Sunday May 5, 2013 we purchased carpet which was expertly installed Tuesday, June 4, 2013. The total, including a down payment of $1,100 and a paid COD of $2,296.00 was $3,396.00

This transaction has been a series of misrepresentations and errors for which Jim Boyd’s Flooring America refuses to accept responsibility.  The lack of attention to detail is clear and compelling.

It begins with a change order which shows that due to slightly more carpet needed than originally believed there was an increase of $96. That was understandable. A revision showed a down payment of $1,150 (it was $1,100). This was followed by another with amounts corrected. 

When we purchased the carpet our salesman, Bill Gould, told my wife June and I that we had 30 days and if we were not happy with the carpet, they would either remove the carpet and pad with a full refund, or exchange it.  We were also told that the carpet carried a lifetime warranty on it.  Subsequently when this whole fiasco reared its ugly head, the store manager, Larry Hunt, denied having such a 30-day policy, which leads us to wonder if the “lifetime warranty” exists either.  

The salesman was busy that day and had to attend to other customers besides us. The carpet for which we signed up was called Riverfest. There are hundreds, even thousands, of various carpets, grades and names among the various manufacturers.  It is safe to assume that the public would not know one name from another such as Riverfest, Riverfest II, etc.

Mr. Gould showed us several types of carpets.  Once we settled on the brand and with all the promised guarantees that were conveyed to us, my wife made it emphatically clear that we wanted the more dense, sturdier carpet of the Riverfest.  It was a credit to Mr. Gould that we fully trusted him and we believed that our salesman wrote the correct model identifier for what we ordered and chose.  We signed the order with the full belief that he paid attention and that we were on the same page.  We would not have known how to double check.  In fact, June returned to the store a day or two after the purchase to select a slightly darker color. At that time she again pointed to the carpet we were ordering to the woman with whom she spoke.   

My wife and I chose the same carpet together and together heard the salesman say that we had 30 days. To hang this on us because we “signed” it is to accept no responsibility for the fact that care was not taken to be sure that all the details of the purchase were reiterated to make sure we were all on the same page of understanding.  If that would have been done, the error would have been discovered on the spot and we would have cancelled the deal.  We have no interest in the carpet that was installed.

Needless to say, the carpet we received and that which we ordered is NOT  the same carpet chosen at the store at the time of sale.  There is no way we would have chosen that low grade of carpet especially at that price. We meticulously looked at numerous samples and settled on one. 

Now they state they are “willing” to remove the carpet at their expense and with us paying the difference to install what we originally ordered.  Under the circumstances of a combination of their misrepresentations and negligence, this is totally unacceptable.

We want what we were told we were getting. . Mr. Gould was throwing out a number of discounts, which we appreciated.  We are talking about a small townhome and 680 sq. ft (their measurement) on the second floor. 

After two arduous days preparing for the installation, the three-man crew arrived with the head mechanic doubled over in excruciating pain.  He said they were going to have to postpone the installation.  My home office was dismantled and the crew was told that if the installation did not happen that day, we would have to cancel.  After about 1-1/2 hours, the crew started the installation. 

After they left we saw that the installed carpet was not what we ordered and is an inferior grade, with very little pile.

There are only two solutions acceptable to us:

(1)   Install the denser sturdier carpet we picked out and believed we were buying, or

(2)   Remove all carpet and padding and provide a 100% refund

Short of this we are prepared, ready and able to pursue this matter continuously, actively and vigorously via a variety of legal entities, consumer groups and various media online and offline.

 The customers came in to our business and looked at carpet.  They were shown both Riverfest and Riverfest Plus products with 8lb. 3/8" padding.  After being presented pricing on each carpet, they choose and signed for the Riverfest product.

After we installed their carpet, they complained about the thickness and feel of the carpet and pad when walking on it.

It is unfortunate they feel this way.  In order to accomodate, and in the spirit of satisfying our customer, we suggested that we take up the existing carpet and install the Riverfest Plus carpet.  We offered to cover the cost of the labor.  All the customer would be responsible for is the difference in the cost of the two carpets. 

They rejected this offer which does not seem resonable to us, but that is their decision.
