Corporate Advocacy Program™
Extortion - Most states define extortion as the gaining of property or money by almost any kind of force, or threat of 1) violence, 2) property damage, 3) harm to reputation, or 4) unfavorable government action. While usually viewed as a form of theft/larceny, extortion differs from robbery in that the threat in question does not pose an imminent physical danger to the victim.
For all of the Lawyers out the....Dont forget, you are a public officer-- The punishment for extortion is a fine, imprisonment, or both[viii]. However, when the offense is committed by a public officer, the penalty can include forfeiture of office. In some states, an extortion victim can bring a civil action and recover pecuniary damages from the accused.
The minute a person pays you to take their mugshot off the internet, You have committed extortion. I encourage all persons to take this to their local and state prosecuters as well as any consumer fraud organizations.

BOISE The Ada County sheriff says its own website is being used to extort money from people who have been arrested. Since 2003, the Ada County Sheriffs Office has been posting daily mugshots of those arrested on their website. But, Sheriff Gary Raney says recently third party websites have been "scraping" the mugshot and names of those on their website and then placing the information on their own website. Scraping websites, like Boisemugshots.com , has thousands of mugshots of those arrested since early 2011. The photos on Ada Countys website are deleted after five days. Boisemugshots.com provides a link to another site that removes the information from the Internet for $99.It's really a form of extortion, said Raney. This is something that really goes against the fundamentals of what I sense we should be putting that mugshot out there for. Raney says he is now considering taking down the website to protect those who have been arrested. There's really an injustice that happens to people, said Raney. Raney is also looking into increasing the security on the site to prevent other sites from taking information.

update on actions against Mugshot companies
AUTHOR: Jane Doe - (United States of America)
SUBMITTED: Wednesday, February 27, 2013
Besides the new Ohio case, which might or might not make it as it seems insufficient in missing many causes of action against these companies and did not include the big boys, such as Google, Yahoo, etc. as a part of this anticipated litigation.
Don't count on what you read from various posts on how these companies cannot be sued. Look at some of the attorneys who file these posts, they specialize in family law, probate law, etc. Not remotely close to the issues at hand. Also, none of them did any due dilligence in reading the many multiple stories on various illegal and violations of existing laws these people have violated.
Also, I just saw a mew website concerning Class Action lawsuit against Mugshots.com. Did anyone realize that the links provided show NOTHING, there is no author, no corporate publication, really nothing. More insulting, is the REQUEST FOR DONATIONS to an unknown "law firm" with unknown lawyers. BUYER BEWARE..... First the article is wrong. No one can start a class action lawsuit in those terms. It eventually becomes through litigation a class action lawsuit. Yes some of the content is correct with respect to how these behind the scenes people do their thing. I did not even bother to check out the links listed under the garbage on the front page. Links to House Bills in two states did not work, etc. All red flags and scum plus fraud. Donate to a stranger?? Enough said. One thing to remember, reported incidents have occurred to certain victims that are stranger than truth. These organizations are not only bad, they are scary. Threats have been made to certain individuals, etc. Don't worry though, seems that if everything was legit, no one would have worry right? There are 65 causes of action against these companies, maybe more, as the list of Defendants is huge. The case against Google, Yahoo, etc. will also be substantial. Believe me, no one has done their homework. Things are in the works, be patient. Assumably, a website will be launched to collect data from the thousands plus more involved that are victims of this racket. Karma is coming and she is pissed off.

I hardly think it costs him 399.00 to remove a photo and of course people are "requesting" it - you don't leave them much choice now do you? Busted.com charges about 30.00 - fl arrests charges abut 100.00 when there is a "sale" and by the time you get through the 15 - 20 sites that have scoured the daily arrests in the area if you are middle class you will be broke because it wiill cost you about 1000.00 to get everything removed.............until his brother starts a new company............not to mention the new lucrative papers that appear in every convenience store that will show your 17 yr sons photo on the front that anyone can buy for 1.25 - it is disgusting............if a company has questions, let them run a background check to at least get the TRUTH - this former convict needs to be put back in jail

My original case was a divorce and I had been given clemecy as I took a plea deal.( I tore through me own home during my divorce) my wife was allowed to charge me with burg/crim misc. The case is now before a new judge to be re opened as it turns out me wife had no legal grounds to have charges filed.
Now I see this photo with Mugshot.coms water mark across it, which they do not own. I have contacted them several times and so has my Attorney. No response. I guess the new owner and I will be in a Florida court room soon. We have all the paper work and required documents Mugshot.com states they need. NO Reponse!!!!!
This is Blackmail at its best, you have these parasites and their unethical attorneys stateing since you request their services it is not extortion. Yes it is as you cannot profit in any way from public records. I am bringing fourth all of the needed information and also signing the petition for a class action law suit along with my own suit in which I will be seeking crimainal charges and damages.
I bet when the Jew is served along with the Parasite Wiggins they will respond. I guess being locked up 4 years in a federal Pen for Credit Card theft didn't phase this Wiggins punk one bit. Time to send him back along with his freinds and scumbag attorneys, which in my view are not attorneys and need be arrested and their License to practice law taken away for life!
These so called Attorneys have over looked many issues! One big issues is that not one person has filed a Freedom of information act request for anyone person that is shown on the site.

