 I have only been with new wave for a couple of months. Recently, due to a loss in the family, I have fallen behind in payments. Well, Friday the 21st of February, I called the office to make a payment agreement. They agreed not to disconnect my services as long as I made a payment by February 28th. So, today is February 25th and I woke up to them disconnecting my services. I tried to tell their service tech about the agreement and he said he had a work order for today. I call their office and they tell me that because I am 61 days late that they don't have to honor any agreements. So it's ok for them to re-neg on an agreement but yet Im still expected to be honest and make my payment or they are gonna send me to collections? Is that fair? I surely don't think so. Especially considering the situation. So if I am sent to collections I will not be paying because they breached their agreement with me and pretty much told me that they are liars in their own words.

 If you wish to point fingers then we will play that game with you. From your own post I quote.....Recently, due to a loss in the family, I have fallen behind in payments.

This means that YOU were the first party to break your contract agreement. The most basic part of the contract, that you will pay your bill ontime. YOU DID NOT DO THIS!! So you have broken the WRITTEN contract. So you call up to make payment arangments and they tell you ok pay it by this date and your all good. But, since you are just that late in making ANY payment, from your own post again.... I call their office and they tell me that because I am 61 days late that they don't have to honor any agreements.

This means that when YOU called YOU knew that YOU were that far behind on payments. So YOU break the contract terms and want them to work with you and they agree. But when itys found that you are BEYOND a very specific time fram, I.E. 60 days, they have to disconnect because you have shown that you are either a scammer or deadbeat to them. YOU descide that since they CANNOT do what YOU want, youre going to throw a bitchfit and just not pay them at all over a situation that YOU caused. Your personal life and personal issues DO NOT factor into your contractual obligations. No where in the paperwork you signed does it state that YOU get to NOT pay them if life tosses problems at you.

So YOU break the contract, they try and work with you but because you are just that late in making ANY payment, they cannot do as you ask, so YOU refuse to pay for it citing that THEY have broken the terms. Ok let me give you some info. YOURE NOT THAT IMPORTANT!!! You wont get away with this because YOU dont have a leg to stand on. YOU ARE A DEADBEAT!!! You refuse to pay what you LEGALLY owe. YOURE ACTING LIKE A CHILD!!! Youre not getting your way so youre going to stomp your feet and hold your breath until they allow you to continue to screw them over by NOT PAYING. YOU ARE THE PROBLEM!!!

You may not like what I have to say, but SOMEONE has to say it. YOU are making a situation worse for yourself because you THINK youre standing on some form of principle. Principle is all well and good WHEN YOU ARE RIGHT!!! In this case you are not right but dead wrong. Dont continue this course of action. It ONLY ends up with YOU paying more and more money. I dont know if you have a parental figure in your life, but I can tell you that if you did they would tell you that you have to pick and chose your battles. This is a battle you are ill-equiped to fight. It will require a ton of YOUR money to resolve.

YOU will have to accept REALITY because there is no other alternative reality where you win this fight. Yes its kinda upsetting that your service was cut off due to LACK OF PAYMENT. Yes its upsetting, but NOT illegal, that a phone rep tells you one thing and something else happens. But this entire situation could have been avoided. Step off that high horse, its a long ways down, and there is nothing below you to save you from your own folly.

In the future, if you wish to stand on priciple, make sure you have SOMETHING to stand on. And do some research!!!

Nice try, but the FIRST and important "agreement breach" was on YOUR part in NOT paying as agreed..how am I doing so far? Your "REASONS" for not paying as agreed, mean nothing whatsoever.

If your WRITTEN agreement says anything you're told (not in writing) is binding then you have a case.  Otherwise, you ARE headed for collections.  Let us know how your plan works out for you..what could possibly go wrong?
