Mr. Kevin Fleming, his wife Maria Rueda and partner Robert Black have collected between one million and two million dollars from little suspecting land purchasers in America and Canada for beach front land on the Pacific Ocean of Nicaragua. The development is called Isla Mariana and they have sold over 40 lots, fully paid at an average of $60,000 each. All buyers are fully paid and have been supplied a title. It is common knowledge these titles are based upon a fraudulent title and thus are also fraudulent. The government has invalidated these titles.

Kevin Fleming and his company Nicaragua Developments SA refuse to advise his clients and have no ambition to repay them. They have known the land is a title problem for over a year. The lies flow from this company like water from the sky. The constant sales pitch to get your money is ever present...before someone else takes your dream lot. It is all lies.

They have a new far bigger round #2 going. Seaside Mariana Spa & Golf Resort. The marketing reach into the USA is large. Designer golf course, spa blah blah. I believe they are doing it again as GREED is everpresent. Fleming is the Hitler of Central America and his thurst for money and power have no boundaries.

On Tuesday, December 16, 2014, the Plaintiff Kevin Fleming made an application for alternative method of service brought without notice to the presiding master at the courthouse at The Law Courts at 651 Carnarvan Street in the City of New Westminster, in the Province of British Columbia to serve the notice of civil claim filed on November 4, 2014 in the Supreme Court of British Columbia on the Defendants Geoff Bramwell, John Bramwell, Nica Projects Ltd. and Brammy Bros. Painting & Restoration Ltd., collectively referred below as the (“Bramwell Defendants”).

The Fleming lawsuit alleges defamation against Geoff Bramwell, John Bramwell, Nica Projects Ltd., Brammy Bros. Painting & Restoration Ltd., Edward Albert Cole, Taylor Collings, David Crowe, Darrell Bushnell, Federico Gurdian Sacasa and 26 John Doe individuals who have published lies over email and the Internet, following the termination of Agreements with Wyndham Hotel Group and Golf Design Agreement with Nicklaus Design.

In an Affidavit of Attempted Service filed in the Supreme Court of British Columbia, the process server from Rapid Taggers attended the work address of the Bramwell Defendants on November 6, 2014 and left a message with the receptionist. On the same day, the process server received a message from Geoff Bramwell stating he was out of town and to return the next week.

On November 10th and 12th, 2014, the process server returned to the work address of the Bramwell Defendants and was only able to leave a message on the intercom. On November 12th, 2014, the process server left a voice mail message for John Bramwell. On November 18, 2014, the process server attempted to serve John Bramwell at a known residential address but was unsuccessful. As of December 1, 2014, no return phone calls from the Bramwell Defendants were received from the process server and it’s the process servers belief that the Bramwell Defendants are evading service.

Rule 4-4 in the Supreme Court of British Columbia permits substituted service in two distinct circumstances: 1) where it is impracticable to serve the person by personal service; and b) where the person to be served cannot be found after a diligent search or is evading service.

Upon hearing Fleming, and on the reading the sworn Affidavits #3, #4 and #5 of Kevin Fleming, the court ordered that Fleming may serve the notice of civil claim by alternative method upon the Bramwell Defendants by posting a copy of the notice of civil claim and the court order at the Bramwell Defendants work address on the rear entrance door of 1332 Franklin Street, Vancouver, British Columbia, and such service shall be deemed to be good service upon the Bramwell Defendants.

In addition, the time within the Bramwell Defendants may file a response to the notice of civil claim be 21 days after the completion of service. Fleming says, “the alternative service message proposed offers a clear statement of the significance of the notice of civil claim and I will continue to defend my reputation and hold the Defendants to account for their irresponsible publishing of defamatory statements that has deeply hurt me and my family and I welcome the opportunity to meet the Defendants in the courtroom to address their negligent behavior”.

British Columbia Supreme Court Grants Kevin Fleming Permission to Serve Defendants Online

On December 15, 2014, the Supreme Court of British Columbia allowed legal notice to be served by private messages on online forums and sent via email to 26 anonymous individuals advising them that they are being sued in the Kevin Fleming defamation case.

Fleming, who filed a defamation lawsuit seeking damages on November 4, 2014, says in the lawsuit that online comments that imply he was acting in fraudulent manner and unethical are untrue.

Fleming does not know who the John Doe Defendants are or where they are located, and there is no cost-effective means of discovering this information. The only readily apparent means of finding out would be to seek production orders against the various Internet service providers.

Even if such orders were granted and obeyed, they would only yield e-mail addresses, service on which would essentially be no different than that under the proposed order. A court permits alternative (“substituted”) forms of legal service when the usual method of hiring a detective or a process server is “impracticable” or when a defendant is evading service.

With the success of the recent motion, defendants such as “Seaside Mariana Investors Union”, “Isla Mariana Investors Union” and “NicaHeat” will be forced into a tricky choice between fighting the lawsuit, and thus exposing themselves to a verdict, or laying low and allowing a default judgment to be entered against them, thus exposing themselves to the risk of being identified and penalized later without any chance of a defense.

Under most circumstances, when a person does not file a statement of defense within a given time, the suing party is entitled to a default judgment, which can result in the collecting of compensation from the defendants.

Fleming believes being able to serve legal notice over the Internet is a way for the law to catch up to social media and the judgment means he does not have to serve the defendants in person. This is not unprecedented; there are other cases of hard-to-identify people being notified through Facebook and Twitter that they have been sued.

According to Fleming, “it is important that this defamation lawsuit is seen to the end where judgment is granted in order that individuals would not have to endure these types of hate-filled campaigns, personal attacks and vicious lies.”

The purpose of this message is to inform you that I filed an action on November 4, 2014 in the Supreme Court of British Columbia, alleging defamation against Geoff Bramwell, John Bramwell, Nica Projects Ltd., Brammy Bros. Painting & Restoration Ltd., Edward Albert Cole, Taylor Collings, Federico Gurdian, David Crowe and Darrell Bushnell for publishing lies over email and the Internet, following the termination of Agreements with Wyndham Hotel Group and Golf Design Agreement with Nicklaus Design.

There are lies being spread on the Internet that I have committed a fraud. These lies have harmed my family and Owners and Promissory Purchasers in the beachfront communities of Isla Mariana and Seaside Mariana in Nicaragua. I'm not going to simply accept it and move on.

I'm pursuing them in court and will obtain orders compelling them to pay damages for their illegal actions. I will force everyone who has failed to take down these lies from their websites to do so and to pay damages for not taking them down when I asked them to.

Edward Albert Cole (Ted Cole) is responsible for the slander, libel and defamation against Grupo Mariana, Seaside Mariana, Isla Mariana, Kevin Fleming and Maria Rueda using the anonymous identity of the Seaside Mariana Investor Union and sending mass emails and posting online messages using various website such as Rip Off Report and Facebook. No credibility should be given to unknown individuals who post online messages and send mass emails anonymously making wild and false accusations under disguised identities such as Ted Cole.

In addition, Ted Cole was responsible for filing a reckless  civil lawsuit against Seaside Mariana Spa & Golf Resort, S.A., Kevin Fleming and Maria Rueda leading to the brand termination of Wyndham Hotel Group and Nicklaus Design at Seaside Mariana Oceanfront Community. Furthermore, Ted Cole, his wife Carmen Elizondo and Michael Edmonds filed unwarranted criminal accusations against Kevin Fleming.

