The MRCA (Mountain Recreation and Conservation Authority) has place cameras all over the Santa Monica Mountains to catch drivers rolling through stop signs. The stop signs are known to be in quiet intersections, exits from parking lots onto empty streets, and even in the middle of the road. The MRCA has stated that these are in place to curb "the potential for serious injury". Although, in these parks, particularly in the places the cameras are set-up, no injuries or accidents have ever occurred. It's not hard to see what the true motivation is here. The fees imposed for these tickets start out at a cool $175, then...
"Late payment charges of ten percent (10%) per month, simple interest on the delinquent amount, shall accrue and are payable. If the delinquent amount has not been paid within sixty days of the date set for payment then a twenty five percent (25%) nonpayment penalty shall be added to the principal amount due, and thereafter interest shall accrue on the delinquent amount plus the nonpayment penalty."
Do not be fooled. Though these mailers seem threatening, after all they're from the government right? Well, yes and no. Until a court mandates that the cameras must be removed, the MRCA can charge you the money, but does not mean they actually have the legal authority to impose these fines. (other than the fact that they simply say they do) In addition, they have no legal recourse to pursue collection, cannot use DMV holds, cannot file civil suits, and most importantly can't report to the credit bureaus. Even though lengthy instructions are given as to how the fine will grow and grow, the website fails to point out what the MRCA will actually do about it. Futhermore, they admit, "A Violation of the MRCA Ordinance will not be made part of the operating record of the driver or owner of the vehicle. As such, no DMV points will be assessed."
RSI Enterprises is the collection agency who does their dirty work after the initial deadlines are past. They too posess no legal recourse for collection beyond empty threats and half-hearted tenacity.
I repeat, do not pay them... ever.
