Hi,

It appears NCO Financial is hiding under following names: Nextcard Payment Services and www.cardmemberservices.net

I am a user of Nextcard from 02/2000, was never late and since August my payments (electronic payments from bank) do not reach Nextcard for several weeks! Even today (10/24/02), payment made on 9/30/02, 24 days later is still not received(!!!)

Results are : Late fees and interest rate to the roof.

Check out latest (closing date 10/08/02) Nextcard (dead company long time ago) statement: Customer Service: PO Box 9229688, Norcross GA 30010 (fake address, extra 8 on the end of p/o box number and most likely your RRR letter with inquiry will bounce back, while you lost time)

How-to's:
1. DISPUTE all unathorized fees/charges (since July 10, 2002) in writing with Return Reciept Requested.

2. Wait for 30 days upon they received it. If no reply, send a friendly reminder with a VALIDATION request of debt.

3. Wait for 30 days, if silence again, dispute whole thing with all Credit Reporting Agencies. Have copies of all documents sent and good track of dates.

4. Make payments on time, do not stop! You must be clean!

Search web for bayhouse.com Excellent free resources how to work with companies like NCO.

Get a digital voice recorder ($50-60 or less) and call them. Mention that conversation is recorded, ask for company name, ID, full name (spelling works best) and authority level.

It appears NCO is looking for an "easy meal". Lets make it as hard as possible instead. If 600,000 or so ex Nextcard cardholders (800k-200k purchased by other bank) will address current problems with NCO, they will have to play by the rules!

Needs immideate attention of FDIC and WA/GA State regulators to NCO practices!

The reason why we have removed links, e-mail address or phone numbers from this report is because people have, in the past, attempted the following, ...all too often.

Posting LINKS

Many times links to unknown web sites will cause your pc to freeze up and /or cause you to get a computer virus, virtually rendering your computer useless. Most of the time, this is the work of a Company or an Individual who has been reported.
Many Government links are no better than the BBB and are just a waste of time, giving you false hope. Many government sites (like the BBB) just collect all information from you, the consumer, but never make that information available, so consumers will NOT be educated as to what exactly they should be looking out for. On the other hand, many government agencies have and do come to the Rip-off Report for information. We have been assisting many government agencies for some time now, including the FBI and Attorney General offices from around the country..

Now that all these Rip-off Reports are out in the open for everyone to see, in a way, this embarrasses these agencies into doing something when they see so many reports on a Company or Individual, because they are now out in the open for all to see. Unfortunately, many (not all) Attorney General Office's and government agencies will not move against a rip-off unless there is going to be some sort of publicity on the rip-off. By reporting your experience on the Rip-off Report, is the next best thing to getting your story on TV or in a newspaper. Most national TV networks and many local TV stations from all around the country come to the Rip-off Report for information they will not get from the BBB, Attorney General office's or any other government agency. Rip-off Report has instigated many local and national stories, resulting in help for victims, in one way or another. Most government agencies will never even bother with rip-offs unless it involves $50,000 or more. Now that the government is cutting back even more dollars for these types of programs, this number will even get higher and we can expect even less to get done, by even less people to work on all these rip-offs.

LAWYERS :

We have also struggled with the following for a long time..
The reason why we delete phone numbers, ..all too often unscrupulous lawyers or individuals posing as lawyers are collecting victims information to only further victimize them. Many times, well-meaning consumers think they are going to collect names and get them to a lawyer who will do something. In every case we have allowed a consumer victim to do this, nothing has ever came of it. Consumers were under the impression that something will be done to get them help. In every case this did nothing but lead the consumer on, further victimizing them, and some consumers were mad at us. We feel it is our responsibility to check the legitimacy of the lawyer before advertising their service on the Rip-off Report.

We will also not allow lawyers to use this web site for free when they will end up taking a large amount of fees, leaving the victim with very little. There are many competent lawyers out there that know how to get the unscrupulous Companies or Individuals who ripped you off, to pay their fees. Those lawyers capable of this can post their numbers after checking with us here at the Rip-off Report.

POSTING YOUR E-MAIL ADDRESS:

For similar reasons as mentioned above, we will not allow individuals to post e-mail addresses, so they can be contacted for more info they claim they cannot post. If that person can contact YOU and get the information, so will everyone else be contacting you anyway, and, if it's good enough for them to receive it by contacting you, then you should be able to post that information for everyone to see and know about. And, many times, in an attempt to get your contact information, consumers will leave an email address; this is just a ploy to sell you a product or some other service. Most likely, you will end up on other junk mail lists. ..if they have something to sell, they should place an advertisement showing support to Rip-off Report.com so we can further help consumers.

Taking Crooks to a new dimension

I paid off my entire balance and closed my account on April 2002.

