For those of you like me that having to deal with the mis fortunate of having to be victim of the Midfirst Bank andMidland Mortgage scammers.Mortgage scam contains some type of misstatement, misrepresentation, or omission relied upon by an underwriter or lender to fund, purchase or insure a loan. Mortgage scam is easily practiced particularly where mortgage industry professionals are involved. The true level of mortgage scam is largely unknown because asignificant portion of the mortgage industry is void of any mandatory fraud reporting and in addition, mortgage fraud in the secondary market is often under reported. Based on various industry reports and analysis, mortgage scam is pervasive and growing. Mortgage scam can be basically analyzed as:





  • Fraud for Profit

    Sometimes referred as Industry Insider Fraud and the motive is to falsely inflate the value of the property, issue loans based on fictitious properties or revolve equity. Based on existing approximate reports, eighty percent of all reported


    mortgage scam losses involve collaboration or collusion by industry insiders


  • I Contacted the Kansas City Missouri FBI to report the incident,
    and identify this Scam. But intern was told by the agent to get online and Google
    to see it anyone else was having the same problem. Maybe I would be able to get
    in on a class action Law suit.

    I find it utterly amazing how the Banks , Mortgage Companies, Law enforcement, Scammers, and   people that have had the opportunity to live a
    good life, and  having someone like myself to spend 23 years of my life fighting for their freedom make my life hell.  I am A U.S. Army Golf War Veteran who had purchased a house in 2004 hoping to have a normal life after have served my country.


My first mistake was to use my the veterans G.I Bill to assist me in the purchase the house which lead to Identity Theft, because the veterans administration lost a notebook computer with valuable information of veterans.  


The second mistake was buying a house as First Horizon as the mortgage lender. After have made on time payments to First Horizon for 2 years for some unknown reason my mortgage payments went from $792.00 to $1,494.00 double the amount. Than having paid the requested payments lead to First Horizon indicating payment were not being received adding late charges, and I fulfilling  my responsibilities went further e.g. making over-payments and making payments 15 days in advance on payments  that were supposed to be applied to the principal but were instead pocketed. But First Horizon was determined to usurp as much home equity as possible so they manufactured grounds for foreclosure by pocketing payments instead of crediting them to the mortgage-account then claiming that the payments were not made, and skipped along to foreclosure.


In 2006 I filed for chapter 13 because the amount to continue making payments and then forcing me to come up with $11,964.00. This time rather than manufacturing grounds, their main strategy was to do whatever they could to PREVENT ME FROM FINDING OUT that they were taking foreclosure action against my home.



In July of 2008 the mortgage was transferred to MidFirst/Midland Co.  To continue the process before the transfer the judge asked that I bring my account up to date as I had agreed.  Paying First Horizon a Stipulation and Consent Order payment of $ 4546.35 Total Payments.  15 days after the transfer Midland Mortgage Co, decided to apply Payments to other my normal payments 7/18/2008, 7/21/2008, and 7/31/2008.Indicating they did not know how the Stipulation and Consent Order payments worked applied the amount to my normal payments subtracting the remaining amount that was supposed to be applied to the principal than pocketed my normal payment. And indicating that the Stipulation and Consent Order payments were never made. Nevertheless not being calculated correctly from the start, and misapplied.


In November of 2009, 6 months after the judge finalized the Chapter 13 order. Midland Mortgage and South & Associates P.C. are attempting there 5 times foreclosure acting hoping the judge will overlook the truth, and proceed with the action.  The manufacturing grounds for this action are failure to comply with Stipulation and Consent Order payments, and not making payments on time even though payment were sent to them 10-15 days prior to the due date. I was not given a copy of The Order. Only the letter you sent indicating the Judge had asked me to bring my account up to date. Stipulation and Consent Order did if signed did not indicate start date from what I recall. I was only told that there would be about 8 payments of $ 585.56 Date to be Determined. 2nd Amended Proof of claim submitted by Midfisrt Bank was approved acquiring all late charges. The total of the claim was entered in to the Chapter 13 repayment Plan. Midland Mortgage Co. with South & Associates P.C. indicated that I had no proof. Nice try The Three $ 1,551.45 Certified checks from the Credit Union were sent for the Stipulation and Consent Order payments. (Brake down of payments) $585.56 x 7 Stipulation and Consent Order payments = $4098.92, $ 4546.35 - 4098.92= $447.43, Leaving $447.43 for the 8th payment of $585.56 $447.43 would leave me owing them $ 138.13.


Midland Mortgage Co. modified a payment ledger so that anyone looking at it would not see the scam they had wish to accomplish. Because judges hope the attorney can resolve the problem and does not have time to be accountants, and calculate debts.  South & Associates P.C knows this, and objected when I had contacted my attorney to ask for a court date to speak with the judge. To prove that my payments are on time, and the Stipulation and Consent Order payments were made. The hearing is in a week.
Note: Here is some advice I took from my attorney that I would like to pass on. There are things that you need to do to help prevent further damage.


Pay your payments 5-10 days prior to the due date if you can.



Make a copy of the check, Money order,before you send the payment.


Send your payment Signed Registered Return Receipt (Green Copy)


Note when you wrote the (check /moneyorder) the month it is for, account number, date it was cashed, and ask forverification when it was cashed.If they send the check back likeMidland Mortgage Co. does to obtain late charges. Send another.


Keep your own Payment Ledger attach all the information and give it to your defense attorney he is not the enemy and the one who gets all the crap. Help your attorney Help You!!U.S


Supreme CourtJudges, and State Judges, are getting frustrated with fact of having their courtroom packed with hardworking people that Mortgage Companies and banks are taking advantage of. Foreclosure, bankrupt, and unemployment people are about 75% in the last 3 years and they caused it.



While this is an Outrageous & Popular Scam (from the ripoffreport.com categories) the MEDIA HAS BEEN So SILENT on this type & source of fraudulent activity that many would probably guess it to be an Unusual Scam. The status of this particular series of events is that I wish to
initiate a FEDERAL LAWSUIT in the U.S. District Court. Therefore I am seeking legal representation and want to establish contact with homeowners who have been similarly situated. In hope to put these scam artist out of business.
