Jd byrider reposessed my vehicle after being slightly late due to medical reasons. This is the 4th car I have had with them since May 2013 The first broke down when transmission went out, the other two had constant issues and breakdowns causing me to lose my job. Each time they swapped the car the down payment went higher and higher to where what i had paid meant nothing. They told me if i pay the payment i could have the car back, only to change their minds that evening. My rent and medication was in the car and also went missing. Each car i didnt even have long enough to get the real tags. Even with all my payments i still had not finished the down payment installments because they always increased. I am currently seeking legal council to at east get what i paid back. I understand i was late but only a couple days

DIP Payment Trial Period

 The first two months are always deferred down payments, they are a trial period.... If you are late on your first four or five payments, how reliable are you going to be for the next 3 years plus?? NO MATTER WHAT IF YOU ARE 5 MINS LATE ON A DIP PAYMENT YOU WILL BE REPOED!! They are a test..............

Does that contract YOU signed say "...payments are due on or before the due date unless you are in the hospital." ?  End of story!

Im actually seeking legal council for advice not the pay money upfront kind. As far as payment wise this was the first and only time late because i was in the hospital for a days which they knew. I was going to make the payment the day after it was taken when i got my check. They even said i could make said payment to get the car back, it was only $150. But then when they brought the car back from the repo lot changed their minds and told me to get my stuff.

 So you think you have enough money for a lawyer..but not enough to make your payments.  Which if you had actually made your payments you wouldn't be in this situation now...and this is your FOURTH car with them.  And the wheels on the bus go round and round.

Seriously, no laywer is going to take your case without a huge up front retainer, and the chances of you prevailing is about zero.   The reason?  Well you made a legal agreement to make a certain payment on a certain day at certain times.  If you fail to make that payment you agreed that they had the legal right to reposess your car.  There is NOTHING in your paperwork that says they have to wait a certain amount of time before they reposess it.  Oh and there is also nothing that says you only have to pay it when you can.

Oh and while other lenders may not have reposessed a car after 2 days...you are dealing with a Sub-Prime lender who loans Sub-Prime borrowers money to purchase a car.  These are very high risk loans and as such they keep a much tighter leash on the borrower than others will.  The only way to get out of this loop..either save up enough cash or actually prove you can handle credit by making your payments when you are supposed to.
