I requested more info and submitted my contact information. I was called the next day by a man who identified himself as Mike Gill. In telephone conversations dated 11/19, 11/21 and in numerous subsequent conversations and emails, Mr Gill said he owned the business named Great Lakes Scholars, aka The Scholar Program, Great Lakes Educational Resources LTD, California Young Scholars, Illinois Young Scholars, Floridas Young Scholars, Lone Star State Scholars, New England Young Scholars, and Southern States Young Scholars and wanted to sell his business.
I was very interested and sent a Good Faith deposit of $2500.00 on 12/6. After some research, study and due diligence, I decided against the purchase. I discussed this with Mr Gill Jan 2, 2014 after he called me to inquire about my progress to get the other $58,000.00. I informed him that I changed my mind and explained my misgivings.
On Jan 13, 2014 I inquired about the status of my $2500.00 deposit via email. Mr Gill informed me he would not be returning my deposit since I had backed out of the deal, not him. From his email dated that day:
"Since the sale was not consummated, by no fault of my own, there will be no refund."
I informed Mr Gill that was not legal. I asked him how he would feel if he "put a deposit on a car you like but then don't buy it. Would you expect the seller to keep your deposit? What would your reaction be as the prospective buyer?"
So far, there has been no response.