On April 8, 2013, the criminal accusation of Defamation filed by Cole and his wife Carmen Elizondo on February 6, 2013 was dropped with no retraction, penalty, fine, jail time or guilty finding against Kevin Fleming.  The January 31, 2013 immigration restriction against Kevin Fleming was lifted on April 9, 2013.

On May 20, 2013, the civil lawsuit filed on July 5, 2012 by Cole was closed with no guilty finding. In addition, the criminal accusation of Fraud by Cole and Michael Edmonds was dropped and there was no penalty, fine, jail time or guilty finding against Kevin Fleming. The February 20, 2013 immigration restriction against Kevin Fleming was lifted on May 21, 2013.

We have a clear and compelling case with evidence of the negligence of Ted Cole and the Seaside Mariana Investor Union. The obstructionist behavior displayed by Ted Cole, Carmen Elizondo and Michael Edmonds has made moving forward in a positive manner difficult. However, with the Seaside Mariana Investor Union finally and thoroughly discredited we are now free to proceed forward.

We are approaching 7 years from the date of the original filing on rip off report. Seems a review of the situation is in order as a lengthy amount of time has passed for the truth to surface. The truth being Kevin Fleming and Maria Rueda are outright fraudsters and have ripped off North American investors to the 30 million USD range. They have been sued twice so far. The first for 3 million, the second for 5 million.  The first was a success with about 500 acres being transferred away to settle. The second was from California for 5 million which is in progress.

I am almost certain that the leader of that group is the same “Warrior” that waded into this website dispute in 2007 and offered glowing praise for Kevin Fleming.  But you can ask him yourself, I will give you his cell number. Clearly, “warrior” was 100% duped in 2007. In 2013, he is suing for his 5 million dollars back. I know of 2 more lawsuits coming and encourage any of the ripped off Kevin “clients” to contact me. I can put them in touch with other groups to seek justice. I do council you to not litigate in Nicaragua. Kevin’s prior post is offering his attorneys name in Managua.  I council you to consider litigation in other jurisdictions. The best being British Columbia, Canada where Kevin resides.

Some examples that I have heard, and ask you individuals to step forward are:

A Virginia woman who “invested” USD $350,000 is the Seaside scam and was about to buy another fictional beach lot for $40,000 or so in 2012, and finally looked online. Clearly her $350K is gone.

An Ontario man whom paid $80,000 ish in 2012 for a Seaside lot. Next day, Nicklaus and Wyndham jumped ship citing no meaningful construction progress and no chance to get a hotel built. Kevin refused to return any money whatsoever. Of course, his lot is worthless. No power, no water, no golf course, no hotel.  Just a field. In some cases he surrendered that field to settle the 3 million lawsuit.

A Texan whom knows he has lost $350,000 on a fictional condo building at Seaside.

A British Columbia retired couple that has lost all their retirement savings of $186,000. Kevin placed them in a building lot shuffle exercise between Isla Mariana and Seaside over several years. They have contracts to purchase 4 lots, yet have none. And are bankrupt. I understand their demand to be repaid in full was sent in Dec 2013.

There are many, many more. But you get the idea.

Lets go over the headlines on this report since 2007 for laughs:

2007: Isla Mariana forging new ground as reported by Kevin Fleming.  In Dec 2013, the situation is absolutely nothing has been done on the site to further IM. It has gone backwards rapidly. Kevin collected 3 million revenue on this scam. All these buyers should sue.  ELECTRICITY is supplied by a private consortium of area land developers which includes Tamarindo Beach Estates (our development) to this area, but the electricity will never be made available for Kevin Fleming. Kevin decided not to invest $30,000 in 2008 in electricity and have this utility for his site.

Electricity is at lot side and functioning for the 3 other island developments. Five houses are under construction now using this same electricity.  FRESH WATER is supplied by a private consortium of area land developers which includes Tamarindo Beach Estates (our development) to this area, but the fresh water will never be made available for Kevin Fleming. Five houses are under construction now using this same fresh water supply. Based upon his prior poor behavior, Kevin was not invited to participate in the fresh water project.

2007: Isla Mariana given Stewarts Title Insurance as reported by Kevin Fleming in this rip off report website above.  In Dec 2013, the situation is absolutely no title insurance is offered on the Isla Mariana site. It also has gone backwards rapidly to the point that no title insurance is offered in Nicaragua. Some argue due to flagrant false claims made by Kevin Fleming at both his troubled projects: Isla Mariana and Seaside Mariana.

2007: No government objection to Isla Mariana location as reported by Kevin Fleming and 2007: Intendencia disavows existence of Agrarian title as reported by Kevin Fleming.  In Dec 2013, the situation is the Supreme Court of Nicaragua is handing down a series of non-appealable decisions on a sequence of title disputes on the 952 manzana (1637 acre) Isla Real las Penas upon which Isla Mariana theoretically sits. All rulings are in favor of the Agrarian title…. 100%. The other fraudulent, duplicated, moved or fabricated titles are being cancelled. November 2012 was the first ruling on the north end of island. Agrarian title is the correct title. 

October 2013 was the second ruling on a 15 year dispute mid island. Agrarian title is the correct title. Neither dispute involved Tamarindo, nor Isla Mariana, but the arguments are the same. The Agrarian title is the correct title for the whole island. TamarindoBeach owns the Agrarian title. Isla Mariana does not, IM owns a fraudulent, moved or fabricated title and is being cancelled. Aka erased. All derivatives from that title, such as all Kevin Flemings clients, are being cancelled. The process is slow in Nicaragua, but steady. The truth is clear, and the truth prevails.

My door is open to whomever wants access to our information to further their lawsuit to rectify their finances with Kevin Fleming. I will help you. (((email redacted)))

The final comedy is the Nicaragua Brief on WordPress. This is a window into the mind of a fraudster. Kevin writes the “truth” as he sees it. No other person, or journalist sees the situation in this light. The Nicaragua Press is full of lies, especially the sections on Geoff Bramwell, Ted Cole. It even has an Isla Mariana sales promotion. Ha ha. Selling dreams for almost 10 years, since 2004…No title, no power, no water, no work at all… yet still selling it.  Then forwards it all over the world as the truth. The sad part is he uses the “truth” on the Nicaragua Press self promotion that is neither true nor objective 3rd party, yet presented as both, to gather the unknowing flock on his facebook page and takes their money for Seaside and Isla Mariana modified land scams.

We are approaching 7 years from the date of the original filing on rip off report. Seems a review of the situation is in order as a lengthy amount of time has passed for the truth to surface. The truth being Kevin Fleming and Maria Rueda are outright fraudsters and have ripped off North American investors to the 30 million USD range. They have been sued twice so far. The first for 3 million, the second for 5 million.  The first was a success with about 500 acres being transferred away to settle. The second was from California for 5 million which is in progress. I am almost certain that the leader of that group is the same “Warrior” that waded into this website dispute in 2007 and offered glowing praise for Kevin Fleming.  But you can ask him yourself, I will give you his cell number. Clearly, “warrior” was 100% duped in 2007. In 2013, he is suing for his 5 million dollars back. I know of 2 more lawsuits coming and encourage any of the ripped off Kevin “clients” to contact me. I can put them in touch with other groups to seek justice. I do council you to not litigate in Nicaragua. Kevin’s prior post is offering his attorneys name in Managua.  I council you to consider litigation in other jurisdictions. The best being British Columbia, Canada where Kevin resides.

