James E. Gabel, Attorney-at-Law Submitted Will With False Information, Conflict-of-Interest Woodbury New Jersey

James E. Gabel, Esq., was contracted to write a will for the estate of Paul L. Bustard. The text of the will contained information that was false. This was never verified by his practice.

Mr. Gabel should have recused himself from the proceedings after this was brought to his attention as he represented the estate, which included both parties who stood to gain from the terms of the will. He advised one of the parties to retain new counsel, but remained as lead counsel for the estate which is a conflict-of-interest.

The will was drawn up while Mr. Bustard was incapacitated by his disease and pain-killers and was not in possession of his full faculties.

Further, the terms of the will violated an existing court-order which also was never verified. 

Finally, the circumstances under which the will was notarized are in dispute as there was a very small window in which Mr. Bustard could have signed the will and his primary care-giver does not remember seeing either the "witness" or the "notary." on or around the date in which it was filed.
