In 2004 i purchased a used tv for $300.00 by cheque.The person i purchased this from asked if i could give her the cash wich i in turn did.I asked her for my cheque back and she said she ripped it up and of course i did not put a stop payment on it.
She went to money mart and cashed it there.It was returned nsf. Money mart collected 149.00 dollars from her.Now i have received a garnishe for 579.00 at my place of employment.When i asked where i was served money mart said that it did not matter where i was served i owed them this money.
I feel like i never had a chance to go to court to defend myself as i was not served with paper's. And How can we go from owing $151.00 out of 300.00 to owing 579.00. I understand there is extra cost or whatever but $579.00 Where are my right's in this.

I know it's been a while since you posted this, and I am not a Money Mart employee, but I work for a similar business--so hopefully I can help a little :)
Unfortunately, in a case like this, Money Mart would not be in error, as you had the responsibility to see to it that your cheque was either in your hand or cancelled. Sadly, the person you gave the cheque to seems to be rather dishonest.
To save your own credit rating, I would suggest paying Money Mart what they say is owed.
Request written statements and detailed receipts for any and all payments made to them, and forward copies of those to the person you gave the cheque to originally with a request for repayment.
You CAN collect the money from the person you gave that cheque to, provided you have a receipt from them for your cash payment.
In the future, just remember to always leave a paper trail and you'll never go wrong :)
