I had a balance of $1293.41 in which I paid $100.00 on 2/8/08. That made my new balance $1193.41.

I was then charged $7.99 for a TLG Shopper (Which I cancelled) on 2/11/08. This made my new ballance $1201.40!

On 2/18/08 I was charged a finance charge of $35.60. This made my new ballance $1237.00.

My credit limit is $1250.00, it was $13.00 under the limit and then I was hit with a $35.00 over the limit fee and then charged my $4.00 monthly membership fee. This made my ballance $1276.00.

I made a payment on 2/20/08 for $50.00 which knocked it down to $1226.00.

Then the TLG Shopper charged me again $7.99 putting my account ballance at $1233.99 then they assessed another $35.00 over the limit fee.

I have made no other purchases and my statements do not show any other fees outside of the ones mentioned.

The Truth Indeed!

AUTHOR: Saromans - (U.S.A.)

John, John, John. once again not paying any attention. It seems that you must be terrible with your finances that you must go and make claims about people you don't know. The late fees are in dispute too as I formentioned. It was these fee that drove it to the OTL status.

Since you are not Merrick nor know any of the facts. then you should probably stick to caring about yourself and butt out of other people's reports. Its really annoying. You take what you want to see and make crap up. Obviously you can not be in an adult discussion because your too hard headed. Wise up, grow up and try not to live your life trying to upset others.

As for Robert your response is more constructive. It was otl I admit, but because of their fees I did not mention that in the original report, All late fees and otl fees are in dispute and are being looked into. Just to let anyone now. They charged the late fee the day before it was actually due they claim its "still under investigation". That their words. I am trying to get that cushion back that I once had. The extra fee from TLG I have cancelled numerous times by mail and over the phone. They have been giving the run around on this issue. Like I stated before this is the only credit card I have a problem with.

I know and understand my finances, I also know and understand my credit cards as well. Obviously when a rep from that very company says it seems to be an error there must be some merrit to my argument! This forum is for people to report their issues with companies that do them wrong. It is a place for people, like Robert was trying to do, to help others to the best of their understanding of the issue. This is not a site for people to be rude and give misinformed advice or opinions as John thought he would.

There are other places for that and this is not one of them! But John I'll give you one point. you annoyed me so much that I called Merrick and stated exactly what I reported here and I have gotten further with this company then I ever had before because you annoyed me so much. So thank you John, You do have meaning in life!

Didn't go over?

AUTHOR: Robert - (U.S.A.)

""I had a balance of $1293.41 in which I paid $100.00 on 2/8/08. ""

""My credit limit is $1250.00,""

Looks over the limit to me. This explains the FIRST OTL charges. Here's where I think you messed up. You paid it down but not enough to keep it from going OTL again once the first OTL fee and the aditional charge from TLG Shopper, finance charge and membership fees. Hence you went OTL agains and of course another OTL fee is assessed to your account. Another aspect to your delima might be concerning your billing cycle - closeout billing date. Let's say your billing cycle ends at midnight on the 20th. and you're over the limit from the 19th thru the 21st. You will very likely get hit with 2 OTL fees. One for being OTL the previous month, and another OTL for being OTL at the BEGINNING of the next billing cycle. This is assuming of course that there are NO OTHER time periods where your balance exceeds the limit.

Suggestions: If you're going to keep your balance that close to your limit, then I suggest you cancel ALL AUTOMATICE CHARGES from this account.

Try to get your balance below a minimum of 75% (50% would be safer) of your limit. This way, if something unexpected comes up you have a "cushion" and will hopefully avoid OTL fees in the future.

The truth finaly comes out.

AUTHOR: John - (U.S.A.)

Now you finally admit that you have late fees as well. Pretty funny. I guess you'll use the defense that you pay ON the duw date and that should be good enough for them because you say so. Get rid of the cards altogehter as you clearly have no idea how any of it works.

Think, Comprehend, and Understand Then add your "Suggestions"

AUTHOR: Saromans - (U.S.A.)

You said your credit limit was $1250. So if you had a balance of $1293 you WERE over the limit. Their OTL fees put me at the $1293 amount! Which was stated in the report...did you read it? It was pretty well layed out. Everyone I talk to seems to understand, even Merrick Bank themselves!

The over the limit fee gets assessed anytime you go over, not only if you are over at the end of the month. Now, they might not have applied it until your closing date, that does not make that fact that you were over during that month go away. Also, because the OTL fee put you over the limit again they charged you another OTL Fee. So your saying that they can charge an OTL fee to put me over the limit then charge another OTL fee? IT WAS NEVER OTL BY MY PURCHASES, IT WAS WITHIN $100 OF THE LIMIT WHEN THEY STARTED 3 MONTHS AGO CHARGING ME LATE FEES AND OVER THE LIMIT FEES WHEN NEITHER WERE TRUE AND I HAVE BEEN DISPUTING THEM EVER SINCE!

