Ok, I receive a message from a guy named Jimmy at this collection agency. I call him back and says i owe $900.00 dollars for a CC machine from a company i use to work for, apparently before they went out of business they used my info.

When i spoke to Jimmy, at first he was ok then he says i should file bankruptcy, when i tried to explain that i was just an employee there, immediately he starts screaming into the phone that he is going to sue me and says things i couldn't understand and hangs up.
I called him back, he didn't pick up so left him a message telling him not to call back and harass me.

Ten minutes later my wife calls me, scared and frantic and says a guy named Jimmy called from MBW (he used his companies initials), he asked about me she tolled him i was at work, so he asks for my number and she refused to tell him so he tells her a phone number and asks her if it was mine, she tells him try it and find out. Now he tells her that "your husband owes me money and i am coming right now to your house to get it" she replied "don't come here if you do I will call the police" he says "I am coming now, i will be right there" then he hangs up.

I called him back, now he welcomes the phone call, I yell at him and threaten him (I know I was pissed) and he continues with the call without hanging up, he starts to name people in my family, do you know? and names my wife, my brother and my father.

I tried to call the police and they put me on hold then hung up (Cleveland Police).

After all this i get a call, supposedly from the MBW legal department stating they have me recorded threatening him, I should add when asked who i was i did not respond and never acknowledged who was talking to even though he knew.

What do I do, any Ideas how to handle thugs.

scam artists not from McCarthy Burgess & Wolff

I, like a lot of other people have been receiving constant phone calls from someone claiming to be from McCarthy Burgess & Wolff. After repeatedly asking them not to call me at work, and after hearing time and time again that I was going to be served papers at work and be sued, I decided that I was going to do the only logical thing and report them to the State Department of Banking. You see, in Connecticut, the Department of Banking handles all the licencing for all Collection Companies. I first needed to find out if they were licenced to do business in the state. They were. The State told me that I had to write a detailed letter explaining what went on, who I talked to, how many times they were calling me, where they were calling me, who they were talking to (friends, family, ETC.) But I was also told that I had to call the company directly one last time and get specific information on the debt that I owed.

I decided to look the company up on the internet to get the name of a company officer to talk to. Well to my surprise, they were not only very polite, they had never heard of the person claiming to be calling from their company. They did tell me that I owed a debt to Sprint, but also knew that i had a payment arrangement with the company and was working with Sprint. They told me no other action would be taken and to feel free to call them if I needed any other information.

I was also told that all their phone calls are recorded and they would be going through the recordings to see if there was any inappropriate phone conversations.

I have learned in dealing with alot of scams over the years, not to give any personal or bank information out over the phone. Have them send paperwork to your home address. Ask them to verify what they have on file, but do not give them any information. If it goes to court, fine, let it. You will have an opportunity to tell your side but remember to keep records. Detailing phone calls, dates times, who they called, when. If they are calling your cell, save all messages and calls. Have you employer write something stating they are harrassing you at work.

Always look up the actual company and speak to someone at that company to verify if this person works for them.

VOIP How sweet it is.

I got a call today wanting me to call back. The reason I fill that they wanted me to call back was so they could argue with me and it would not cost them as much. I called back and said come on lets talk it is not going to cost my long distance anything. I have VOIP and long distance is free. He did not want to argue after that.

I got a call from a company calling them self's MBWA collection company. They told me any thing I said could be used in a court of law. Who appointed them Federal prosecutors?

Yes, here's how you deal with them!

Yes, I can tell you how to deal with these freaks.

