Morgan & Pottinger is trying to collect on a debt that is almost 20 years old. I have disputed the debt and was never given any proof or validation of the debt. Morgan & Pottinger went ahead and pursued legal action against me by filing a civil suit. They have sent a sheriff to my home approximately 8 times. Conveniently, nobody was home each time. One night he came around 10PM. My neighbors have seen the sheriff each time. This is humiliating and has caused me and family much grief, distress, and embarrassment. Morgan & Pottinger has violated FDCPA regulations, has not followed the Statute of Limitations, and has caused us much stress and anxiety. I am personally looking to sue them in a class action suit. I am currently seeking legal action against them. I have also just sent complaints to the KY Bar Association and the Attorney General. I want to sue them for punitive damages. They do not follow the rules boys. It is time to stand up for our rights and fight back!!!!

Class action lawsuits take years....

You can file in small claims court for FDCPA violations as stated in a rebuttal.

GO TO THE BUDHIBBS WEBSITE - DOING THINGS CORRECTLY WILL STOP THEM FASTER THEN A CLASS ACTION.. And put money in YOUR POCKET!

If anyone is experiencing the same or similar circumstances I am interested in a forum or discussion to stop Morgan & Pottinger (M&P) from their current efforts to collect old debt. Specifically, if you had a low balance credit card, older than 5 years that was closed by the credit card co. and possibly sold to M&P, you may have rights you are unaware of. M&P purchases for a very small amount of money uncollected debt and then aggressively goes after the individual(s) by judgement, garnishment, and meanwhile adding interest and court fees. You will probably never pay the debt because the interest compounds daily. Their actions may be against The Fair Debt Collections Act, and anyone can go online and print a copy of these (try a search engine on google, yahoo, etc.). There is also a FREE site for getting a copy of your credit report - and this one is REALLY free (unlike creditreport.com which isn't free although they advertise they are!!). I would be happy to provide that to anyone interested - I try to check this site regularly! I am looking for any actions or stories about Morgan & Pottinger that are similar to my own situation.

Don't waste time with a class action lawsuit...

These people are playing the default judgment game....they file lawsuits and hope that you don't respond and/or show up in court...which means a default judgement...regardless of the debt being outside the SOL.

Send Morgan & Pottinger a letter via Certified Mail + Return Receipt stating:

Per the Fair Debt Collection Practices Act, I am requesting:

- written validation of this alleged debt
- a copy of the original signed contract for this alleged debt
- written validation of the original "date of delinquency"

This letter has been sent via certified mail and the delivery is being time-stamped. If your office refuses to provide validation under the Fair Debt Collection Practices Act, then this refusal will be officially documented.

DO NOT sign your name on this letter.

Make them validate the debt and challenge them every step of the way. If a court date is set...DO NOT be a "no show" under any circumstances...

Im right with you I tried responding in paying on this with these people and paid half of what they wanted by taking a loan out now they are saying i owe the same amount I did before I pd.1500.00 and threating to take me to court again..I told them to go right ahead this time they werent getting another dime from me if you ever get any thing started with them in a law suit or enought people let me know soon im in
