Four years ago we purchased and financed two identical 2003 Nissan Altimas. The cars were purchased at Sterling McCall Nissan and financed through Nissan Motor Acceptance Corporation.

On June 26th we traded my wife's Altima in on a new Mazda Miata and were looking to trade my Altima in on a new Altima coupe for my wife. Our salesman contacted NMAC for payoffs on both vehicles. They made him put me on the phone and verify who I was and that my salesman had permission to receive the payoff figures.

I gave that permission. They gave him the payoff amounts. On July 7th we traded my car in and bought the new coupe for my wife. On July 11th we received a letter from NMAC stating they'd received 3,273.10 on my wife's 2003 Altima and showed a remaining balance of 332.30 due on or before July 21, 2007. The 3,273.10 was the payoff amount given to the dealer on that vehicle.

I called them up and the representative said they'd only received 3,265.61. I told the representative I had the letter right in front of me that said they'd received 3,273.10 which was the payoff amount on my wife's car. She had no explanation for that. She said the car dealership hadn't payed them enough money and to contact them.

I called the Nissan Mazda dealership I'd dealt with and they informed me they'd made payment on both vehicles. I called NMAC back and they said they showed they'd only received a check for 3,265.63 on the one vehicle and nothing on the other. I asked to speak to a supervisor. I told him about the letter and he said someone on his end at NMAC must have made a mistake and that I could consider the $332.30 something they would write off because it was their mistake.

I called NMAC several days later to check and see if both accounts had been closed and they informed me that both accounts were open and told me one car had been shorted on payment and they'd received nothing on the other. I called the dealership and informed them of this. They assured me they'd made payment on both but would check into it.

Then I received two letters in the mail from NMAC saying I was past due on my payments of 275.32 on my wife's car and 303.18 on my car. I called the dealership and they informed me that they contacted NMAC and that NMAC had applied the payoff for my wife's car to my car's payoff by mistake and that they'd sent the payoff check to my car back to the dealership regular mail for no apparent reason. The dealership stopped payment on that check, called NMAC and told them they were overnighting them a new check and to apply it to the right vehicle.

At that time the dealership confirmed both payoff amounts on both vehicles. The dealership contacted me and said that I could call Thursday afternoon of that week and the accounts should both be closed. I waited until Friday afternoon to call. NMAC told me that one account had been closed and they were mailing the dealership the title to that vehicle. Then they told me complete payment on the other vehicle had arrived that day (Friday) and that it would be posted at midnight that Friday night but wouldn't show up until Monday morning because they were closed on the weekend.

The finance department at the dealership called me yesterday and said they'd contacted NMAC to see if the accounts were closed and NMAC said their computers were down and couldn't give them that information. They told me they'd received returned checks on both vehicles from the bank showing that NMAC had cashed both checks last week. The checks were seperate and that a VIN number was written on each check.

I called yesterday afternoon at which time a supervisor informed me that both accounts were still open and had deficient funds to be closed. He told me his company wasn't going to eat the deficient amounts still owed according to their records. My wife went to their website online and discovered that the one account was posted on their website as closed but the other showed as still being open yet I had just been told that both accounts were still open and deficient.

If this goes past August 16th it's going to look bad on our perfect credit. I had asked NMAC if I'd ever missed a payment in the four years we'd had both accounts. Their answer was no. I then asked if we'd ever been late with a payment. Their answer again was no. Our credit score is somewhere in the 700's to 800's. We've never defaulted on ANYTHING EVER! My wife and I are teachers.

Our last 3 weeks have been a living hell over this mess. Last night NMAC called me at 6:40 p.m. at my house and informed me I still owed them 330.32 ASAP. I talked to yet another supervisor and this time asked to speak to his supervisor which he transferred me to her voicemail. I will never again purchase anything through NMAC and strongly recommend no one else does either. Read the other posts and you'll see I'm reporting the exact truth.

I, at this point, would like to seek legal counseling and take some sort of action against NMAC for the way I've been treated, the way my accounts have been mishandled and the way NMAC has put me through over 3 weeks of mental torture over this whole mess, their mess to be more precise.