No RipOff here, just bad financial managment on your part....I manage my finances pretty well. The only way you are going to get out of this is to get your account down to well below your limit I understand that. I have been trying to do just that while fighing these charges which a Merrick Bank rep just today said himself that the fees were in error and he would look into getting the issue resolved! I have a handfull of credit cards and this is the only card I have an issue with. So yes there was a rip off.

'Reaping?'
>>Yes, you are enjoyting whatever it was you purchased with the $1193 THAT YOU SPENT-NOT THE BANK. The bank did not just magically put that amount on your card and demand payment.
No duh! I thought they waved a wand over it. I know what I spent, I also know I didn't go OTL!

'So Jon , your comment lacks substance.'
>>Only to those that don't want to admit they have no clue. Would you like to admit that you have no clue?

'A balance that is carried by a Bank and/or creditor is my bill.'
>>Exactly as are the charges that are associated with the balance the YOU created. The bank did not sped the $1193-YOU DID. Therefore, not a 'fraudulent' charge.
Once again I know what I spent, I also know I didn't go OTL and therefore should not be charged an OTL fee.

'I use the card and I make payments to the bank. It is their responsibility to maintain the account.'
>>No, it is YOUR responsibilty. They did their part in giving you the money for what you purchased already.
NO BY LAW IT IS THEIR RESPONSIBILITY! Get a clue sir. They must maintain the account, my responsibility is to pay my bill and manage my account.

'It is not their job to assess fee that are fraudulent.'
>>It is their job to assess fes as yYOU BORROWED MONEY FROM THEM IN ACCORDANCE WITH A TERMS AND AGREEMENT.They did not assess fraudulent fees. They charged the monthly finance charge on YOUR $1193 balance and that put you over the limit. Then you get hit with an over the limit fee becuase of YOUR spending. Again, the bank did not put the $1193 on the card at random-YOU spent the money.
Quick math lesson. The monthly fee was $4.00, finance charges were 35.60 and TLG was 7.99 which adds up to $47.59 then added to $1193 is $1240.59...thats not over the $1250.00, close I know, but not otl. The fee was assessed the same day.

'Its not reaping from one's spending.'
>>Purchasing anything you never had and using it is reaping it's benefits.
The OTL fee, which is what were discussing, is not what I purchased nor should reap!

'You may like to be charged fees that you don't make, but I don't.'
>>I don't get charged fee I understand how credit cards work.

I guess not...you see OTL means you go OTL on your credit limit balance...not within $10.00 or $5.00 or even $1.00, but OVER THE LIMIT! It's that simple!

I don't make as I know how credit cards work and my responsibilty to have them. I pay the finance charge on what I purchase with their money and I KNOW I can't get near the limit and don;t get hit with over the limit fees.
I find it hard to believe you haven't been charged a fee, but nonetheless way to go to you. Just cause you never get close to yor limit doesn't mean others don't. No one should be charged fee they didn't deserve. No matter what someone spends on their credit cards.

'Understand the argument before you make a comment.'
>>Understand how things really work before filing a frivolous report. Don't be mad because no one joins your bleeding heart thread but in fact takes you to school on it.
I do understand how credit cards work. I talked to Merrick Bank just today and their rep was confused himself and they are looking into the issue. He didn't know why I was charged these fees, by the way 3 months in a row. Which raised my balance closer to the limit. So sir don't be upset cause you went to someones report didn't understand it and made dumb comments that were not productive. You should not be commenting if you don't fully understand the report. Oh and Schooling? You might ant to go back with your fuzzy math and poor reading skills!

You were over the limit....

AUTHOR: Robert - (U.S.A.)

"I had a balance of $1293.41.."

You said your credit limit was $1250. So if you had a balance of $1293 you WERE over the limit. The over the limit fee gets assessed anytime you go over, not only if you are over at the end of the month. Now, they might not have applied it until your closing date, that does not make that fact that you were over during that month go away. Also, because the OTL fee put you over the limit again they charged you another OTL Fee.

No RipOff here, just bad financial managment on your part.... The only way you are going to get out of this is to get your account down to well below your limit.

So

AUTHOR: John - (U.S.A.)

the bank is responsible for the $1193 in purchases that were there well before any over the limit charges? If you had a zero balance and they charged an over the limit I might agree. You are reaping the benefits of your own spending.