Class Action Lawsuit & Media Exposure
AUTHOR: Stop Star Nine Ventures - (USA)
SUBMITTED: Sunday, January 29, 2012
Mug publishers/removers are disorganized and impulsive when it comes to media exposure. We need to put up a solid front for journalists who can see and point out the many hypocrisies regarding the lack of transparency by those who report "real crime news." The more news stories the easier it will be for the courts to identify the perpetrators. The mugpublishers need to be accountable for their actions just as they hold the individuals whose mugs are published accountable for his/her arrest.
Here is a trademark hissyfit that will help us link Florida and Texas. Attorney Bruce Denson pointed out the spat between "reputation" companies in his ripoffreport. I was willing to give Mr. Denson the benefit of the doubt but I think his flawless standing with the Florida Bar will be tarnished at the end of the day. "flynrider" and "truewrong" are obviously mugscammers- I think one or both of them may be Tyronne Jacques.

Why so difficult to explain ethics to mugshot profiteers?
AUTHOR: Stop Star Nine Ventures - (USA)
SUBMITTED: Tuesday, January 17, 2012
If mugshot publishers are the modern day defenders of our 1st amendment rights why do they try so hard to cover up their own identities? Why do they not return phone calls from the press so that they may claim the glory that goes along with mugshot publishing?
Kyle Prall of Star Nine Ventures/Citizen's Information Associates also brought up the 1st amendment in a conversation we had during which he was trying to cover up SEO involvement with online mugshots. Ironically, he felt that Ed Magedson of ripoffreport.com shouldn't have the same right to this constitutional provision now that his information was online.
The fact is that many states and counties across the U.S.A have outlawed the corruption of mugshot publications and that these 1st amendment claims are bologna.
"The same is true for lists and photographs of registered sex offenders. The same is true for mug shots"
Surely you are not trying to equate child molesters to the teenager that is arrested for public intoxication. The extra measures that are done by LAW ENFORCEMENT (not seedy computer geeks) to help the public indentify this sort of criminal reflects the nature of these particular crimes in consideration with the safety of children. It is ridiculous to suggest the public benefits from your sleazy mug publishing.
More ridiculous is how you go on to blather about copyrights. Law enforcement is given exclusive rights according to lawful procedure to collect this information in order to coincide with their investigation and report. If it truly is public info what is copyrighting worth? Nothing. Unless, of couse, you are trying to use the info to extort someone by advertising it.
Who said we have a problem with giving information to the public? If it wasn't for info like this we might believe your B.S.
What we find more disconcerning than the fact that yall not only misemploy the 1st amendment of the constitution, exploit the use of public information, but as indicated above those who publish mugshots know full well the undesirability of what they do. It is on the premise of shame that these mugshot websites and rags exsist. They were created on notions of extortion through embarassment not with the intention to "keep the public informed." This loser quit his job because he found it lucrative to extort others with mugshots.
I am not a lawyer (I doubt you are much of one either) but I do know that the loopholes in state law which are currently not written specificly enough to stop this sort of disgusting thing will be addressed.

Why so hard to explain law to non lawyers?
AUTHOR: Truewrong - (United States of America)
SUBMITTED: Sunday, January 15, 2012
" There is this pesky constitutional provision called the First Amendment. Mug Shots or persons who were arrested and/or convicted are public documents. If you were arrested and/or convicted, and if your mug shot is publicly available, this is a public record that records an actual and truthful fact--that you were either arrested or convicted. If someone published a list of persons who had been arrested for DUI, as long as the list is accurate, no one could possibly complain about the fact that his name appears on this list. The same is true for lists and photographs of registered sex offenders. The same is true for mug shots. Do they have the potential for harming your reputation. You bet!! Do you have a claim based on this harm---no way. Is it illegal for companies to accept fees in exchange for removing your photo from its published collection of mug-shots? Clearly not.
Here is your problem----a mug shot was taken of you. It is available from sources on line. You do not own the copyright in the mug-shot---the copyright is owned by whoever took the photograph and/or the governmental authority who paid him. Thus, you have no legal right to limit its use and distribution. It is a true picture that reflects an unfortunate but real event that occurred in your life. Guess what--you have no claim for invasion of privacy---you have no right to keep private your arrest and conviction history---including mug shots. "

How a net nerd in Lafayette turned an insipid business model into a public-shame machine, then ducked back into his cyber cave when the heat was on.
We all know district attorneys are not the highest paid of lawyers. You have a point that extortion is not the easy charge to prove. In fact, here is an article titled:
It is only extortion if you pay them right?
Well how about misuse of public information:
(c) A person commits an offense if, with intent to obtain a benefit or with intent to harm or defraud another, he solicits or receives from a public servant information that:(1) the public servant has access to by means of his office or employment; and(2) has not been made public.
Uhhohh! aren't lawyers public officers because of the state board that approves their licensing? Are you one of the bottomshelf lawyers working for one of these sleazy operations? I promise 2012 is not going to be a good year for all you rotten sons of b*****.

SUBMITTED: Monday, November 21, 2011
"Lafayette Parish Sheriffs Office spokesman Lt. The charge to remove the photo, Stansbury says, is likened to an administrative fee."
