I purchased a 2005 Mustang from Mel Clayton Ford at a tent sale in Tempe, AZ The car had 800 miles but I accepted the salesmans story that it was from test drives and from the salemen driving it. I accepted that so I don't have a problem with that. I traded in a 2000 Ranger in which I had 1 payment left. The salesman and the finance person said that it wasn't a problem. They would add it to my financing and make the payment. 3 weeks later Ford Credit (who I financed my Ranger with) said that the payment hadn't been made and that it would be considered late if I didn't pay it so I did. Also at the tent sale I was told that the owners manual would be mailed to me and I could go by the dealership and pick up the 2nd key and alarm fob. I went to the dealership that weekend and they said that I would have to pay $150 for the 2nd key and $50 for the alarm fob. I refused so I didn't get either. I then left 4 voicemails for the salesman, Chuck Angell, over the course of 2 weeks but never received a callback. After I found that I would have to make the final payment I left 4 voicemails for the finance manger, Kevin McCloud. I received no callbacks so I contacted a Ford Customer Representive who's number I got from Fords Website.

They called me back the next day and said that they spoke with the sales manager, John Wagner, and I should contact him for the owners manual, key and alarm fob. I left him 3 voicemails and received no callbacks. They also gave me the name of Kevin McCloud whom I had already left voicemails for but hadn't heard back. I left 3 more with no callbacks. 5 weeks after I purchased the vehicle with no callbacks I went to Mel Clayton Ford to try to straighten things out. I was told that John Wagner no longer worked there so I have no idea who or if the Ford Representative spoke to anyone. I did receive a key but it didn't work in the vehicle. I was told that they didn't know where the 2nd key that came with the car was. I can't program the key because, of course, I don't have the owners manual. They also didn't know where the alarm fob was nor the owners manual. This is a car that was suppose to be new but none of these items were with it. I then went to the finance department and was told to speak with someone named Cynthia. She said that there was nothing she could do about the final payment because it was a Sunday afternoon. She didn't even ask my name. She was rude and acted less than interested in my situation. I wouldn't have had to go to the dealership on my day off, a Sunday, if they had simpley returned my phone calls. I'm still in limbo as neither the dealership nor Ford Customer Representative seem interested in resolving any of this.

Not confused. He is the salesman I worked with at the tent sale. He then took me to the Mel Clayton stand at the tent sale

The salesman, Chuck Angell, actually does work for a competitor. He is the salesman I worked with at the tent sale. He then took me to the Mel Clayton stand at the tent sale because he said that the car was Mel Claytons. A representative of Mel Clayton filled out the paperwork. Both the MSRP sheet and the license plate tag said Mel Clayton Ford. The manual is important because it tells you how to program the key. Since my original post I've left 3 more voicemails for employees of Mel Clayton Ford and received no response. I spoke with the Ford Customer Representatve once more. He spoke with Mel Clayton Ford while I was on the phone with him and he said that they had the wrong address for me and that the check had been returned to them. Why they didn't simply call me I don't know. He then gave them my correct address and said that I would have the refund within 5 business days. This was 3 weeks ago. He also said that he would send me the owners manual and I would have it in 10 business days. I still haven't received the manual or the refund check. The Customer Representative also said he had no record of me purchasing the extended warranty and I've received absolutely no correspondence from Ford or Mel Clayton Ford.

Respectfully, I think that you are rather confused about the events and players involved in your car deal.

At least one of the individuals you mention in your comments, doesn't even work for Mel Clayton, but a competitor's dealership, thus it is highly improbable that this individual had very much to do with your deal (Your post suggests that he was rather significant).

Given the nature of that tent sale, it is highly probable that the Mustang you purchased did not belong to Mel Clayton. Your confusion about the players involved only suggests this further. Please look on the MSRP and you will probably see that this was NOT Mel Clayton's vehicle. This being said, the missing items were not items that Mel Clayton would have had to incurr any costs to replace. They simply would have had to bill the owner dealership.

A manual is not at all important for the replacement and programming of your keys. The car itself is. It physically needs to be present in order for the key to be programmed to correspond with the chip in the engine.

As for your final payment, I would be very willing to wager that you have since been reimbursed for the final payment that you made to Ford. Am I wrong?

Your situation makes me angry. Why? Because had just one individual taken a moment's time to explain some of these basics to you, you wouldn't be angry at all! All of your concerns / issues were easily resolveable if some took a few extra minutes to actual provide you with a minimal level of attention.

If you made the final payment, which you were foolish to do, then Ford Motor Credit should send you the title. It is obvious to me what happened here. The dealer just sat back and waited, knowing Ford Credit would call you about the last paymen. You should have stood firm and told Ford Credit that the car was traded in, you no longer had it in your possession, and the payoff money was in the dealers hands. They both scammed you because no dealer in his right mind would make a deal on a car unless they had the lenders payoff figure. They have to payoof the car and request the title assigned to them. Ford motor owes you the last payment as a refun. I was a dealer and had this happen several time, wher a person traded in a car before the last payment was credited. I paid off the car and the lender refunded the payment to the car owner.
