY!!! Why is it that when someone questions YOUR version of events they MUST work for whomever YOU are whining about?? First, YOU SHOW NO PROOF OF WRONGDOING!!! Thats a big one. Secondly, YOU SHOW ZERO DAMAGES!!! Thirdly, YOU HAVE COMMITED DEFAMATION WITH ONE AND TWO!!!! YOU do realize that the entire web is NOT FaceBook? Yes, YOU have the right to freedom of speech but what YOU have posted on a public forum IS NOT PROTECTED!!! YOU are going to have to do better then JUST your version of reality.

Go ahead and do some research, Im 100% sure that YOU will not find ANY Law that makes HD at fault. YOU will however find Laws reguarding what YOU have done. A simple Google search will show you the price ranges for defamation. Its NOT PRETTY!!! YOU can rant all you like it will NOT change reality. YOU spilled paint on YOUR vehicle due to YOUR carelessness. Its is NOT Home Depots fault that YOU spilled paint inside your vehicle. Paint and other such substances that can mess up your interior are supposed to be stored in the TRUNK!!!! YOU CHOSE to place the paint in the front seat. YOU could have placed it on the FLOOR!!!!! But YOU did not do this and NOW seek to make the responsible party Home Depot. Just so THEY have to pay for YOUR mistake.

The entire quart spilled on the passenger seat. I had packed my car and was on the way to Los Angeles later that day. All ny clothes were in the car including a rake that my friend in LA needed. My computer was in a plastic shopping bag on the passenger seat along with my mail and my cell phone. I noticed that ther can "tipped over" not falling off the seat, and covered the entired ventilated leather seat of  mg Mercedes. I grabbed my cell phone and put it in my lap and then grabbed the plastic bag by the handled. It was covered in paint and proceeded to pour over me and the rest of the front of the car but I thought I could save it by holding it up. That was not to be. The employee just used paper towels to sop up the puddle on the front seat.

That was at the direction of the store manager who stated she did not want the paint to do more damage when it was being towed. The car was then undriveable. As for the paint coming right off: When I got home I tried to get to paint off of my computer but without scraping it off it did not come off with the Goof off provided by Home Depot manager. I  did save the cell phone, but not my new jeans. I appreciate your giving me the opportunity to explain this situation so that you might understand the damage that was done. As you suggested, and for that I thank you, they probably have a knee jerk reaction to all claims by denying them, I hesitated to claim it against my insurance because of the $1000 deductable but obviously Home Depot is not as honorable I I always believed.

The passenger seat was completely covered and poured into the vented seat. When picking up the compouter bag the paint ran all over me, the driver seat, the rugs and eventually when removing my mail and computer from the car it fran all over the outside of the car.When driving back to Home Depot I held the bag with my computer in my right hand and drove with my left but the paint ran over the entire inside of the car including the instrument panel. I have photos as does Mercedes Benz. I hope that explains your negative sugestions.

To start off, these claims companies default to the "your at fault" stance hoping you will give up and go away.  So it may take some time for them to pay for it.  But let me just say that if they denied your claim and you think they are liable, then take them to court, and most likely a Small Claims case.  What exactly are you claiming in damages?

With that said, there are a few things that really make no sense.  Perhaps the biggest is that why if you were able to drive back to the Home Depot.  How come after them doing some clean up did you all of the sudden have to have the car towed?  We are talking about spilled paint in the passenger seat area, not some mechanic who forgot to put oil in your car. 

On top of that, this was a quart of paint, or about 32 ounces.  It is also very unlikely that the entire can spilled by just tipping over.  If the entire can did spill then the can did more than just "tip" over.  One other thing is you made quite a statement about taking the paint without a bag and that it was powermixed.  One could argue that in the entire time of you having it, if the lid was unsecured enough for it to just fall off, how come you didn't notice it.

There is also the clean-up issue.  Was this water based or oil based paint?  Water based paint, can very often be cleaned up quite easily until it dries and it is not instant drying, so how much were you able to clean up before it dried?

Again, I am not minimizing the mess or damage that could easily have been caused by the paint.  It just seems as if there is something missing here.
