Noll Collection received a default judgment against me in 2005. I only found out about it after I got notice from my employer that my wages were garnished. By this time it was too late to file a motion to vacate because in IA it needs to be filed within 60 days of the judgment entry. I pulled the case file and found that it wouldn't have mattered because they served an old apartment manager (I didn't live there anymore) and in Iowa in is OK for them to server Apt managers.

To make matters worse, the only evidence they had on me was an "account statement" that listed a Mastercard number. Problem is I never had a Mastercard.

Recently my ex-girlfriend gave me a bunch of old paperwork she had stored in a storage unit for the last 5-6 years. While looking through the old paperwork I found account statements from the Original Creditor of the judgment. I had a Visa card with them and I am more then positive it was paid in full with the Original Creditor.

Noll Collection made she I did not have a chance to fight this in court. I even tried contacting them to see if we could work a deal and they would vacate for some money. They just flat out don't respond. I have tried to contact local lawyers but no one seems to want to take a case that they might not win. I figured I could at least sue them for bringing a fraudulant legal suit against me and possibly collect some damages. I will have the paid judgment on my credit for 7 years and the d**n account wasn't even mine.

If you are ever sued by Noll Collection go to the court house and see what evidence they are using to get a default judgment on you with. More then likely you and I will have the same account number and they will not have proper documentation. The law should provide a solution to a problem like this but it doesn't.

Service is rude.  They will even cut you off and say that you are refusing to pay, while you are trying to negiotate payment arrangements.  They claim that to remove a tradeline from a credit bureau is illegal.  When i asked if that was a federal or state law they hung up on me.  The worst thing is I offered to pay the account in full via certified check, and they said I was refusing to pay and hung up on me.