 

Some examples that I have heard, and ask you individuals to step forward are:

 

A Virginia woman who “invested” USD $350,000 is the Seaside scam and was about to buy another fictional beach lot for $40,000 or so in 2012, and finally looked online. Clearly her $350K is gone.

 

An Ontario man whom paid $80,000 ish in 2012 for a Seaside lot. Next day, Nicklaus and Wyndham jumped ship citing no meaningful construction progress and no chance to get a hotel built. Kevin refused to return any money whatsoever. Of course, his lot is worthless. No power, no water, no golf course, no hotel.  Just a field. In some cases he surrendered that field to settle the 3 million lawsuit.

 

A Texan whom knows he has lost $350,000 on a fictional condo building at Seaside.

 

A British Columbia retired couple that has lost all their retirement savings of $186,000. Kevin placed them in a building lot shuffle exercise between Isla Mariana and Seaside over several years. They have contracts to purchase 4 lots, yet have none. And are bankrupt. I understand their demand to be repaid in full was sent in Dec 2013.

 

There are many, many more. But you get the idea.

 

Lets go over the headlines on this report since 2007 for laughs:

 

2007: Isla Mariana forging new ground as reported by Kevin Fleming.  In Dec 2013, the situation is absolutely nothing has been done on the site to further IM. It has gone backwards rapidly. Kevin collected 3 million revenue on this scam. All these buyers should sue.  ELECTRICITY is supplied by a private consortium of area land developers which includes Tamarindo Beach Estates (our development) to this area, but the electricity will never be made available for Kevin Fleming. Kevin decided not to invest $30,000 in 2008 in electricity and have this utility for his site. Electricity is at lot side and functioning for the 3 other island developments. Five houses are under construction now using this same electricity.  FRESH WATER is supplied by a private consortium of area land developers which includes Tamarindo Beach Estates (our development) to this area, but the fresh water will never be made available for Kevin Fleming. Five houses are under construction now using this same fresh water supply. Based upon his prior poor behavior, Kevin was not invited to participate in the fresh water project.

 

2007: Isla Mariana given Stewarts Title Insurance as reported by Kevin Fleming in this rip off report website above.  In Dec 2013, the situation is absolutely no title insurance is offered on the Isla Mariana site. It also has gone backwards rapidly to the point that no title insurance is offered in Nicaragua. Some argue due to flagrant false claims made by Kevin Fleming at both his troubled projects: Isla Mariana and Seaside Mariana.

 

2007: No government objection to Isla Mariana location as reported by Kevin Fleming and 2007: Intendencia disavows existence of Agrarian title as reported by Kevin Fleming.  In Dec 2013, the situation is the Supreme Court of Nicaragua is handing down a series of non-appealable decisions on a sequence of title disputes on the 952 manzana (1637 acre) Isla Real las Penas upon which Isla Mariana theoretically sits. All rulings are in favor of the Agrarian title…. 100%. The other fraudulent, duplicated, moved or fabricated titles are being cancelled. November 2012 was the first ruling on the north end of island. Agrarian title is the correct title.  October 2013 was the second ruling on a 15 year dispute mid island. Agrarian title is the correct title. Neither dispute involved Tamarindo, nor Isla Mariana, but the arguments are the same. The Agrarian title is the correct title for the whole island. TamarindoBeach owns the Agrarian title. Isla Mariana does not, IM owns a fraudulent, moved or fabricated title and is being cancelled. Aka erased. All derivatives from that title, such as all Kevin Flemings clients, are being cancelled. The process is slow in Nicaragua, but steady. The truth is clear, and the truth prevails.

 

My door is open to whomever wants access to our information to further their lawsuit to rectify their finances with Kevin Fleming. I will help you. (((redacted)))

 

The final comedy is the Nicaragua Brief on WordPress. This is a window into the mind of a fraudster. Kevin writes the “truth” as he sees it. No other person, or journalist sees the situation in this light. The Nicaragua Press is full of lies, especially the sections on Geoff Bramwell, Ted Cole. It even has an Isla Mariana sales promotion. Ha ha. Selling dreams for almost 10 years, since 2004…No title, no power, no water, no work at all… yet still selling it.  Then forwards it all over the world as the truth. The sad part is he uses the “truth” on the Nicaragua Press self promotion that is neither true nor objective 3rd party, yet presented as both, to gather the unknowing flock on his facebook page and takes their money for Seaside and Isla Mariana modified land scams.

Tamarindo Beach Continues to Proceed With Development

Despite the rhetoric above since 2007, Tamarindo Beach continues to develop the area and supply quality title to Purchasers. The development wishes not to participate in public laundry washing and regrets involving Rip Off report in 2007. This is not a productive exchange, nor a productive forum for exchange. Several attempts have been made to take this material down. We are informed that rip off does not remove material.

To be clear a) Tamarindo Beach continues to develop the area and is steadily working towards a destination fitting the great natural beauty of the area.

b) We wish all 5 other developments on the island the best in the development of their area and remain open to working together on any common infrastructure.

c) Tamarindo Beach will not be drawn into responding to silly comments as listed in the previous emails from Nicaragua Developments.

This island area is continuing to develop well and I welcome prospective Beach Purchasers to have a look at what is growing.  It is a superbly beautiful spot.

At least one person who purchased at Tamarindo Beach/ Los Suenos wishes to file a class action lawsuit.  Currently there is no office of record in Nicaragua for the Bramwells, Tamarindo Beach or Los Suenos Island Resort Nicaragua. 

 

While the operations of many other developers in the region have come to a halt, we remain on-track and steadfastly moving forward. All the resorts and properties under the Nicaragua Developments umbrella are moving forward on schedule. 

 

Isla Mariana Beach & Marina Resort has been issued a full Masters Title Insurance Policy with Stewart Title Guarantee. In addition to a partnership with Stewart Title Latin America, the organization of Nicaragua Developments has forged recent new partnerships with Convex Capital from the United Kingdom, ORO Travel, PGA Prestige Collection and AON Risk Services.

 

Moreover, Nicaragua Developments is in the process of forging several more exciting new partnerships, some of which are soon to be announced.

 

Isla Mariana has obtained a letter of intent from an International Hospitality Brand and will soon see a 4-star hotel on the sitethe first of its kind on the island. We mean business.

In may of 2008, i visited Nicaragua to buy property. i meet with 3 different people and visited 3 different places to buy property. john bramwell was the developer and rep. for Los Suenos, Tamarindo Beach and ocean estates. he showed me the property the development plans what they had done on the Island etc. 2 days later we went to his office to sign a contract meet with a lawyer that was to have power of attorney to close on the property. i paid half the cost then and the last half at the end of August in 2008, through a wire transfer to the company El Faro. i never received word from Mr. Bramwell or the Lawyer i emailed and telephoned before reaching John Bramwell. he stated everything will be ready when you arrive in November. i tried to call Bramwell once in Managua with no return call from him for several days.

finally, we meet in January of 2009. we drove to the property at which time he stated we didn't send the title because we are not putting in the infrastructure to you lot. then showed me other lots and told me he would work up the plot plans and have them for me in 1 to days. the lot we settled on is on the north end of the Island development called Isle de Marianna. one week later i had not heard from him so i called and sent an email his reply we are working on the plot plans we will have it in another week. one week passed and nothing from him ie no email no phone call. at this time i called and left a message i would go to Leon and find a lawer to help me with this problem i am having with you. the lawyer and i started working on this we drove to Managua to where farco and bramwell's office use to be but no longer was. we went back to Leon contacted the police and district attorneys office ( not called district attorneys in Nicaragua).

i finally reached Bramwell by email and told him i want my money his reply was i am working on the plot plan for the lot but if you don't want it then be ready for a fight. i have all of the email from january of 2008 to the present from this person the lawyer he provided for me and all of the paper transaction. i am trying to find people that would like to join in a class action suit

No Government Objection to Location of Isla Mariana


The Attorney General of the Republic of Nicaragua has issued an official signed letter declaring that the government has no objection to the location of Isla Mariana Beach Resort. The official document, which is referred to as a Letter Of No Objection, is crucial because such a letter can never be issued twice for the same piece of land.

