I took a loan for $600 a few month ago but I lost my job shortly after and have been unable to make my payments. Since then Mountain Loan Centers has been continually harassing my friends, family, employer and myself. I am now preparing to file bankruptcy and I have contacted them on several occasions to inform them of this, every time I call they are extremely abusive and refuse to let you speak. I even sent them a cease and desist letter asking that they no longer contact me regarding the debt, per the Fair Debt Collections Act, but they still continue to call multiple times a day. The have said that they never received the letter but it was sent certified and I have confirmation that they received the letter. After this I asked if they do not abide by the law their agent responded with “you owe us money and we will continue to call you until you pay us”, completely dodging the question. This business is very shady, rude and horrible to work with. I wish that I had read other reviews before going to them. If you are considering a loan with them, save yourself the trouble and run far far away.

The reason

 The reason they are calling you is because you borrowed money from them and did not fulfill your legal obligation to pay them back.  The reason they will not stop is because the FDCPA does not apply to them.  They are considered an original creditor and the FDCPA only applies to 3rd Party Collection agencies.

Oh and just as an FYI the "Bankruptcy" threat means nothing to them.  They probably hear that from the dozens of other people who don't want to pay them.  Where the deadbeats think that just saying the word "Bankruptcy" is like some magic pill that gets the company to run away in fear. 

Well the fact is that a) If you declare bankruptcy and they can not collect payment they just take it as a loss so there is no additional incentive.  b) Depending on the bankruptcy you are granted you may be required to pay them back anyways..again no loss.  c) You may not be allowed to delcare bankruptcy.  d)You are just lying and have no intention of declaring Bankruptcy. 

So as you see in all cases they really don't loose out.  Oh there is also another possibility.  Once people use the bankruptcy "threat" they try to beat you to the punch and will actually file a lawsuit against you for not only the amount you borrowed, but the additional interest and fees because you are not paying as well as the court costs.

All of this is totally legal and would have happened with ANY company you decided to stiff. Why?  Because these companies are not charities.

 The Fair Credit Act only applies to Third Party Debt collectors. You are being contacted by the original company therefore you are not protected under this act.  A Cease communications letter does not apply  to this situation.  If you are applying for bankruptcy then inform them of this.  BUT you are not guaranteed to be granted this either.

They are the original creditor, therefore the Fair Debt and Collections Act DOES NOT apply to them.  However there's a very simple, easy to understand method to be used to get them to stop calling.  Its called the PYB action.  It works everytime!  PYB?  Yes...PYB.  Pay Your Bills!  No, I don't work for them.
