I purchased a car from Millennium Motor Sports dba Bayside Imports on November 24th. The day before the purchase, I had agreed with the salesperson (Mike) to the sale price of $27000 and the dealer processing be of $695. Mike told me that this price was contingent of financing through their lender, so I applied for credit through Bayside Import and Mike told me that I was approved for 4.09% for 72 months with $3,500 for the down payment. I decided to make to trip from Virginia to New York on November 24th to sign all the paperwork and pick up the car. 

Once at the dealership on 24th, Mike told me that they could not qualify me for 4.09% but that the lower rate the bank accepted was 4.99%. Mike and Ricky the finance manager told me that lender also required to carry the ATP that they advertised as total loss protect for $29/month, otherwise the rate was going to be 7.99%.

In order to get the lower rate I agreed to the ATP which I later found out was not refundable.  I asked for a document
from the lender stating that I was forced to carry the ATP, but Mike and Ricky told me that I would receive all the documents in the mail directly from the lender.  They also charged be $1,479.25 or 5% for Virginia Sales tax when the actual sale tax in VA is 3%.  They never provided me a copy of the retail finance contract.

It was late on Saturday and needed to return to Virginia the same day so signed to documents and picked up the car.

However, I called the lender (TD AUTO FINANCE LLC) on December 06, 2012 and asked them about the ATP program.TD Auto Finance confirmed they have never required the ATP as part of the financing and will never require such a thing,
and the dealer had basically lied to me.  Upset, I called back Mike at the bayside import, but he refused to refund me for the ATP which will cost me of $2088 over the life of the loan. I called again on December 8th, 2012, but the dealership refused again to make things right.

In addition, I realized that my finance contract shows a down payment of $3,000 instead of the $3,500 I gave them.  Mike told that they reduced theprice of the car by $500 because they had to play with value of the car to get me financing. This is wrong he kept the money so he would not have to pay taxes on it.  This is unacceptable! I was ripped off and the state and government are also losing money when sale staffs are not reporting the total income they make.   I need to get refunded for this ATP program I never wanted. I will not give up until I get a refund and I will not hesitate to use take legal actions again Bayside Imports and its staff.