The official document, which is dated April 8, 2008, gives clear authorization for the location where Isla Mariana currently stands. The document also acknowledges all deeds purchased by Isla Mariana. The entire landmass of Isla Mariana has been recorded and detailed, deed-by-deed.

The letter issued by the Attorney General of Nicaragua establishes Isla Mariana as the owner of the land in question. With the issuance of the letter, the State of Nicaragua has made it known that they recognize Isla Mariana to be on State land but in granting an official Letter of No Objection, the government is affirming and protecting Isla Mariana's rights as a good-faith third party purchaser.

A recently surfaced Agrarian title has been a source of contention on the island. The State of Nicaragua, INETER and the Municipality of Leon have weighed in on the matter. The island in its entirety has undergone a thorough investigation. The State of Nicaragua has concluded that the Agrarian title does not correspond to the area that Isla Mariana is located. In addition, the State has raised serious concerns about the origin of the Agrarian Title. The State of Nicaragua will commence an investigation to ascertain whether the Agrarian title was purchased in good faith and is in fact a fraudulent title.

Intendencia De La Propiedad, the highest office of Agrarian Titles in Nicaragua, from the Ministry of Hacienda (the Finance Department) has issued 3 official letters in three different consecutive government administrations stating there is no evidence of the existence of the Agrarian 275 title held by the Bramwell's for the project Tamarindo Beach and Nica Projects.

In regards to the Agrarian title, a letter was generated by an official at Intendencia De La Propiedad confirming its existence in July 2007; however, the person who issued the letter was subsequently fired under strong public allegations of fraud. Prior to that, there were three letters issued by officials from different governments within Intendencia De La Propiedad stating that the Agrarian Title has no registration record in their office.

With the issuance of the Letter of No Objection, the government is confirming its position of upholding the rights of good-faith third party purchasers, such as Isla Mariana. In doing so, the State of Nicaragua is taking a positive step toward resolving property disputes that have been ongoing in the area.

Isla Mariana Beach Resort is located on an island situated off the Western Coast of Nicaragua, between the cities of Leon and Managua.

With the latest findings, Isla Mariana is in the process of securing title insurance with leading carriers in Nicaragua.

Isla Mariana plans to commence construction in the first quarter of 2009 with Development Permits and Environmental Permits already approved and issued to Isla Mariana Beach Resort. Proudly, we are the only project on the island that can report this accomplishment and take the next steps starting construction with support of all local and state government authorities.

The Isla Mariana development plans include a boutique condominium hotel, 69 beachfront lots, amenities center and 15-slip marina.

No Government Objection to Location of Isla Mariana


The Attorney General of the Republic of Nicaragua has issued an official signed letter declaring that the government has no objection to the location of Isla Mariana Beach Resort. The official document, which is referred to as a Letter Of No Objection, is crucial because such a letter can never be issued twice for the same piece of land.

The official document, which is dated April 8, 2008, gives clear authorization for the location where Isla Mariana currently stands. The document also acknowledges all deeds purchased by Isla Mariana. The entire landmass of Isla Mariana has been recorded and detailed, deed-by-deed.

The letter issued by the Attorney General of Nicaragua establishes Isla Mariana as the owner of the land in question. With the issuance of the letter, the State of Nicaragua has made it known that they recognize Isla Mariana to be on State land but in granting an official Letter of No Objection, the government is affirming and protecting Isla Mariana's rights as a good-faith third party purchaser.

A recently surfaced Agrarian title has been a source of contention on the island. The State of Nicaragua, INETER and the Municipality of Leon have weighed in on the matter. The island in its entirety has undergone a thorough investigation. The State of Nicaragua has concluded that the Agrarian title does not correspond to the area that Isla Mariana is located. In addition, the State has raised serious concerns about the origin of the Agrarian Title. The State of Nicaragua will commence an investigation to ascertain whether the Agrarian title was purchased in good faith and is in fact a fraudulent title.

Intendencia De La Propiedad, the highest office of Agrarian Titles in Nicaragua, from the Ministry of Hacienda (the Finance Department) has issued 3 official letters in three different consecutive government administrations stating there is no evidence of the existence of the Agrarian 275 title held by the Bramwell's for the project Tamarindo Beach and Nica Projects.

In regards to the Agrarian title, a letter was generated by an official at Intendencia De La Propiedad confirming its existence in July 2007; however, the person who issued the letter was subsequently fired under strong public allegations of fraud. Prior to that, there were three letters issued by officials from different governments within Intendencia De La Propiedad stating that the Agrarian Title has no registration record in their office.

With the issuance of the Letter of No Objection, the government is confirming its position of upholding the rights of good-faith third party purchasers, such as Isla Mariana. In doing so, the State of Nicaragua is taking a positive step toward resolving property disputes that have been ongoing in the area.

Isla Mariana Beach Resort is located on an island situated off the Western Coast of Nicaragua, between the cities of Leon and Managua.

With the latest findings, Isla Mariana is in the process of securing title insurance with leading carriers in Nicaragua.

Isla Mariana plans to commence construction in the first quarter of 2009 with Development Permits and Environmental Permits already approved and issued to Isla Mariana Beach Resort. Proudly, we are the only project on the island that can report this accomplishment and take the next steps starting construction with support of all local and state government authorities.

The Isla Mariana development plans include a boutique condominium hotel, 69 beachfront lots, amenities center and 15-slip marina.

Who is the Real Idiot here? Greedy and DUMB get ripped- off mosttimes.

Let me see, we have greedy people who want to buy a huge mansion on a paradise of a place for about what one small shack in the worst part of town in the US would cost?

They don't check with the government first in the country where they wish to go as well as other sources BEFORE THEY BUY!

Apparently, they don't know how to research a title or they are so blinded by the allure of this millionaire lifestyle for CHEAP that they go for it and maybe they are conning themselves.

I wonder how many of them actually come to Nicaragua in person and know enough Spanish to get themselves around and ask the questions that need to be asked. How many of them neglected to go to their local law library at their university's law school and checked how Nicaraguan real property laws work and how to find the person who has the information you need.

Can't read or understand Spanish and you go to a country where THAT is the NATIONAL language or at least the main language spoken???? YOU are setting yourself up for a BIG rip-off, my friend.

You buy this exotic property sight unseen????Who is the Real Idiot here?

I had a friend who bought himself some great beachfront property on Padre Island right on the ship channel but when the first Category Five Hurricane blew through there, there was no beach left! Should have checked with a local geologist or civil engineer, I guess...

If you don't research the foreign country where you want to retire, it's not the fault of the guys who are selling you a piece of this deluxe tropical paradise....

Having been immersed in this amazing place for the last three years, I continue to be surprised at how quickly things are progressing here and the energy of the country and its people. And, of course, this economic vigor is feeding real estate development as Nicaragua emerges into world view.


