Mobil One Express Lube I got my oil Changed and they did not screw the oil pan plug back in all the way. It fell out and caused my engine to seize. Danbury Connecticut

 I went in to get my oil changed and I started to notice some oil leaking out of the car.  I continued to add oil to make sure things stayed normal.  I was driving on the highway when my car shut off and locked everything at 65 MPH (Brakes, and steering).  I got the car towed to the Subaru Dealership and they told me my oil pan plug must have come loose and fallen out causing my engine to seize.  I ended up having to trade the car in for less than half of what it was worth.  I started to file a lawsuit but my attorny told me it might not be worth it since I was still in college.  Now that I have graduated, I am looking to continue to pursue them.

Mobil One Express Lube Engine Seize

Thank you for the response.

I did however try to take a look under the car myself.  The car was too low for me to totally get under.  I tried using floor jacks to get it in the air for me to get under and was still unable to determine where the leak was coming from.  I did talk to family and friends and they too were unable to determine the source.  They suggested I continue to add oil to make sure I do not run the engine dry.  We had planned on going back to the Mobil Express Lube when I was back from school, but did not make it.  Before making the trip back home, I added multiple courts of oil to ensure that I would have enough for the 2+ hour drive home.

The college student part: I was part of a sports team and had a booked shedule every day and every weekend.  I am not sure that is a total excuse but reasoning behind that information.  I was in a different state and was unable to bring it back to the origional place.

This happened just under 2 years ago.  It will be 2 years ago in August.

 The fact that you were in college has nothing to do with this..it is the fact you have no proof that they are saying it isn't worth it.

You were able to notice oil leaking from the car.  So being a college student what did you do.  Did you take it back to them..NO.  Did you take it to another mechanic to find out why it is leaking..NO.  Did you take a look yourself to see if you can figure it out..NO.  Did you ask any of your friends or relatives who may be able to figure it out..NO.  The ONLY thing you did was to keep putting oil back into your engine.  Did you put in magic oil that was supposed to stop any leaks?

So sorry, but you had plenty of time to negate any damage that could have been done.  So even if by chance they didn't replace the plug correctly, and by some miracle you are able to prove it in court.  You also hold quite a bit of responsibility for the damage that was caused because of your actions.  So the chances that they would owe you anything would be slim at best.

The other thing is that you don't mention anything about when this happened.  Every state has a Statute of Limitations which is the period of time you can sue someone.  In some States this can be as little as 1-2 years.  So if you are in a state that is 2 years, and this happened 3 years ago.  Even if they admit that they did it and that they owe you for damages..you can't do one thing about it because you waited to long to sue them.
