 On October 12, 2013 I bought a 2005 Nissan Quest Minivan for a total of $8500.00 with a down payment of $2000.00. I did test drive for 5-10min could not test drive any longer because Van had no gas. Before signing paper work, I did indicate there some issue like broken storage space and sun block panel was broken as well. Well I test drive notice a smell of burn oil sales representative by the name Eric said that it was that the motor was duty and had not yet been wash. Then when I told him that the van felt kind a weird it’s made like a jump he said it was normal. Then he said that not to worry before I took possession of the van it would take to carwash and they would wash the motor and the outside as well. Than Mrs. Roger Rodriguez took over and this credit check with wanted me to signed for a loan which I would be paying 39.99 % interest charge I told him no when I was walking out he then said he would do inside financing with a 2000.00 .

I took the van home on Saturday October 12, 2013 parked in the drive way the following morning there was a big spot of oil on the drive way that was which when check it was motor oil. On Monday I call Mrs. Eric I told him the van was linking oil and that their more thing I notice were not working. Long story short I hire another mechanic to check the 2005 Quest Nissan Mini Van the following items were not working or damage:  3 Motor mounts, 1 transmission mount, exhaust manufuel was liking, oil mount linking motor oil, CD player not working, did player not working, Left side tire doing loud noise, brakes and rotor damage both side and chip right side windshield Storage box broken and driver side sun block shade panel broken. Estimates repairs expenses $2000.00. When I call Mrs. Roger Hernandez and indicated all this problems to him he indicated “What did you expect for a used car! “ I told him it was a $8500.00 car not a $850.00 car off the street and that he need it to fix all this he then indicated that I would have to paid for half of it. Told him why?? I had only 3 days and that knowing that this is one of his cars on the lot and having a mechanic shop on site he should know of the damages and he try to hide them. He said to take the Minivan to see what he could do I took it in Friday October 18, 2013 Its been eight days and Mrs. Erik and Mrs. Roger Hernandez refuses to take my Phone call. I went on Saturday October 26, 2013 Receptionist indicated he was out doing business that they would give him the message to give me a call back. I called 3 more times on Saturday and never received a call back. Its 8 days No cars no money no call back. Till today Have to file in justice court because Mrs. Rodger Hernandez refuses to fix Minivan and give my 2000.00 deposit back. BEcareful of this man and dealer ship he does not care about peoples life The minivan was in so bad shape that the I counld of crash in the freeway or street with my 4 children. And he told me in me face " Do you think I care about that". Be carefull do not buy from KMI Auto.

I don't work for the dealership, but that vehicle you bought was at least 9 years old and those types of very old, high milage type vehicles are sold AS IS. The exception to the AS IS sale would be if you purchased a warranty with the car when you bought it. Did you pay for a warranty at all?

You should have kept on walking when he quoted you a rate of 39.99%.  The fact that he is now financing the vehicle "in house" doesn't mean the rate is less. In fact, he can sell the loan to some other company to service too - even after he agreed to keep it in house. Of course, we don't really know your terms because you didn't specify and it sounds like you never read the contract.

You would be better off to read your current contract now just so you know what terms you agreed to when you signed it.

If you can, go refinance the vehicle with your credit union (it might not be possible due to the age of the vehicle).

You will need to get the vehicle repaired on your own at your expense. That is perfectly normal for the owner of a older vehicle. It is up to you to maintain and repair the vehicle. Don't take it back to that dealership. They don't really repair the vehicle but they charge you an arm and a leg. Go to a real mechanic to have it repaired so you at least can drive it safely.

Next time, don't fall for those old scams that these buy here pay here dealerships run. Next time, get your financing from a credit union before you ever go car shopping. Next time there is no gas in the vehicle to properly test drive, return it to the lot and walk away without signing anything. You were played.