During our travels over the last year, we have found great interest in the possibilities for investment offered in emerging markets such as Central America, and a growing sense among adventuresome investors that this is a chance that shouldn't be ignored. SAN RAFAEL DEL SUR On most tourist maps of Nicaragua, the 2-kilometer stretch of central Pacific coastline between Pochomil and La Boquita appears as unmarked beachfront. But that didn't keep developer Kevin Fleming from finding this undiscovered beach and charting it for what will be the largest and most ambitious tourism-development in Nicaragua's history: The Seaside Mariana Spa & Golf Resort.

The project not only aims to put this beach on the Nicaraguan map, but put Nicaragua on the world tourism map.

Even before breaking ground, Seaside Mariana, which will be home to Central America's first Jack Nicklaus signature golf course, is already causing a buzz in the golf world. Industry insiders say the Nicklaus team is already touting Seaside Mariana as one of the new projects they are most excited about in the world.

The course is expected to have an enormous draw for international golfers looking for a tropical, oceanfront course that's designed by the leading name in the sport.

Nicklaus, who visited Nicaragua last year to scout out the terrain and design the holes, later gushed about what a special and unique course it would be no small claim for someone who has designed more than 300 courses around the world.

The golf buzz is also translating into excitement about the project's real estate potential and its prospects of franchising the Grupo Mariana brand across the country to develop a national chain of world-class tourism destinations in Nicaragua, Fleming said.

We are going to make Nicaragua the No. 1 tourism destination in Central America, and raise awareness about the country around the world, Fleming, a 37-year-old Canadian, told The Nica Times.

In fact, Fleming's dream for Nicaragua and Grupo Mariana named after his Nicaraguan wife is so grandiose it can barely be contained by the country's borders. Over the next five years, Fleming said, he hopes to make Nicaragua a mainstream international tourism destination by developing 25 tourism projects around the country, totaling 5,000 new rooms to meet the Fleming's vision is to have the Seaside Mariana project, a massive complex with condos, golf course villas, a spa and a luxury boutique hotel, serve as the flagship for the other Grupo Mariana developments in cities and towns such as Len, Granada, Managua and San Juan del Sur and that's for starters.

Because of the country's wide array of tourist attractions, Fleming says he wants to offer a product line that would allow a family to visit Nicaragua and spend several days at the Seaside Mariana Spa & Golf Resort, a couple nights at the Grupo Mariana boutique hotel that he plans to build in Granada, and several days exploring Isla Mariana, an island resort off the coast of Len. All the projects, he said, will have the same quality of excellence.

We are going to bring new brands into Nicaragua to satisfy the niche markets and raise the development standards on all levels, Fleming said. Within five years, we'll be the largest project in the country.

The government is also enthusiastic about the project.

Investment-promotion agency Pro Nicaragua has endorsed Seaside Mariana and Tourism Minister Mario Salinas said the project is one of the premier investment projects in Nicaragua and meets all the requirements for government support.

Massive Project

The Seaside Mariana project, which is being planned and developed by Fleming's development group, Nicaragua Developments S.A., will have two luxury condominium buildings beachfront and ocean view as well as 16 golf-course villas and 305 additional ocean view, riverside and equestrian golf-course lots on a sprawling 923-acre private community. The resort community will also include a world-class spa, fitness center, beach club with pools, shops, restaurants, a boutique hotel and nightlife, among other attractions.

Once completed, owners will be able to earn income on their house or condo unit by renting it to golfers and other vacationers through Kemper Sports Management, a leading U.S. sports firm that will manage Seaside Mariana.

Fleming said sales are already brisk, totaling 365 lots and condo units so far in the pre-construction stage. The beachfront condo building has already sold 39 of 86 units, and the ocean view building, which just came on the market, has already sold 13 units. Fleming said he expects construction to start within a year, with completion of the first phase by the end of 2010.

Fleming didn't want to publicize the amount of money he calculates it will take to build the project, but said he's not worried about getting the funding. In addition to

individual investors, Fleming said, he is in talks with major banks and other institutional investors and has already raised a good amount.

The money is out there; it's on the sidelines and people want to invest. They just need to know where to put it, Fleming said.

Courting Investors

When it comes to attracting individual investors to Seaside Mariana, Fleming said the first step is selling people on the idea of the New Nicaragua. That's why Seaside Mariana has started its promotional campaign by focusing on selling the image of Nicaragua on billboards in Managua and with ads in The Nica Times and other press in the United States and Europe.

Fleming realizes that one of the biggest challenges to getting investors to put their money in Nicaragua is to first get them to come see the country. Once that step has been taken, the next step becomes infinitely easier to make as visitors oftentimes become enchanted with the country at first site a phenomenon former Tourism Minister Lucia Salazar called the low-expectation factor.

During a recent investment seminar held for aspiring investors and those who have already purchased at Seaside Mariana or one of the other Grupo Mariana projects, investors from different parts of the United States, Canada, Costa Rica and Europe appeared impressed with the project and the country, each for different reasons.

Anthony Maher, a 29-year-old professional indoor soccer player from Milwaukee, Wisconsin, said his expectations were blown away about both the country and the product. As a sports guy, Maher said the recognized sports brand names Kemper and Jack Nicklaus put him at ease with the investment.

Cliff Hall, of Bournemouth, UK, said his impression of Nicaragua was that it was a great holiday playground for anyone from the United States; it's lovely, actually. Though Hall said the 14-hour trek to Nicaragua from his hometown is a fair journey, Seaside Mariana made sense to him as an investment. As an investment, yes, I think it will be great, he said. I you live in the states and love golf, what more could you want?

Yasmin O'Boyle, a Londoner who bought an ocean view condo sight unseen, said she was impressed with the beauty and feel of Nicaragua. O'Boyle said she is in the process of selling her apartment in London to move to Nicaragua, attracted by the countryside and a pace of life that reminds her of her early childhood in Tanzania.

My childhood was like Huckleberry Finn; life was safe and free, O'Boyle said wistfully. I feel that here in Nicaragua. I want my childhood back!

Still others said they were impressed with Seaside Mariana's social-development foundation, which is helping to build schools, teach job skills and reforest the surrounding areas. The foundation will be financed, in large part, through the sale of 24 prime lots, which will infuse millions of dollars into the social program.

The goa l is to help the entire municipality of San Rafael and the surrounding communities with health and education programs, and also by providing job training for the project, English classes, masonry and carpentry skills, said Carmen Elizondo, executive director of the community development Mariana Foundation. We want to have an economic and social impact on these communities, where the only employment now is seasonal work during the cane harvest.

While no development project can expect to offer everything to everyone, Fleming said the Grupo Mariana project's aim is to offer many things to many people. It's that combination of quality and diverse tourism offerings, coupled with a strong social component, that Fleming said separates his project from others in Nicaragua.

And it's ultimately a lure that Fleming thinks is strong enough to help investors overcome whatever hesitations they might have about Nicaragua.

People will always want to go on vacation, he said. Governments come and go, but the lakes, volcanoes and beaches of Nicaragua will always be here.

SAN RAFAEL DEL SUR On most tourist maps of Nicaragua, the 2-kilometer stretch of central Pacific coastline between Pochomil and La Boquita appears as unmarked beachfront. But that didn't keep developer Kevin Fleming from finding this undiscovered beach and charting it for what will be the largest and most ambitious tourism-development in Nicaragua's history: The Seaside Mariana Spa & Golf Resort.