In November 2002 I received a statement with a "miscellaneus charge" of $136 (even though my account was closed 7 month before!). I tried calling but there was nothing but an automated answering system that said all disputes must be in writting, which I did.

In December 2002 I get another statement this time with the $136 + $29 late payment. At this point my perfect credit is starting to get hurt. So I try calling.

This time I get someone on the phone and after giving me the run adound for a good 30 minutes they tell me it was a mistake and they will zero my balance. I should get a new statemnet saying that.

In January, I get a statement saying $136 + 2 $29 late fee. I'm on the phone again. They claim they will fix it. My Credit history has a 2 month late note in it.

February comes and I get another statement wqith the 3rd late fee included. So I get on the phone. I explained them what happened and that I closed my account in March 2002. They say they'll zero it out. I have a 3 month late note in my credit report.

March comes, I am very upset to find out that again I am being charge late fees, I think my ballace went from 0 to $136 then to $227. This time I did convince them to get me a supervisor. She promised says she fixed it while we where on the phone.

Finally, I do get a statement in May that shows that my account has been zero out. At this point, my credit has been ruined showing a 5 Months deliquency on this bogus charge.

I contact Equifax to start a dispute, they take my info and 3 months later I get nothing back from them.

I contact Equifax again and start another dispute. 3 weeks later I get a report that they have contacted Nexcard and they claimed my records are accurate, my account is still open but I do not owe them anything. My credit history has still the 5 in it.

Today I have contacted Equifax again and file another dispute. I am sort of running out of patience. BEWARE OF THIS FELLONS.

Have had no Problem

I was also a victim of the forclosure of NextCard. However, aside from the inconvenience of losing a great credit card with an awesome charge rate and having to change where to send my payment, I have not had any of the problems I hear about here and elsewhere on the Internet. I get my statments on time, with the agreed-to prime + 0.5% rate. I make my payments on-line at cardmemberservices.net and have never experienced any site down-time.

It helps to pay the bill as soon as I have the money. I get paid on the 15th, but the bill isn't due until the 7th of the next month. I pay on the 16th. Better to pay down the debt rather than hold the money in a non-interest-earning checking account.

I have had very nearing the same experience as the gentleman from Seattle has reported. They are rude, inconsiderate and have raised my interes rate to an outrageous 29.99%. I can't get any response to e-mail or letters in an attempt to get the interes rate reduced. They had the nerve to close my account saysing I hadn't responded to their request for iformation. I am not surprised they were shut down.

I would like to included in any ongoing investigation or class action suit against them.

I have had very nearing the same experience as the gentleman from Seattle has reported. They are rude, inconsiderate and have raised my interes rate to an outrageous 29.99%. I can't get any response to e-mail or letters in an attempt to get the interes rate reduced. They had the nerve to close my account saysing I hadn't responded to their request for iformation. I am not surprised they were shut down.

I would like to included in any ongoing investigation or class action suit against them.

Regarding NextCard and NCO

I'm just a consumer who happens to work for a credit counseling agency, therefore I have a little background information that might help clear this up.

History:
NextCard was closed by the FDIC about a year ago. FDIC attempted to sell all of NextCards accounts to other banks that would continue to service the accounts as active credit cards, but had great difficulty doing this because NextCard was too liberal with who they gave large limit credit cards to. No other banks were willing to take the same risks that NextCard had been taking.

This is part of why NextCard got shut down. Eventually, the FDIC was able to sell many accounts to Merrick Bank and then the majority of the remainder to First National Bank of Omaha (FNBO)(a.k.a. First BankCard Center.) First National Bank of Omaha hired two agencies to service these accounts. NCO is one of these agencies.

How does this lead to your issue:
NextCard's payment address has changed about 3 times in the past year. Also, your account is now owned by a different bank. You mentioned that your bank automatically sent payments electronically to NextCard.

Check with your bank about where and how your payments were sent. Even if they were sent electronically, if they were sent to the wrong company (deposited into the old NextCard account instead of being directed to FNBO) you're lucky if they actually got forwarded where they were supposed to instead of simply being returned / mailed back to you.

In the very least, these payments were definitely going to be late and were going to incur late fees and possible interest rate increases due to the delinquency.

Additionally, Many banks who offer automatic payments do send them electronically to creditors that are specifically set up to receive them, but send paper drafts to other creditors who are not.

It is very possible that your "automatic" payments were automatically mailed to the old, invalid NextCard address you originally supplied your bank with when you set up the automatic payments.

At this time, that original address is invalid by two address changes and the account is with a new bank. You're probably not going to be happy about this, but you were responsible for updating your bank with the new addresses and/or payment information, not NextCard/FNBO/NCO (it's your checking account, not theirs. They probably could not have updated it even if they wanted to.)
