 have reviewed the response made by the business in reference to complaint ID 10289480, and have determined that this does not resolve my dispute.  For your reference, details of the offer I reviewed appear below. have sent close to 100 pages of documentation showing expenses, pictures of sub par work, copy of an invalid contract not signed by my wife, No Problems incorrect invoice charging for tile work they already said that the homeowner did, copies of checks and receipts for everything. I mailed this documentation to the BBB on November 3,2014. The expenses incurred by homeowner are as follows: * Contractor board up on October 1, 2013 - $1200  We had not hired No Problem! at this point. That does not change the fact that it is a requirement by the insurance company.

This is an expense that our policy covers and therefore, was deducted from the insurance money. * Public Adjuster - $8351.11 Aaron advised us against hiring a public adjuster immediately and explained that it is because the cost of hiring one is very expensive. He knew the full cost of the public adjuster would come out of our settlment because he tried to sell us on the idea of him putting that money towards newer upgrades and options. We did some research and decided that hiring a public adjuster would be in our better interest. The adjuster was able to double our settlement. Aarons invoice did not change until our policy coverage amount did. *Garage door install - $1180 This was paid for by insurance company, and was in the scope of work. However Aaron was going to supply a 26 gauge door, with a chain drive opener. We were able to get a 24 gauge door with a belt opener for the same price.

Doesnt matter which one of us paid for it...it went towards the house from insurance proceeds. * Fence Material - $2000 Going with Aaron for our rebuild was contingent upon him paying for a new fence on the back of our property. He agreed to cover the cost, both my husband and I were there when he comitted to it....kind of puzzling to see him act like he doesnt know what we are talking about. My husband provided the materials and labor to put up the fence, and remembers Aaron saying "I thought I was paying for that" * Entry track lighting - $192.69 Aaron was allowed $3500.00 for lighting. We managed to only get $1400.00 to spend, not to spend just anywhere. We were given only one place to shop, and got 2 fans and 5 light fixtures. That left 3 fixtures with no lights, so we purchased a track light...just like we had before the fire, and husband installed it. * Closet light - $100 Aaron was allowed $3500.00 for lighting.

We managed to only get $1400.00 to spend, not to spend just anywhere. We were given only one place to shop, and got 2 fans and 5 light fixtures. That left 3 fixtures with no lights, so we purchased a light...just like we had before the fire, and husband installed it. * Floor Decor - $544.55 This was our tile expense after Aaron forgot to put the soap dish in shower wall, then they ripped it out and used all the tile we bought to do the tub, including grout, bullnose, and several boxes of tile. Then we had to buy mosaic tiles to complete shower tile on floor. All just trying to speed up the process. * Replacement door opener rail - $53.04 Aaron lost the rail to the door opener, and it had to be replaced. * Door Pickup - $90.00 Aaron had my husband drive past Greenville TX to pick up and deliver door back to house. * Soap dish - $15.00 We provided soap dish during guest bath tile install because all they were willing to do was using a piece of tile with unfinished edge in plain view. *In wall speakers - $1000.00 Aaron was paid by insurance company to install in wall speakers for surround sound, but did not replace or install speakers.

This is just the beginning on this topic...more later on that Supplies, materials, etc - $130.00 After one of Aarons contractors brought it to our attention that the windows Aaron installed were loose, and not properly sealed. We had to scrape, caulk, and seal each and every window. Money order - $6070.43 Remainder of monies given to Aaron in the form of a cashiers check drawn from Woodforest bank(a copy has been provided) Total amount of all expenses total $20,926.82. All the expenses listed above are legitimate, and were all included in the scope of work. But Aaron did not follow the scope of work. Below are a list of items listed on estimate, that Aaron was paid for, but choose not to do: Final cleaning - $225.26 R&R doorstopn springs - $63.84 Paint bedroom walls 2 tone - $164.63 R&R window drapery bedroom 2 hardware - $76.47 TV wall bracket- $178.08 R&R track lighting hall-$81.60 Fixture for track light-$116.00 Floor protection-$12.81 R&R window drapery hall bath hardware-$76.47 R&R mirror-$234.27 R&R toilet-$329.13($50.00 toilets were installed)

R&R fixture closet-$141.06 Temporary shoring post-$124.72 R&R pegboard-$123.52 R&R cabinetry garage-$866.10 Crane and operator-$1468.00 R&R chimney flashing-$166.70 Brick veneer detach and reset-$9,107.20 Sub room complete-$3,465.48 Total dollar amount of items not performed by Aaron, $23,318.59. The A/C condenser will be reported stolen, and the copy of the receipt has been included with all of our documents sent to BBB. Condenser was paid for under code upgrades, and the receipt will reflect as such. It is not our responsabilty to meet contractors at appointments because Aaron could not. It was their responsabilty to get the house back like it was before the fire. And currently, it has a ways to go. This company feels our personal preferences are of no importance, and continued to go pick out all the things that makes a home personal. 

A extension on the dwelling coverage was personally made in good faith for Aaron that he would finish our house in a timely manner. Wellington says they have never seen a restoration take this long. in fact it has been so long... all the building  permits that were pulled by no problem have expired.  We have left reviews on social media sites that simply expressed our experience with this company, and contained nothing but the truth. We have also been informed that our reviews were well within the limits of the law, so we will continue to let others know our experience and try to prevent this from happening to anyone else. Aaron has also made references like "that crappy house" to us.  Our insurance company also refunded our deductible to us, but Aaron is trying to get that as well.

 Final payment has been given to our attorney. No Problem will not provide lien releases which is a condition set forth by the attorneys. We have began removing negative feedback from the largest site Google in good faith that No Problem would do the right thing and proceed forward with lien releases. If things progress in the right direction, we will continue to remove feedback accordingly.

Due to the nature of our business, our reputation is of utmost importance. We feel we must respond to this review due to information this customer did not disclose. This home has been inspected and approved at 95% completion by their insurance company.

We discovered in Sept 2014 the customer cashed and spent some of the insurance proceeds checks and have told us they do not have the money to pay us what they owe. Customer has received all of the funds from the insurance company but have only paid us $115k of $177k claim.

The customer also did not disclose in their review that the customer chose to reallocate funds for the subroom, speakers, brick so he can have upgrades in his home as well as items insurance did not cover so the customer would have no out of pocket expense.

In efforts to move this family back in, we made an offer for them to release the funds they do have per our contract, let us complete the remaining 5% and we can worry about the open balance after they move in. This offer was made in October 2014.

The customer did have to repair the tile in the bathroom that he removed after it was installed but he also has been working in the home adding specialty lighting to his shower to promote a business. However the promotional video has been made private so it can no longer be viewed on Youtube since it was reported in our response to the BBB. youtube.com/watch?v=YmueaeAaj4c.

The customer has had a check since October 20th with our name on it. Due to the manipulation of insurance funds this customer has displayed, we feel it is in our best interest for this customer to pay us what they owe before we incur additional expenses.