Even before breaking ground, Seaside Mariana, which will be home to Central America's first Jack Nicklaus signature golf course, is already causing a buzz in the golf world. Industry insiders say the Nicklaus team is already touting Seaside Mariana as one of the new projects they are most excited about in the world.

The course is expected to have an enormous draw for international golfers looking for a tropical, oceanfront course that's designed by the leading name in the sport.

Nicklaus, who visited Nicaragua last year to scout out the terrain and design the holes, later gushed about what a special and unique course it would be no small claim for someone who has designed more than 300 courses around the world.

The golf buzz is also translating into excitement about the project's real estate potential and its prospects of franchising the Grupo Mariana brand across the country to develop a national chain of world-class tourism destinations in Nicaragua, Fleming said.

We are going to make Nicaragua the No. 1 tourism destination in Central America, and raise awareness about the country around the world, Fleming, a 37-year-old Canadian, told The Nica Times.

In fact, Fleming's dream for Nicaragua and Grupo Mariana named after his Nicaraguan wife is so grandiose it can barely be contained by the country's borders. Over the next five years, Fleming said, he hopes to make Nicaragua a mainstream international tourism destination by developing 25 tourism projects around the country, totaling 5,000 new rooms to meet the Fleming's vision is to have the Seaside Mariana project, a massive complex with condos, golf course villas, a spa and a luxury boutique hotel, serve as the flagship for the other Grupo Mariana developments in cities and towns such as Len, Granada, Managua and San Juan del Sur and that's for starters.

Because of the country's wide array of tourist attractions, Fleming says he wants to offer a product line that would allow a family to visit Nicaragua and spend several days at the Seaside Mariana Spa & Golf Resort, a couple nights at the Grupo Mariana boutique hotel that he plans to build in Granada, and several days exploring Isla Mariana, an island resort off the coast of Len. All the projects, he said, will have the same quality of excellence.

We are going to bring new brands into Nicaragua to satisfy the niche markets and raise the development standards on all levels, Fleming said. Within five years, we'll be the largest project in the country.

The government is also enthusiastic about the project.

Investment-promotion agency Pro Nicaragua has endorsed Seaside Mariana and Tourism Minister Mario Salinas said the project is one of the premier investment projects in Nicaragua and meets all the requirements for government support.

Massive Project

The Seaside Mariana project, which is being planned and developed by Fleming's development group, Nicaragua Developments S.A., will have two luxury condominium buildings beachfront and ocean view as well as 16 golf-course villas and 305 additional ocean view, riverside and equestrian golf-course lots on a sprawling 923-acre private community. The resort community will also include a world-class spa, fitness center, beach club with pools, shops, restaurants, a boutique hotel and nightlife, among other attractions.

Once completed, owners will be able to earn income on their house or condo unit by renting it to golfers and other vacationers through Kemper Sports Management, a leading U.S. sports firm that will manage Seaside Mariana.

Fleming said sales are already brisk, totaling 365 lots and condo units so far in the pre-construction stage. The beachfront condo building has already sold 39 of 86 units, and the ocean view building, which just came on the market, has already sold 13 units. Fleming said he expects construction to start within a year, with completion of the first phase by the end of 2010.

Fleming didn't want to publicize the amount of money he calculates it will take to build the project, but said he's not worried about getting the funding. In addition to

individual investors, Fleming said, he is in talks with major banks and other institutional investors and has already raised a good amount.

The money is out there; it's on the sidelines and people want to invest. They just need to know where to put it, Fleming said.

Courting Investors

When it comes to attracting individual investors to Seaside Mariana, Fleming said the first step is selling people on the idea of the New Nicaragua. That's why Seaside Mariana has started its promotional campaign by focusing on selling the image of Nicaragua on billboards in Managua and with ads in The Nica Times and other press in the United States and Europe.

Fleming realizes that one of the biggest challenges to getting investors to put their money in Nicaragua is to first get them to come see the country. Once that step has been taken, the next step becomes infinitely easier to make as visitors oftentimes become enchanted with the country at first site a phenomenon former Tourism Minister Lucia Salazar called the low-expectation factor.

During a recent investment seminar held for aspiring investors and those who have already purchased at Seaside Mariana or one of the other Grupo Mariana projects, investors from different parts of the United States, Canada, Costa Rica and Europe appeared impressed with the project and the country, each for different reasons.

Anthony Maher, a 29-year-old professional indoor soccer player from Milwaukee, Wisconsin, said his expectations were blown away about both the country and the product. As a sports guy, Maher said the recognized sports brand names Kemper and Jack Nicklaus put him at ease with the investment.

Cliff Hall, of Bournemouth, UK, said his impression of Nicaragua was that it was a great holiday playground for anyone from the United States; it's lovely, actually. Though Hall said the 14-hour trek to Nicaragua from his hometown is a fair journey, Seaside Mariana made sense to him as an investment. As an investment, yes, I think it will be great, he said. I you live in the states and love golf, what more could you want?

Yasmin O'Boyle, a Londoner who bought an ocean view condo sight unseen, said she was impressed with the beauty and feel of Nicaragua. O'Boyle said she is in the process of selling her apartment in London to move to Nicaragua, attracted by the countryside and a pace of life that reminds her of her early childhood in Tanzania.

My childhood was like Huckleberry Finn; life was safe and free, O'Boyle said wistfully. I feel that here in Nicaragua. I want my childhood back!

Still others said they were impressed with Seaside Mariana's social-development foundation, which is helping to build schools, teach job skills and reforest the surrounding areas. The foundation will be financed, in large part, through the sale of 24 prime lots, which will infuse millions of dollars into the social program.

The goa l is to help the entire municipality of San Rafael and the surrounding communities with health and education programs, and also by providing job training for the project, English classes, masonry and carpentry skills, said Carmen Elizondo, executive director of the community development Mariana Foundation. We want to have an economic and social impact on these communities, where the only employment now is seasonal work during the cane harvest.

While no development project can expect to offer everything to everyone, Fleming said the Grupo Mariana project's aim is to offer many things to many people. It's that combination of quality and diverse tourism offerings, coupled with a strong social component, that Fleming said separates his project from others in Nicaragua.

And it's ultimately a lure that Fleming thinks is strong enough to help investors overcome whatever hesitations they might have about Nicaragua.

People will always want to go on vacation, he said. Governments come and go, but the lakes, volcanoes and beaches of Nicaragua will always be here.

SETTLEMENT IS IN PROCESS OF AGRARIAN TITLE BETWEEN TAMARINDO & ISLA MARIANA

It is good to know that this dispute appears to be over. Several settlement discussions have taken place over the last 5 months. The Nicaraguan attorney general's office has been very involved in settling the titles validity which has made it possible to move forward with a settlement proposal.

At this time, it appears that a settlement has been accepted by both sides whereby all past and future land purchasers will receive the proper title. In fact, the title for this island area is likely the strongest for many miles due to the intense investigative work that this dispute triggered. Leaving no possible title flaw uncovered, this title is now very strong. Any purchaser in either development should feel very comfortable in their decison to buy in this area of the Pacific coast of Nicaragua

It is preferred that through a cooperative effort the individual lot owners of this area will receive their individual lots and title insurance. All the pieces are in order to achieve this. An Open Letter to Isla Mariana Owners


Dear Friends,

We want to thank each and every one of you for your words of encouragement and continued support during this trying period. There is light at the end of the tunnel. We have a clear and compelling case for clean title and are working hard toward achieving that end.

