I had gotten behind on payments due to my husband had passed away and I took time off work to be with my children. I was 2 payments behind and contacted the company to make arrangements to pay. I agreed to w/u 1 pament on 1/11. My check was not recieved until 1/18, again I contacted the company to make sure the status of the loan had not changed and informed I was w/u the payment that day. I was assured it was ok and to send the money. I was told the loan was not in forclosure status as long as the payment was sent before I was 3 payments behind it would not be placed in forclosure status. I sent the payment the same day. 3 weeks later I was notified by w/u the payment was not accepted the same day I was served w/ forclosure papers. When I contacted the company they advised me I would need 4,243.81 to bring the loan current which included attorney fees. When asked why they did not accept the payment I was informed I made the agreement with the wrong department. I agreed to a repayment plan which when recieved said I owed 9,364.21 even though I still wasnt back to work. when the agreement came they wanted 1600 a month for 6 months. My actual payment is 800 when I spoke with the next rep and tried to explain that i hadnt returned to work and I couldn't afford these payments she advised me that if I wasnt working they coulnd't make arrangements with me and they would have to go ahead w/ the forclosure. Since then I have made 2 payments of the 1600 and when I contacted the company to let them know I could only make 1 payment this month they again refused to accept the payment. They cant give me any information and advised me tocontact the attorney handling the forclosure. When they were contacted they advised they couldnt give me any information to contact Homecomings. I cant even get anyone to tell me what I need to bring the loan current. I dont understand how a company can refuse a payment and then tell you its your fault for not paying. I have asked the company to please accept my monthly payment and they refuse. How can they forclose on my home when I am attemping to pay and they are refusing to accept it. Had they accepted my original payment as agreed this would not be happening.

I want to know what other recourses she would have for her situation. GMAC failed to acknowledge receipt of my payments even though I sent them copies of the money orders front and back. They filed foreclosure. I filed Answer. Please help.

Dear Jamie, I offer condolences for your loss, because I suffered a loss, too! It is state law that before any official foreclosure procedure can begin you have to experience several attempts by the company to resolve the issues, if this has occurred & resolution has not been reached they can start foreclosure procedures provided that they did indeed notify you by certified mail of which it sounds like this did not occur!

Also, in order to turn done your money it has to be acknowledged & turned down by an individual of whom is in a postion of utmost authority to do so (not just any individual) of which, it sounds like, that just randomly your payment was turned down. You have rights, you can still pursue these unresolved issues to obtain & accomplish your objective to be entitled to expression of proper authorized explanations in writing! Do not allow any of your rights to be violated by the other side whatever those rights of yours may be! Wishing you courage to fight for justice to be yours!

You said you were 2 payments behind. A mortgage company will not accept anything less than your entire payments. So, yes you would need to pay both payments plus all fees and it adds up quickly. I am not fussing at you ,but considering the company your with, you already had a high interest rate or a ARM. Which means they are less likely to work wiith you. So, you really need to get a forbearance worked out or it will go to forclousure quickly. I doubt selling is an option at this point.

Sorry to hear about all your problems. I hope you can work it out. However being 2 payments behind means you had to catch up the entire payment plus ALL FEES in order to keep it out of forclousure.