Write up a Sworn under Penalty of Perjury GRANTOR status Declaration. Sequence: When you sign a 'Contract', the Banks, Companies, etc don't tell you that they have already accessed your Trust account being held at the U.S. Treasury Department and have already been paid in advance. Then they bill you for 100% tax on top of that. So they're double dipping. Then they list your Account number on Fidelity.com and get 2.5% interest PER DAY off stealing YOUR Signature, seal and SS # to willfully and maliciously leverage bonds/mutual funds in your name unbeknownst to you then they claim those funds which are yours but they fill out a 1099A for abandonment and keep those funds because you didn't claim them! You had no idea! So what you do is do the Sworn under Penalty of perjury Declaration that you are the GRANTOR, You do a signature rescission but leave the signature for A4V/R4V, Irrevocably Terminate all beneficiarys and Trustees. As GRANTOR appoint yourself as Sole Beneficiary and make the CFO or Prosecutor or Judge the FIDUCIARY TRUSTEE and force him/her to not only pay the bills, but also to return to you all the monies, payments, Dividend checks they withheld from you illegally. These thieves not only inverted the trust on us, making us the Trustees and them the Beneficiarys, they've never sent the required mandatory by Law  Dividend checks!!!! The Courts have authority over you in 2 ways. First is secret (implied) Power of Attorney. The second way is Assumpsit/Presumption. So add this to your Declaration:

                     SWORN UNDER PENALTY OF PERJURY DECLARATION

I hereby Declare & Swear that I did not in the past, do not now or in the future intended, intend now and never do intend to purposely or otherwise avail myself or be held in economic and/or involuntary servitude, peonage, slavery, benefits, privileges, titles of nobility, Trusteeship and/or opportunities offered.

Get this notarized and recorded at your County Recorders office. Sent this out with instructions to the new Trustee. Congratulations, you are now the new Beneficiary and no Court or stinking ESQUIRE has any authority over you.


IF they try to take you into court (after you've revoked all POA's, their only authority over you is perceived, not real) You can also demand a Ratification of Commencement. This is where their boat is torpedoed! A foreclosure is over, cc case is over, everything is over because they cannot bring forth a REAL party in interest. DO NOT EVER plea bargain. And just in case you are in a court situation, always always tell the Judge/Magistrate/Hearing officer that you DO NOT CONSENT to their Benefits and Privileges (Which, believe it or not) are Fines, Fees, Community Service, Traffic School, Points off your License (that you don't need anyway because we all HAVE A RIGHT TO TRAVEL! Jail, prison, Probation, Parole. Yes, these are their lovely 'Benefits and Privileges, you WAIVE THEM! You tell the Judge you do not consent to anything you may deem as punishment!

Dont let them scare you

Don't let jimmy scare you. They may or may not have you on tape in most states it is not leagle to record conversation with out you consent or them putting you on notice. How ever if thay called your house and made threats ageants your wife and family you should be proactive and make complants ageants them to the police and the BBB. If you dont owe them money put them on notice that if you hear from them in any maner you will file a law suit ageants jimmy and MBW.

If you do uwe the money they proble bought you debt for pennys on the doller. The trick is to find out were they will settel it will probaly be around .05 to the doller

My name is Jane and I came across this blog doing my own investigation on this company that called me claiming I owed a debt. I wanted to make sure I wasnt dealing with a scam company. Anyone can get your information nowadays. I have recently resolved my debt with them after a few altercations with some of the people there. I understand thier job is not easy and does require some "pressure" or "scare tactics" but sometimes these agency's do cross the line.

That sounds like this guy "jimmy" would have no idea that would have happened to you and was calling to discuss a debt.

Akabush you said you became upset once you heard that this was for a company you nolonger worked for and used your information without you knowing. Then you said, " I called him back, now he welcomes the phone call, I yell at him and threaten him (I know I was pissed)" Akabush, I could have reacted the same way you did when I was told I owed something I had no idea about, but I didnt. Personally I became interested. (due to the fact I know I resolve all of my debts and I do not like anything on my credit report that is'nt positive). With the help of a supervisor I was able to find a solution to this problem and it was resolved. My husband and I have alot of questions to as why did you become so upset instead of using that energy to find a logical solution. I suggest contacting the company you used to work for and ask them how and or why they used your information. Or simply as it may sound, ask for a signed contract. I hope I helped out