Agrarian titles are issued by the OCI (the government office of Agrarian titles in Managua) for the specific purpose of agriculture and farming. Agrarian titles refer to land that was confiscated by the government and given to a new person or group of people, usually the underprivileged, for the express purpose of farming. Roughly half of the land included in the 275 Agrarian title is unsuitable for agriculture. It is also noteworthy that the 275 Agrarian title is undivided, which raises further question as to its validity.

In addition to our efforts on behalf of all our lot owners, another bump in the road for Isla Mariana has arisen by way of our former partners. As most of you are aware, we have severed all ties with our ex-partners, Geoff and John Bramwell. We did so after learning they had formed a secret corporation (Toucan Properties) in order to purchase land that was under an option-to-purchase contract between the seller and Nicaragua Developments. From that day forward we have been entirely separate entities. This is an important distinction because our former partners are trying to sell land with the questionable 275 Agrarian title, which we want no part of. Our reputation is of the utmost importance to us and we do not wish to be confused with them.

Our credibility is paramount. Compromising our owners or settling on the easy way out runs contrary to our core values. We are fighting for you by working in conjunction with First American to get clear title. Additionally, at some point in time we may find it necessary to expose the 275 Agrarian title for what it is. In Nicaragua opportunists can exploit developing markets by creating new titles for personal gain. Sometimes in cases like these a developer might choose to simply buy up all the titles to avoid any hassle. Unfortunately, this is a self-perpetuating cycle as it sustains a lucrative business for those who create these alternate titles.

Our former partners at Tamarindo Beach have purchased just such a title and are trying to assert that it takes precedence. Irrespective of the fact that their title has multiple problems, the Bramwell's are trying to argue that it supercedes all others. It's convenient to purchase a title for pennies on the dollar in order to make the claim that it covers all of the neighbor's beachfront. Convenient, but not plausible.

Our former partners purchased a fraudulent title for a fraction of the previously established market value of land in the area. It is a textbook case of too good to be true. They have been scammed, which is unfortunate. The Bramwell's' incentive to fight is extremely high, as they will be left with but a few manzanas of land when the Agrarian title is ultimately discredited. Developing this small area may not be economically feasible. Thus, their impetus to resort to any and all means to defend their claim is very strong. This is a nuisance, but not a major roadblock for Isla Mariana. The reason? The Agrarian title has numerous red flags and questionable issues.

Our goal, and our commitment to you, is to build a relaxing, fun-in-the-sun, beachfront community that all will want to visit and enjoy. Please be assured that temporary obstacles will not deter us.

The bottom line is that the owners of Isla Mariana are first and foremost in our minds. We won't be satisfied until our development is the carefree oceanfront getaway that we originally planned and you still deserve. We have a clear and compelling case to move forward on your behalf. We intend to keep our promise to you.

In closing, all companies issuing title insurance in Nicaragua such as, First American Title Insurance, Stewart Title Insurance and Land America have been notified of the false Agrarian Title created by fraud many years ago and documented in the official records of the state. The Agrarian Title held by the Bramwell's is not likely to receive title insurance anytime soon as the evidence is clear that no such title can be assured of claims against the title in the future.

The basis of your wild extractions is from June 2007. This basis is that the OTR cannot locate files as of June 2007 in relation to this agrarian deed. From this simple position statement you have concluded and convinced your "clients" that 1)the deed does not exist 2) It is possible to remove an agrarian title 3) It is possible to magically make this land yours after removing a title 4) The OTR will never find the files 5) The coastal law will not apply.

All is FALSE. All that they said is in June 2007, the government cannot locate the file. However, in July 2007 they did locate the file and reviewed it all closely to the point where they issued an official position statement signed by the director that all is in order on this agrarian title. This document has been reviewed by at least 5 independent 3rd parties of substance. It is legitimate.

The titles you sold are invalid. All your bad words in relation to Tamarindo Beach and the Bramwell's is utter garbage.....complete trash. If you cease this stupidity and bring a good offer to legitimitely purchase the land that you require, I can ask that your offer be considered for a limited time.

INTENDENCIA DISAVOWS EXISTENCE OF AGRARIAN TITLE


In response to a request submitted to the Official Property Intendencia office on June 21, 2007 by one Ms. Rosa Argentina Solis in the city of Managua, it has been determined that according to the computerized registry of the highest governmental office of titles in Nicaragua, there is no evidence of the existence of the Collective Reform Agrarian Title No. 55621, Volume 992, Page 42-43, first seat.

According to Mr. Ciro Orozco Berrios, Lawyer and Director of Titles at Intendencia, there is no evidence of the aforementioned Reform Agrarian Title, allegedly submitted on the second of November, nineteen eighty-nine (1989). The title in question is allegedly located in the region of Las Marimbas, Municipality and Department of Leon and is registered in favor of the following gentlemen: Hector Jimenez; Douglas Rivas; Angel Guido Castro and Luis Guido Parajon.

The Agrarian Reform title No. 55621 has been central in a dispute regarding proper land ownership on Isla Real de la Pena, Nicaragua.

The party most affected by the issuing of this official decree is the Tamarindo Beach and Ocean Estates development, which own 92% of the Agrarian title in question.

Dear Isla Mariana Owners,

There has been a major development in the title case concerning Isla Mariana Beach Resort and Tamarindo Beach and Ocean Estates. We are pleased to report that what we have believed for over one year has been comprehensively and unequivocally proven in the month of June 2007.

Indendencia, the highest office of Agrarian Titles in Nicaragua, from the Ministry of Hacienda (the Finance Department) has issued an official letter stating there is no evidence of the existence of the Agrarian 275 title. The Agrarian title is not valid as decided by the highest official office of titles in Nicaragua. This is a very important development for all owners at Isla Mariana.

As you know, for months the Bramwells have been maintaining that they need a letter from Intendencia to demonstrate the validity of their Agrarian title. The highest Director within the official title office of Intendencia, Mr. Ciro Orozco Berrios, has issued a letter. The letter states that the Agrarian title does not exist in Intendencia's computerized records or in any other official records.

Not only has Intendencia, the highest governmental body in the country that authenticates titles, declared that the Bramwells' Agrarian title does not exist, they have also named and referenced the exact title number, exact volume, page and seat. The bottom line is that the Bramwells will never receive the letter they need because it does not exist.

In essence, the Bramwells gambled. They hoped to purchase a title for pennies on the dollar and later find a way to make it legitimate. Thankfully, in the end the bet did not pay off. They have no viable development, no legitimate title and no title insurance. Soon the Agrarian title should be annulled.

As we have mentioned, the Bramwells had no option but to fight because they were aware that without the Agrarian title they would have nothing. We were standing in their way and thus they had strong incentive to attempt to sully the character of Nicaragua Developments. Any emails received from them are more readily understood when viewed from that vantage point.

Tamarindo Beach has maintained that the Agrarian title overlaps Isla Mariana and that we must move. In addition to the recent official disclosure from Intendencia, First American and Garcia Boden ruled that there was no evidence to support the Agrarian title and that the title may be located in an area elsewhere according to the same Agrarian title description. (That is if it were real, which we now have unequivocal evidence that it is not.) We are not going anywhere. We have a legal right to be where we are.


Nicaragua Developments has been acting in good faith throughout this difficult process. When a problem was discovered, we were adamant about not exposing future investors to risk. We have been diligently trying to resolve the matter, while simultaneously contending with multiple difficulties and delay tactics generated by the Bramwells and Tamarindo Beach.

As you know, the obstructionist behavior displayed by the Bramwells has made moving forward in a positive manner difficult. However, with their title finally and thoroughly discredited we are now free to proceed forward. We are on track to present our case to a court of law and move forward with the development of Isla Mariana.

Investor's rights are our number one priority just as they have been from day one.

Therefore, during the month of July and August we will be requesting all Power of Attorneys from investors in order to begin action against Tamarindo Beach and to resolve our title issues through legal means. It is our desire to resolve these matters once and for all.

We will not be accepting any deals from Tamarindo Beach because we feel it could jeopardize our investors. The Bramwells recently offered us $2 million to keep quiet and allow them to get title insurance. We refused because we could not accept a deal when we have evidence to the contrary regarding the title. We are simply not willing subject our investors to the adverse consequences, regardless of the money.

Thank you for your continued patience and faith. Resolving a successful future for all Isla Mariana owners is our utmost priority. Recent developments have put wind in our sails and we are ready to forge ahead.

As The Agrarian Title is Authentic, Your Isla Mariana Lot Sales are Void. The Game is Over

In July 2007, the highest level of the Nicaraguan government in relation to agrarian titles, issued notification authenticating the validity of the agrarian title under the land of Tamarindo Beach resort and other neighboring land holders. This department is known as the OTR. This OTR letter is signed by the top official in this organization and can be verified by any Nicaraguan law firm. In the last 2 months, several large Nicaraguan law firms and the state government of Leon have been supplied the aforementioned OTR letter and they have confirmed its legitimacy and authenticity. The firms Garcia & Bodan Law, First American Title Insurance, Taboada & Assoc Law and other large law firms have looked the Tamarindo agrarian title certification letter over closely and confirm it is legitimate. Several other smaller Nicaraguan law firms have done likewise and agree the title is legitimate. The State Government has also reviewed this document and like-wise agrees. Therefore the title under the Tamarindo Beach site is legitmate and is beyond any claim whatsoever.

Any ownership claims on this 275 manzanas of land in the mid portion of Isla Real Las Penas must be based upon ownership of this agrarian deed. This means that the land sales that Nica Dev has made at Isla Mariana are based on another deed, which was clearly shown over 1.3 years ago as a fraud. All Isla Mariana lot sales to Warrior of Cupertino, his friends and all others across North America are fraud. I believe that they have had their titles rescinded by the State government of Leon as they are based on a fraudulent title. I understand that some pieces of this land may be Nica Dev's, but a proper subdivision from the the majority owner of the correct agrarian title is required. I am sorry Warrior, but your lot purchase is worthless as it is for up to 40 more buyers.

Nica Dev arguements are plentiful and false. It is virtually impossible to annull an agrarian title as Mr. Fleming has been telling his "clients" for close to 2 years. The truth is the money has been spent on lavish living and may not be available to repay. Do not kill the messanger. Check the facts. So, what does Nica Dev do? They have fenced in the land, posted armed guards and posted signs on this land to illegally possess it. Similar to the 1930's fascist, if the law does not appeal to their needs, they post armed men and fence it.

Has a lesson been learned by Nica Dev before they pushed on to Seaside Mariana? It is not looking good. But I suggest others investigate. Warrior states he has millions of dollars in Seaside Mariana. I wonder how is it that for many miles to either direction the federal government owns the beach, yet Seaside owns their beach? How is it that the semi reliable rumor mill says that the Seaside Vendor had actually sold 3 parcels on the beach of Seaside to others prior to selling to Nica Dev. This would make of the 1.5 milies of beach at Seaside, .9 is untouchable as it is rare environmentally sensitive white mangroove. So of the .6 miles of beach remaining, 3 more parcels are rumored to be owned by others. This may (read likely) makes the 10 lot packages sold at Seaside with the PRIME BEACH LOT another fraud as some of those beach lots are owned by another. You do the research, it looks like the lesson learned is: Fraud Pays Well. I admit I may be wrong at Seaside as I cannot stomach the research...just a heads up to the interested. But I am fully researched at Isla Mariana. Thank you rip off report for the forum.

GEOFF BRAMWELL, NICA PROJECTS FRAUD ALERT

William from San Jose, California (who is actually Geoff Bramwell from Vancouver, BC) is nothing more than a rival developer with a big chip on his shoulder. His development borders mine and is called Tamarindo Beach and Ocean Estates. Geoff has lied about his name and he's lied about where he lives and the lies don't stop there. What you're seeing reflected in his post is an increasingly desperate man who is trying to mask his identity.

Here are the facts. Geoff Bramwell is a former partner of mine. Unsatisfied at being a minority partner in an enterprise that created success rapidly, Geoff Bramwell went behind my back to purchase land that was under contract to my company, Nicaragua Developments. Geoff Bramwell brought in his brother John Bramwell and they formed an anonymous company (Toucan Properties) in order to conceal who was purchasing the land.

Geoff Bramwell and his brother John Bramwell then proceeded to purchase what is known as an Agrarian Title. Had they done their due diligence, they would have known it was a fake. Why did they buy it? Consider this: land values on the island were not cheap, yet Geoff Bramwell was offered an Agrarian title priced at roughly 4% of the established price per manzana on the island. In a rational person this would set off all kinds of alarm bells, but the key word here is rational.

I'm not a mind reader, but I assume that Geoff Bramwell figured that if he could purchase the Agrarian Title for a 96% discount off the market price on the island he'd have plenty of money left over to try to make it legitimate. And that's exactly what he tried to do. The Agrarian title sequence was out of order, the type of land (mostly mangroves) was inappropriate for an Agrarian title, the official paper was incorrect, and further irregularities piled up from there. To top it off, the official governmental office of land titles could find no evidence that the Agrarian title ever existed. Despite all contrary evidence, the Bramwells insisted that their title was legitimate.

It was more bad news for the Bramwells when they tried to get title insurance for their project, Tamarindo Beach and Ocean Estates. First American Title Insurance Company declined their request for title insurance. But that did not stop Bramwells from continuing to advertise their land to unsuspecting buyers.

If Geoff Bramwell could find a way to make his title legitimate he stands to earn millions, if not tens of millions of dollars in profit from his development. There seems to be one major hurdle standing in his way. As you may have guessed, based on the venom he's aiming in my direction, that hurdle would be the truth. He doesn't care for my company or me because we're standing in the way of his duplicity.

Mr. Bramwell's post is truly out of line. Referring to a rival businessman (and former partner) as Hitler is a slap in the face to the millions of people who were killed in World War II, and speaks to Mr. Bramwell's loose grip on reality. Perhaps a history lesson is in order.

Mr. Bramwell will get a lesson of one kind or another when his Agrarian title is annulled and he is left with nothing. Having one's back to the wall can bring out a viciousness that is frightening to witness. And that is exactly what we're seeing on this board. Any post from William/Geoff from San Jose/Vancouver should be viewed through the lens of what it is the rantings of a man with his back against the wall and nothing to lose.

Consequently, my group continues to invest multi-millions of dollars in Kevin's projects. We continue to be impressed with the plan, strategies, timeline and what has been achieved thus far. Kevin has first rate business goals, partners, and above-all, passion for a development that will eventually become a destination in Central America!

I have dealt with many developers, investors, builders, real estate professionals and found Kevin to be extraordinaire. I have not only invested in Kevin's projects but also acquired a property to build my own retirement home. His vision and project timeline are investors' and owners' dream.
